미국 대학의 스피치 코드에 관한 논의: 스피치의 자유와 혐오 표현 규정 간의 갈등

이 글의 목적은 미국 대학이 공격적인 발언 혹은 혐오 표현으로부터 학생들을 보호하기 위해 스피치 코드 제정과 운영을 둘러싼 갈등의 찬반 입장을 검토하는 것을 목적으로 한다. 대학 당국이 혐오 표현으로부터 약자, 소수자를 위한 교육적·도덕적 노력이 어떻게 전개되는가를 논의하며, 현실 정치의 극단화가 대학 캠퍼스에 미치는 영향을 탐색하는 것을 목적으로 한다. 첫째, 스피치의 자유를 옹호하는 사람들의 근거와 주장을 분석하고, 그리고 스피치 코드 제정과 규정을 지지하는 사람들의 근거와 주장을 검토한다. 둘째, 미국 대학의 스피치 코드에 따른 규제와 제재에 대한 사법부의 다양한 판례를 고찰하며, 스피치 코드의 법적 효력 및 적합성, 합법성과 그리고 스피치의 자유에 관한 법률적 해석과 판단을 탐색한다. 셋째, 현실 정치에서 스피치 자유에 관한 이념적 갈등이 미국 대학 캠퍼스에서 스피치 코드와 혐오 표현 규제에 관한 대립과 갈등으로 확산하는 과정을 탐구하며, 미국 대학의 스피치 코드에 관한 반대와 수용이 어떻게 작용하고 있는가를 논의한다. The purpose of this paper is to examine the pros and cons of establishing and operating a speech code in order to protect students from hate speech at American colleges. It discusses how university administration develops educational and moral efforts for the minorities from hate speech and explores the impact of the polarization of real politics on university campuses. First, it analyzes the arguments of those who support the position of free speech and those who support the regulation of speech codes. Second, it examines various judicial cases on regulations and sanctions under speech codes at American colleges. Third, it also explores the legitimacy aㅜd legal effects of college speech codes. Forth, it investigates the process in which ideological conflicts over free speech in real politics spread to confrontation and conflict over speech codes and hate speech regulations on college campuses. Finally, it discusses how acceptance and opposition of speech codes at American colleges work.
