        Why Unfair Competition Prevention Law Needs a General Clause Experiences from Japan

        일본 부정경쟁방지법은 부정경쟁행위 일반을 규제할 수 있는 一般條項(general clause)을 두고 있지 아니하며, 단지 부정경쟁행위로서 금지청구를 할 수 있는 행위유형을 한정열거하고 있다. 일반조항이란 예를 들면 업무상의 거래에서 경쟁의 목적을 가지고 선량의 풍속에 반하는 행위를 한자에 대해서는 중지 및 손해배상을 청구할 수가 있다. 일반조항은 새로운 입법을 강구할 필요 없이, 새로운 유형의 부정경쟁행위를 포섭할 수 있는 장점이 있는 반면에, 운용방법에 있어서 법 원에 의하여 판결되기 까지는 무엇이 금지되는 행위인지 알 수 없으므로 오히려 경쟁을 위축시 키는 것이 아닌가라는 우려에서 일반조항의 도입을 미루고 있다. 또한 일본 부정경쟁방지법은 영업사법적 성격을 가져 소비자보호를 위한 입법으로서는 충분하 지 못하다. 동법은 부정경쟁행위에 대한 민사적 구제의 가장 유효한 수단인 금지 및 예방청구권 을 영업상 이익이 침해된 자 및 침해될 우려가 있는 자에 한정함으로써 독일처럼 事業者團體나 消費者團體에게, 나아가서 스위스처럼 消費者에게도 禁止請求權 등을 인정하는 법제에 비하여 소비자 보호가 미흡하다. 오늘날 소비자 보호의 필요성이 점점 높아져가는 점 및 부정경쟁방지 법의 기능 활성화라는 측면을 감안하면 一般條項의 新設이나 事業者團體 消費者團體 등에게 禁 止請求權을 인정하는 것을 신중히 고려하여야 할 것이다. 입법론적 관점에서 저자는 WIPO 모델 안 접근방법에 기초한 법안을 제시한다.

      • The Market Development of PM Aluminum

        The Application of powder metallurgy (PM) aluminum structural parts is at its early growing stage, despite of some automotive applications. The market potential for PM aluminum, however, is large. Growth is expected from the market expansion of the existing applications and new applications, including the replacements of aluminum and zinc based castings and some ferrous PM automotive parts by PM aluminum. Compared to castings, PM is an efficient mass production technology. The PM aluminum is more competitive than die casting for some automotive applications. Besides weight saving leading to performance improvement, the total cost increase for aluminum PM parts is less than 15% compared to ferrous PM automotive parts. The future is promising for PM aluminum.

        Valuation and hedging of options with general payoff undertransactions costs

        We present the pricing and hedging method for options with general payoffs in the presence of transaction costs. The convexity of the payoff function - gamma of the options - is an important issue under transaction costs. When the payoff function is convex, Leland-style pricing and hedging method still works. However, if the payoff function is of general form, additional assumptions on the size of transaction costs or of the hedging interval are needed. We do not assume that the payoff is convex as in Leland [11] and the value of the Leland number is less (bigger) than 1 as in Hoggard et al. [10], Avellaneda and Par´as [1]. We focus on generally recognized asymmetry between the option sellers and buyers. We decompose an option with general payoff into difference of two options each of which has a convex payoff. This method is consistent with a scheme of separating out the seller’s and buyer’s position of an option. In this paper, we first present a simple linear valuation method of general payoff options, and also propose in the last section more efficient hedging scheme which costs less to hedge options.

        Applications of Animal Biosensors: A Review

        <P>Odorous compounds perceived by humans or animal species produce a response in chemical- or electronic-based analytical detection systems (chemical sensors, electronic noses, gas chromatography, mass spectrometers, and so on). Animal noses can also produce a recognizable behavioral response in the animal, when exposed to those compounds. Recently, much attention has been paid to the use of animals for scent detection based on their behavioral responses, referred to as animal biosensors. So far, behavioral odor detection by animals has been applicable in some fields, such as forensic sciences, homeland security, or, more recently, cancer diagnostics. The major advantage of animal biosensors is that the animals can be conditioned rapidly and cost-effectively, offering benefits in terms of noninvasive detection and early diagnosis. Here, we review the applications of living biosensors as whole animal biosensors and discuss the main issues, approaches, and challenges.</P>

        Restricted Blood Flow Exercise in Sedentary, Overweight African-American Females May Increase Muscle Strength and Decrease Endothelial Function and Vascular Autoregulation

        Objectives: Exercise with partially restricted blood flow is a low-load, low-intensity resistance training regimen which may have the potential to increase muscle strength in the obese, elderly and frail who are unable to do high-load training. Restricted blood flow exercise has also been shown to affect blood vessel function variably and can, therefore, contribute to blood vessel dysfunction. This pilot study tests the hypothesis that unilateral resistance training of the leg extensors with partially restricted blood flow increases muscle strength and decreases vascular autoregulation. Methods: The subjects were nine normotensive, overweight, young adult African-Americans with low cardiorespiratory fitness who underwent unilateral training of the quadriceps' femoris muscles with partially restricted blood flow at 30% of the 1-repetition maximum (1-RM) load for 3 weeks. The 1-RM load and post-occlusion blood flow to the lower leg (calf) were measured during reactive hyperemia. Results: The 1-RM load increased in the trained legs from $77{\pm}3$ to $84{\pm}4 kg$ (P < 0.05) in the absence of a significant effect on the 1-RM load in the contralateral untrained legs (P > 0.1). Post-occlusion blood flow decreased significantly in the trained legs from $19{\pm}2$ to $13{\pm}2mL{\cdot}min^{-1}{\cdot}dL^{-1}$ (P < 0.05) and marginally in the contralateral untrained legs from $18{\pm}2$ to $16{\pm}1mL{\cdot}min^{-1}{\cdot}dL^{-1}$ (P = 0.09). Changes in post-occlusion blood flow to the skin overlying the trained and the contralateral untrained muscles were not significant. Conclusion: These results demonstrate that restricted blood flow exercise, which results in significant gains in muscle strength, may produce decrements in endothelial dysfunction and vascular autoregulation. Future studies should determine whether pharmacopuncture plays a role in treatments for such blood vessel dysfunction.

        Effects of Channel Aging in Massive MIMO Systems

        Multiple-input multiple-output (MIMO) communication may provide high spectral efficiency through the deployment of a very large number of antenna elements at the base stations. The gains from massive MIMO communication come from the use of multi-user MIMO on the uplink and downlink, but with a large excess of antennas at the base station compared to the number of served users. Initial work on massive MIMO did not fully address several practical issues associated with its deployment. This paper considers the impact of channel aging on the performance of massive MIMO systems. The effects of channel variation are characterized as a function of different system parameters assuming a simple model for the channel time variations at the transmitter. Channel prediction is proposed to overcome channel aging effects. The analytical results on aging show how capacity is lost due to time variation in the channel. Numerical results in a multicell network show that massive MIMO works even with some channel variation and that channel prediction could partially overcome channel aging effects.

        Two-Dimensional AoD and AoA Acquisition for Wideband Millimeter-Wave Systems With Dual-Polarized MIMO

        <P>In this paper, a novel two-dimensional super-resolution angle-of-departure (AoD) and angle-of-arrival (AoA) estimation technique is proposed for wideband millimeter-wave multiple-input multiple-output systems with dual-polarized antenna elements. The key ingredient of the proposed method is the custom designed beam pairs, from which there exists an invertible function of the AoD/AoA. A new multi-layer reference signal structure is developed for the proposed method to facilitate angle estimation for wideband channels with dual-polarized antenna elements. To reduce feedback in closed-loop frequency division duplexing systems, a novel differential feedback strategy is proposed to feedback the estimated angle pairs. Numerical results demonstrate that good azimuth/elevation AoD and AoA estimation performance can be achieved under different levels of signal-to-noise ratio, channel conditions, and antenna array configurations.</P>

        Auxiliary Beam Pair Enabled AoD and AoA Estimation in Closed-Loop Large-Scale Millimeter-Wave MIMO Systems

        <P>Channel estimation is of critical importance in millimeter-wave (mmWave) multiple-input multiple-output (MIMO) systems. Due to the use of large antenna arrays, low-complexity mmWave specific channel estimation algorithms are required. In this paper, an auxiliary beam pair design is proposed to provide high-resolution estimates of the channel's angle-of-departure (AoD) and angle-of-arrival (AoA) for mmWave MIMO systems. By performing an amplitude comparison with respect to each auxiliary beam pair, a set of ratio measures that characterize the channel's AoD and AoA are obtained by the receiver. Either the best ratio measure or the estimated AoD is quantized and fed back to the transmitter via a feedback channel. The proposed technique can be incorporated into control channel design to minimize initial access delay. Though the design principles are derived assuming a high-power regime, evaluation under more realistic assumption shows that by employing the proposed method, good angle estimation performance is achieved under various signal-to-noise ratio levels and channel conditions.</P>
