소년사법제도의 문제와 개선방안

소년은 의사결정을 할 때 합리적인 사고와 판단력을 가지고 하는 성숙된 인격체가 아니기 때문에 범죄를 저질렀다 하더라도 그 정도가 약할 경우 강력한 처벌보다는 교화를 통해 정상적으로 사회에 복귀하도록 지원해야 한다. 이 연구는 이러한 점을 염두에 두고, 소년범죄에 대한 형사사법제도의 현황과 문제를 파악하고, 이에 대한 개선방안을 찾아보고자 한 것이다. 연구결과 다음 세 가지의 개선방안을 제시하였다. 첫째, 전문가 중심의 소년사법제도를 운영해야 한다. 둘째, 소년범죄자의 성공적인 사회복귀를 위해서는 기존의 국가중심 관리체계에서 벗어나 지역사회 중심의 통합서비스 체계로 전환되어야 한다. 셋째, 기존의 처벌 중심의 사법모델에서 벗어나 사회복귀 중심으로 전환해야 한다. Juveniles are not so mature as to make their decisions with reasonable thought and judgement. When they commit a crime, the organization has to assist their rehabilitation through reformation and welfare, rather than more severe punishment, if the offense is not so serious. This paper aims at grasping the current status and problem of crime and justice system over juvenile crime and at searching for improvements. Three improvements as followings are presented as followings. First, it is necessary to operate specialist-centered juvenile justice system. Second, with the purpose of juvenile offender's successful rehabilitation, the existing nation-centered management system has to be changed into regional society-centered integrative service system. Third, the existing punishment-centered justice model has to be changed into rehabilitation-centered restorative model.

가족의 구조·기능적 특성과 청소년의 사회적 배제 수준이 청소년의 비행지속에 미치는 영향

본 연구의 목적은 가정의 구조·기능적 특성과 청소년이 지각한 사회적 배제 수준이 청소년 비행지속에 미치는 영향을 검증하고자 하는 것이다. 이를 위해 본 연구에서는 한국청소년정책연구원에서 실시한 한국아동·청소년패널조사(Korean Children and Youth Panel Survey: KCYPS)의 중1 패널의 2-6차년 패널자료 중 비행의 지속여부를 확인할 수 있는 904명을 대상으로 하였으며, 이산시간위험 모델을 활용하여 기간별로 각 독립변수들의 변화된 값이 청소년 비행지속에 미치는 영향을 보다 정밀하게 분석하고자 하였다. 분석결과 가족의 구조적 특성과 기능적 특성 변수는 청소년비행 지속을 설명하지 못했으며, 사회적 배제에서 추출된 독립변인들 중에서 고용배제, 교육배제(성적), 교육배제(사교육), 사회참여배제(동아리) 변인이 청소년비행 지속을 가장 잘 설명하는 것으로 드러났다. 이러한 연구결과를 통해 비행 청소년에 대한 정책적 제언을 도출하였다. The purpose of this study is to test the effect of family structural/functional characteristics and social exclusion levels perceived by juveniles on persistent juvenile delinquency. For this purpose, the subjects of this study were 904 juveniles whose persistent delinquency could be identified among the 2nd-6th year panel data of the 1st grade in the middle schools from Korean Children and Youth Panel Survey (KCYPS) conducted by National Youth Policy Institute. Using time-discrete hazard model, this study tried to more closely analyze how the values of each independent variable changed by period affected persistent juvenile delinquency. According to the results of this analysis, family structural and functional characteristic variables did not explain persistent juvenile delinquency. In contrast, among independent variables extracted from social exclusion, employment exclusion, educational exclusion (grades), educational exclusion (private education), and social participation exclusion (clubs) variables explained persistent juvenile delinquency most effectively. Through these research results, this study derived policy suggestions for juvenile delinquents.

다문화가정 청소년의 집단괴롭힘 피해경험의 지속에 영향을 미치는 요인

이 연구는 생활양식이론, 일상활동이론, 사회유대이론, 문화갈등이론을 바탕으로 다문화가정 청소년의 집단괴롭힘 피해경험의 지속성에 영향을 미치는 요인을 검증하고자 하는 것이다. 이를 위해 한국청소년정책연구원에서 실시한 다문화청소년패널조사의 중1 패널의 3~6차년 자료를 결합하여 이산시간위험 모델을 통해 분석하였다. 분석결과는 다음과 같다. 첫째, 문화적응스트레스가 높을수록 집단괴롭힘 피해 경험 지속이 많은 것으로 나타났다. 둘째, 비행행동을 많이 할수록 집단괴롭힘 피해경험 지속이 많은 것으로 나타났다. 셋째, 친구애착이 낮을수록 집단괴롭힘 피해경험 지속이 많은 것으로 나타났다. 넷째, 연령이 높을수록 집단괴롭힘 피해경험 지속이 많은 것으로 나타났다. 이러한 결과를 바탕으로 다문화가정 청소년의 집단괴롭힘 피해를 감소시키고 예방하기 위한 실천적 방안을 제시하였다. This study aims to verify the factors having effects on the continuity of victimized experience of bullying of adolescents from multicultural families based on lifestyle theory, routine activity theory, social bonding theory, and cultural conflict theory. For this, this study performed the analysis through the discrete time hazard model by combining the 3-6 year data of middle school(Grade 1) panel of a multicultural adolescents panel study by the National Youth Policy Institute. The results of the analysis are as follows. First, when the acculturative stress was higher, the continuity of victimized experience of bullying was more. Second, when the delinquent behavior was performed more, the continuity of victimized experience of bullying was more. Third, when the peer attachment was lower, the continuity of victimized experience of bullying was more. Fourth, when the age was higher, the continuity of victimized experience of bullying was more. Based on such results, this study suggested the practical measures for decreasing and preventing the victimized experience of bullyin of adolescents from multicultural families.

페터 지마의 사회적 술화와 비판적 대화

Zima bemuht sich, nicht Ideologisch zu sein. Er denkt daruber nach, daß sein Ideologiebegriff beschrankt sei. So wie Zima es angibt, ist seine Theorie schwer auf die gesellschaftliche Konfliktlage anzuwenden. Es scheint naiv zu sein, daß er uberwinden will, aber wie die wahre Erkenntnis hat das vorrecht diese Konfliktlage uberwinden zu wollen. “Kritische Diskussion” ist keine Ubereinstimmung zwischen Subjekte in eine “Idealen Sprechsituation”(Habermas), sondern eine Hilfe zur wahren Erkenntnis des “Objekts”. Es ist wichtig dies vom Subjekt zu fordern. Noch immer geht es um das Verhalten des Subjeks" gegenuber dem Objekt und die Wirklichkeitsveranderung. Zima kritisiert “den Teilenden, den naturalistischen, den monologischen Diskurs” als Ideologie. Solche Kritik ist bedeutsam als Anstrengung fur die Wirklichkeit und Ermoglichung wahrer Erkenntnis, und die Achtung des Anderen mit Ich, d.h. die Veranderung des Zusammenlebens durch kritische Diskussion.

청소년의 비행지속에 영향을 미치는 요인

본 연구는 사회유대이론, 사회학습이론, 일반긴장이론에서 제안된 변인들을 사용하여 청소년 비행지속에 영향을 미치는 요인을 탐색하는 것을 목적으로 한다. 이를 위해 본 연구에서는 한국청소년정책연구원에서 실시한 한국아동청소년패널조사(Korean Children and Youth Panel Survey: KCYPS)의 중1 패널의 2-6차년 패널자료 중 비행의 지속여부를 확인할 수 있는 758명을 대상으로 하였으며, 자료의 분석은 SPSS 18.0 통계프로그램을 이용하였다. 분석결과 사회유대이론, 사회학습이론, 일반긴장이론에서 추출된 변인들 중에서 사회학습이론의 차별접촉변인과 사회유대이론의 참여변인이 비행지속을 잘 설명하고 있으며, 그중에서 차별접촉변인의 영향력이 가장 강력한 것으로 나타났다. 본 연구는 청소년 비행지속을 설명하기 위해 청소년비행이론에서 가장 많이 검증된 세 가지 이론에서 추출된 독립변인들을 바탕으로 청소년 비행지속의 원인을 가장 잘 설명하는 변인들이 무엇인지를 파악했다는 점에서 중요한 의미를 지닌다. The aim of this study is to investigate the factors influencing the continuation of juvenile delinquency by using Hirschi`s social bonding theory, Akers` social learning theory, and Agnew`s general strain theory. We enrolled 758 persons who were able to confirm the continuation of the juvenile among the 2th-6th year panel data of 1 panel of the Korean Children and Youth Panel Survey(KCYPS). The data were analyzed using SPSS 18.0 statistical program. Among the variables extracted from various theories, discriminative contact variables of social learning theory and participation variables of social bonding theory best describe juvenile delinquency. Moreover, among these, the influence of discriminatory contact variables was found to be the strongest. We suggest that our study has a potential strength in terms of identifying the variables that best explain the causes of juvenile delinquency on the basis of extracted independent variables from major theories.
