        Purpose: This study was conducted to assess the fall risk factors. Method: The subjects were 87 persons who were older than 65 years living at 28 nursing home in Seoul and Gyunggi province. Subjects were interviewed using RAFS II for intrinsic factor and the environmental factor were assessed using a structured questionnaire from Oct. to Dec. in 2004. The data were analyzed by SPSS(ver. 12.0) programs, using descriptive statistics, $x^2$-test, and t-test. Result: The 37.9% of the subjects experienced the fall, and its average number is $1.94\pm1.75$. The Women's experience of the fall was higher than that of the men, but it was no significant difference with gender. There was no significant difference with the age and duration of living. The mean of the intrinsic risk factor was 13.38 in total score 39 points marks on the RAFS II scales. The intrinsic risk factor score of the fallen group 15.71 was significantly higher than the non-fallen group 12.10. The variables of recent fall experience(t=4.72, p=0.000) and urinary dysfunction(t=2.64, p=0.010) was significantly higher than the non-fallen group. The highest variable of the intrinsic factor was the age and the variables of drug intake, balance, chronic disease, recent fall experience, urinary dysfunction were followed in order. The mean of the environmental risk factor was 0.24 points. No significant differences were shown in environmental risk factor between the fallen and the non-fallen groups. To the fallen group, the place of entrance was the highest risky environmental factor. To see in area dimension, the floor surfaces was the highest risky environmental factor and equipment and illumination factor was the following risky elements in order. In the total score of environmental risk factors based on the ares, the fallen group was 0.26 and the non-fallen group was 0.24, but there were no significant differences between the groups. Conclusion: This results suggested that visual protection strategy, set up the safety device in the place of entrance and inner stairway, bathroom and nonskid mat in the nursing home would be contribute to the prevention of the fall for the elderly.

        웨이트 트레이닝이 한국 창작무용수의 등속성 각근력에 미치는 영향

        This study was aimed to compared the training effects of traditional training and weight training programs for leg strength of Korean dancers. Fourteen subjects were randomly assigned to traditional training group Ⅰ(n=7) and weight training group Ⅱ(n=7). The experimental data was analyzed by two-way ANOVA with repeated measure and significance level was p<.05. The result of this study were as follows: 1. There was a significant differences in systolic blood pressure which was decreased from 119㎜Hg to 116㎜Hg at 4weeks and 111㎜Hg at 8weeks following 8weeks training program for group Ⅱ(p<.05). 2. There was a significant increased in extensor 60° peak torque isokinetic strength and relative isokinetic strength of group Ⅱ(p<.05). 3. There was a significant increased in flexor 60° peak torque isokinetic strength and relative isokinetic strength of group Ⅱ(p<.05). 4. There was a significant increased in extensor mean power and total work of group Ⅱ(p<.05). In conclusion, weight training induces a significant increase in isokinetic strength of Korean dancer. Therefore, these results suggest that weight training program is remarkably need to improve strength and physical fitness of Korean dancer.

        금융소비자보호법 제정이 보험계약에 미치는 영향

        금융소비자보호법이 2020. 3. 24. 제정되어 2021. 3. 25. 시행(전면시행은 2021. 9. 25)을 앞두고 있다. 최근에는 시행령도 금융위원회를 통과하여 법제처에 회부되었다. 아직 규칙이나 고시 등 하위규범까지 완비되지는 않았지만 주요골격은 정해졌다고 할 수 있다. 금융규제는 전통적으로 금융회사의 종류(업태)에 따라 금융소비자를 취급하는 태도에 차이를 두는 방식이었다. 그러나 이와 같은 규제방식이 부당한 규제차익과 예측하지 못한 소비자보호의 사각지대를 만든다는 지적에 따라 동일기능 –동일규제원칙을 적용하였다. 오늘날 금융소비자보호가 G-20 정상회담의 의제가 되고 각국에서 매우 강한 정책목표가 되고 있는 상황에서 이 법이 소기의 제정목적을 달성하는 것이 중요한 과제이다. 그러나 우리나라와 같이 금융소비자보호를 목적으로 모든 금융권에 일률적으로 적용할 공통규정을 제정하는 국가는 아주 드물다. 우리 법이 풀어가야 할 과제가 많다는 점을 시사한다. 이 통일법은 다양한 금융상품을 전반적으로 규율하지만 특히 보험계약에 큰 영향을 미칠 것으로 보인다. 실제로 보험업법의 많은 조항들이 금융소비자보호법으로 옮겨 왔고, 동시에 그 규제내용이 강화되었다. 이와 같은 관점에서 본 연구는 금융소비자보호법 중에서도 특히 보험산업에 미칠 조항들을 살펴보고자 하였다. 첫째로, 그동안의 논의를 살펴봄으로써 이 법의 제정이유와 배경을 정리한다. 이 법의 제정이유를 이해하는 것은 앞으로 이 법의 해석원리와 법개정의 필요성을 판단하는 데에 중요한 기준이 될 것으로 생각한다. 이 법이 시행되기도 전이지만 2020.12.말 현재 이미 개정안이 7건이나 국회에 계류 중에 있다. 둘째, 본고는 특히 보험업계가 관심을 갖는 6가지 판매원칙(적합성원칙, 적정성원칙, 설명의무, 불공정영업행위금지, 부당권유의 금지, 허위‧과장광고의 금지), 위법계약해지권, 징벌적 과징금과 손해배상에 대하여 살핀다. 셋째, 금융위원회 설치 등에 관한 법률에서 금융소비자보호법으로 이관하면서 그 내용이 강화된 분쟁조정제도에 관하여본다. 현재도 금융분쟁의 약 60% 이상이 보험계약에 집중되고 있는 상황을 감안한 것이다. 앞으로 하위규범이 완비되고, 그 후 법의 시행에서 나타나는 여러 문제들에 대하여 학계 및 실무계의 활발한 논의를 통하여 합리적 해석이 이루어지고, 필요한 경우 입법적 보완이 이루어질 것으로 생각한다. The Financial Consumer Protection Act(FCPA) was enacted on March 24, 2020, and go into effect on March 25, 2021 (full enforcement will be on September 25, same year). On January 13, the enforcement decree is also passed Financial Service Commission. Although sub-norms, such as enforcement rules and public announcements by the FSC, have not yet been completed, it can be said that the main contents and the structure of the FCPA have been established. Traditionally, financial entities business activity regulation had different attitudes toward the financial consumer depending on the financial companies type. However, such a regulatory method result in unfair regulatory arbitrage and a blind spot for unexpected consumer protection. The FCPA, thus, introduced the same product-same risk- same regulatory principles. Today, financial consumer protection is the most significant agenda of the G-20 summit. It is also a primary policy goal in each country. Considering the world s strong trend of financial consumer protection, the enactment goal of the FCPA must be achieved successfully. Nevertheless, till now very few countries have enacted the act that applies uniformly to all financial sectors for financial consumer protection. The uniqueness of Korean law suggests that there will be many challenges to the law to be entirely operated to achieve its purpose. The act generally governs various financial products and sectors, but it is expected that it will significantly affect insurance contracts. In fact, many provisions of the Insurance Business Act have been moved to the FCPA, and at the same time the duty of consumer protection of financial institutions has been strengthened. From this point of view, this study attempted to examine the effect of the FCPA s important provisions, especially on the insurance contract. First, the purpose of the enactment and the background information regarding the act will be summarized by examining the debates and discussions surrounding it. Understanding the reasons for enacting the act is meaningful. It will become a substantial standard when deciding the principles for interpretation of the act or when determining the necessity of amendment of the act in the future. As of the end of December 2020, even before this act went into effect, seven revised bills are already pending in the National Assembly. Second, this study is particularly focused on the six sales-principles which the insurance industry is especially interested in(include the principle of suitability, principles of adequacy, the duty of explain, prohibition of unfair business practices, prohibition of unfair solicitation, prohibition against unfair and false labeling or advertising), the right to terminate illegal contracts, and punitive penalties and punitive damages. This study also looks into the reinforced dispute mediation system. The dispute mediation system originally was in the Act on the Establishment, etc. of the Financial Services Commission, is transferred to the FCPA and became more powerful. Transferred and reinforced dispute mediation system is meaningful because the current situations that more than 60% of financial disputes are about insurance disputes. After the regulatory framework of the act and regulations are all settled, the rational interpretation and implementation of the act will be made through active discussions between the academics and industries on various issues regarding the enforcement of the act. It is also expected that, if necessary, legislative supplementation will be made after the debates and discussions on the numerous issues that arise from the act.

        한국 기업인의 ‘기업시민성(Corporate Citizenship)’개념에 대한 담론 분석

        본 연구는 학교 경제교육 개념으로서 ‘기업시민성(CC:corporate citizenship)’ 개념을 탐색한다. CC는 기업이 시민사회의 시민들처럼 공공선에 헌신해야 한다는 개념으로 기업들에 의해 도입되었으나 최근엔 사회학·윤리학 등 다양한 영역에서도 논의가 진행되는 경제 어젠더가 되었다. CC는 이론적으로 확립된 전형적인 경제개념은 아니지만 경제교육은 지식만이 아니라 경제적 현실에 대응하는 시민을 양성한다는 점에서 현실 경제 속 ‘동시대적 경제 의제’를 가르쳐야 할 필요가 있다. 본 연구는 교육개념으로서의 기업시민성 개념을 구성하기 위한 탐색연구로 먼저 기업들이 이를 어떻게 인식하고 있는지 분석했다. 이를 위해 경제단체와 대기업의 신년사를 2017년 4월 각 기업과 단체의 홍보실을 통해 제공받아 담론분석하였다. 분석 결과, 기업과 경제단체들은 기업시민성을 정부와 사회적 요구라는 외부 요인에 강한 영향을 받는 것으로 나타났다. 이런 점에서 시민들의 기업시민성에 대한 자각이 기업의 태도변화와 우리나라 기업의 시민성 수준을 결정할 수 있다는 함의를 찾을 수 있다. This study was conducted as an exploratory research to form the concept of corporate citizenship (CC) as an economic educational idea. In order to define CC as an economic educational idea, it is necessary to understand how companies perceive it. Therefore, this study has explored the concept of CC in the new years messages of three business-related economic organizations and four Korean major corporations through discourse analysis. The results from this analysis shows that the chiefs of these organizations and corporations are aware of this concept, but they are influenced by external factors such as the government’s demands or society’s expectations. On the other hand, some large corporations such as Samsung and SK have developed their own CC discourse in terms of social communication . In a sense, social communication is important for Korean companies to practice the CC discourse. In this regard, it is necessary to form the concept by exploring various elements of the expectation factors of all corporate stakeholders in order to establish CC as an economic educational idea.

      • 국내 ATM 기반 초고속정보통신망의 NNE 적용 모델 연구

        ATM networks are widely deployed as the network that is capable of supporting multimedia services efficiently now. To date, a large portion of ATM connections, particularly in the WAN environment, have been of a permanent virtual circuits-requiring management intervention for set-up and tear-down. However, switched virtual circuits are required to support a range of desired characteristics on demand, to a reachable end user. To establish, maintain and release on-demand call/connections, the user-network interface(UNI) and node-node interface(NNI) signalling capabilities are required. Two protocols have been specified for NNI signalling within a public network : the broadband integrated-services user part(B-ISUP) protocol specified by the ITU-T, and the private network-network interface(PNNI) protocol specified by the ATM Forum. PNNI offers different type of internetwork or internodal interface from the traditional B-ISUP approach favored to date by public network operators. In spite of its name, PNNI may find its place in network service provider networks as well as in private networks. Thus many public network operators and ATM equipment manufactures are still unable to choose the NNI interface architecture of their system. In this paper, we survey the characteristics of the B-ISUP and PNNI protocols, and investigate the applicability issue of these specifications to the ATM-based Information Infra-Network of Korea. Analyzing the characteristics of the two protocols and clarifying the NNI requirements of the ATM-based Information Infra-Network of Korea, we propose that the B-ISUP protocol is more suitable than PNNI.

        보험사기 범죄에 대한 입법적 쟁점에 관한 연구 : 보험사기방지특별법 개정안을 중심으로

        오늘날 보험범죄는 강력범죄의 경향을 보이며 전문화, 조직화, 흉포화하고 있다. 보험사기는 보험범죄의 대표적 유형인데 생계형에서 이득형으로 바뀌고 있고 우리 사회의 가장 흔한 범죄가 되고 있다. 입법적 대응의 미비와 사회의 도덕적 해이로 누구나 저지를 가능성이 높은 잠재적 범죄가 되고 있다. 보험사기 등 보험범죄의 만연은 보험제도의 순기능을 저해할 뿐만 아니라 인명의 손실과 재산손해라는 사회적 비용을 증가시킨다. 2016년 보험사기방지특별법이 제정되었다. 그 때까지 2010년 개정 보험업법 제102조의2가 보험계약자, 피보험자, 보험금을 취득할 자, 그 밖에 보험계약에 관하여 이해관계가 있는 자는 보험사기행위를 하여서는 아니 된다는 조항을 두었고 이어서 2014년 개정 보험업법이 제102조의3을 신설하였으나 주로 금융위원회의 조사권을 보장하는 것이었고 사기행위에 대한 법위반의 형사법적 효과를 직접규정하지 않았던 것에 비하면 큰 진전이라 할 수 있으나 보험범죄에 대한 대응으로는 여전히 미흡하다는 지적이 많다. 최근 보험사기는 그 성공률이 높아 명확한 피해를 확정하기 어려울 정도이다. 본고에서는 보험범죄의 발생 양상을 살펴보고 이에 대한 현재의 대응방안을 점검한 후, 형사법적 대응을 강화하는 방안을 모색한다. 보험범죄에 대한 입법적 대응으로는 민사법적 대응과 형사법적 대응이 모두 필요하다. 다만 본고는 보험사기방지특별법의 개정방향에 초점을 맞추고 있어 민사법적 대응방안은 제외하였다. 이미 보험사기 또는 보험범죄에 대한 선행연구가 다수 있는 점과 최근 국회에 계류 중인 다수의 개정안을 중심으로 살핀 후 개정방안을 제안한다. Today, insurance crimes tend to be violent crimes and are specialized, organized, and ferocious. Insurance crime is changing from a subsistence to a gain and is becoming the most common crime in our society. Due to the lack of legislative response and moral hazard in society, it is becoming a potential crime that anyone is likely to commit. The rampant prevalence of insurance crimes not only undermines the net functioning of the insurance system, but also increases the social costs of loss of life and property damage. In 2016, the Special Act on the Prevention of Insurance Fraud was enacted. Until then, Article 102-2 of the Insurance Business Act was a major step forward compared to the declared provision that policyholders, insurers and others with interests in insurance contracts should not be engaged in insurance fraud, and Article 102-3 enacted the obligations of persons engaged in insurance-related business. However those provisions were intended to empower to the Financial Service Commission to right of investigate and did not directly define criminal penalties for violations of the act. But, special act also insufficient in response to surging insurance crimes. In recently, the success rate of insurance fraud is so high that it is hard to confirm any obvious damage. The author examines the pattern of insurance crimes and seeks legal countermeasures against them. Both civil and criminal legal responses are necessary for legislative responses to insurance crimes. Considering that there are already a number of prior studies on insurance fraud or insurance crimes, the main body examines the revision of the Special Act on the Prevention of Insurance Fraud, which was recently submitted to the National Assembly.
