특수학급이 설치된 일반학교 특수교사의 교권침해 경험과 개선 방안

이 연구는 특수학급이 설치된 일반학교 특수교사가 경험한 교권침해 실태와 지원 요구를 질적 연구를 통해 밝히고, 이를 토대로 특수교사의 교권침해 개선을 위한 실천적, 정책적 시사점을 제시하는데 목적을 두었다. 연구 방법으로는 특수학급에 근무하고 최근 3년 이내에 직·간접적인 교권침해 경험이 있으며 그 정도가 보통 이상인 특수교사 19명에게 개별 심층면담을 실시하였고, 면담 전사 자료를 연속적 비교분석법으로 분석하였다. 자료 분석 결과, 3개의 범주, 8개의 주제와 42개의 하위 주제를 도출하였다. 연구 결과, 3개의 범주는 ‘주체별 교권침해 유형’, ‘교권침해의 원인과 영향’, ‘교권침해 대처 실태 및 개선 방안’이었다. 이에 따른 8개의 주제는 학부모의 교권침해, 관리자의 교권침해, 교직원 및 보조인력의 교권침해, 학생의 교권침해, 교권침해의 원인, 교권침해의 부정적 영향, 교권침해 발생 시 대처 방식, 교권침해의 개선 방안으로 분류되었다. 연구 결과를 바탕으로 특수학급 교사의 교권침해를 예방하고 교권침해 상황을 개선하기 위한 시사점 및 개선 방안을 논의 및 제언하였다. The purpose of this study is (a) to investigates the current state of infringement of teachers’ rights as experienced by special education teachers working at regular schools with a class for special education and their need for support and (b) to suggests practical methods and policy proposals to reduce the infringement of special class teachers’ rights. For the research methodology, in-depth interviews were conducted with 19 special education teachers in charge of a special class who experienced infringement of their teachers’ rights directly or indirectly more than once in the past three years to a moderate or more severe extent. The interview transcription data were analyzed based on the continuous comparative analysis. As a result of the data analysis, 41 sub-themes, 8 themes, and 3 categories were derived. Three themes were identified on the basis of the analysis result: type of infringement, cause and effect of infringement of teachers’ rights, and response to the infringement of teachers’ rights and improvement measure. Eight sub-themes were further identified, including parents’ infringement of teachers’ rights, school managers’ infringement of teachers’ rights, other teachers’ or school staff’s infringement of teachers’ rights, students’ infringement of teachers’ rights, causes of infringement of teachers’ rights, negative effect of infringement of teachers’ rights, response to the infringement of teachers’ rights, and improvement measure. Based on the analysis, we propose methods of how to prevent infringement of teachers’ rights for special education teachers working at regular schools with a special education class and reduce the infringement of teachers’ rights.
