해기사 실습생의 법적 지위 및 관리제도 개선 방안에 관한 연구

우리나라는 산업현장에 적합한 인재를 양성한다는 목적 아래 학생들이 정규교육과정 중 일정기간을 특정 기업 또는 기관에서 현장실습을 수행하는 제도를 운영하고 있으며, 해운분야에서는 실습생이 해기사 면허를 취득할 목적으로 선박에 승선하여 일정기간 승선실습교육을 받는 제도가 있다. 최근 해기사 실습생이 현장승선실습 중 사망하는 등의 불미스러운 사건이 발생하였고, 이러한 사건들로 인해서 현장승선실습생 관리제도 개선의 필요성이 제기되었다. 또한 선원법상 실습생은 법적으로 선원의 범위에 포함되어 있지 않기 때문에 인권을 보호하기 위한 제도적 공백이 일부 존재하고 있다. 이 연구에서는 현행 선원법 및 선박직원법상 실습생의 법적 지위, 관리제도 및 교육․훈련에 관한 제도적 검토를 통해서 개선이 필요한 사항을 식별하여 해기사 실습생의 법적 지위를 확립하고 인권보호 및 학습권 보장을 위한 정책 및 법률적 개선방안을 도출하는 것을 목적으로 한다. In order to train suitable person for the industrial field, the Republic of Korea has a system for conducting field training at specific companies for the certain period in the regular education course. Furthermore, in the maritime field, there is a system in which a cadet gets on board a ship, and completes a training programme for a certain period , and acquired a license marine officer, if fulfilled the requirements for. Recently, there have been accidents such as a death of a cadet during on board training. As a results of those, the needs to improve the management system for the cadets on board are suggested. In addition, there are some institutional voids in order to guarantee the rights of learning for cadets and to protect human rights because the cadet is not legally included in the scope of seafarers in accordance with seafarers’ act. The purpose of this study is to identify matters that need improvement in the implementation of international conventions through the institutional review of the legal status, management system, education and training of the cadets in the current seafarers’ act and ship officer’s act. And establishing the legal status of cadets, and preparing policy and legal remedies to protect human rights and the right to training.
