피해자다움을 왜곡한 안희정 1심 무죄 판결의 부당성

The South Korean Court ruled in its first trial that a former Governor Ahn is not guilty on the charges of sexual assault toward his former secretary Ms Kim. The Court offered two arguments for the verdict, <absence of power exercise on the part of Ahn> and <absence of victim-like behaviour on the part of Kim>. Since I discussed on the former elsewhere, I will here concentrate on the latter. The Court pointed out that Kim did not show her victim-like posture, judged that Kim’s claim "she was violated in her rights of sexual autonomy" is not to be trusted, and sentenced that Ahn is not guilty. But there are unreasonable elements on the surface of the Court’s description of victim-like behaviors on the part of Kim. In order to complement these defects the Court would need a hermeneutics for the description which will be justified by the meta system, that is, the language of the natural law. Yet the natural law hermeneutics which is to be inevitable to the Court is counter-intuitional. One may seek an alternative hermeneutics which can be justified by what may be called by the humane law language. The natural law hermeneutics which can be gathered from the written judgment consists of three elements: the existing legal items; the principle of legality; no legislation of rules, whereas the humane law hermeneutics subsists in three elements: rule of law; conscientious autonomy; fairness (to epiekes) between blind submission to laws and negligence of laws. The difference between the two hermeneutics is clearly seen in a comparison of their third elements. The natural law hermeneutics says that the Court cannot punish Ahn because the Court cannot legislate a rule so far as there is no law yet which punishes the act of sexual relationship without consent as a rape, the humane law hermeneutics insists the act to be punished on the merit of fairness to maintain judicial morality. The principle of fairness is a principle not of a simple legality for the rule of law but for the maintenance of a property by which a law is desired in regulating a society. Then it can be said that the Court came to distort the notion of <victim-like behavior>, or of judicial morality, by abandoning the fairness principle which was required, but by adopting no rule legislation attitude which was to be refused out of courage. 법원은 안희정의 김지은에 대한 간음 등 모든 피의사실에 대해 1심에서 무죄를 판결하였다. 판결의 재판부는 이를 위해 <위력행사 부재>와 <피해자다움 부재>의 두 논변을 제시한다. 이 논문에서는 <피해자다움 부재> 논변을 다루고자 한다. 재판부는 피해자가 피해자다움을 보이지 않았다는 이유를 대고 이에 따라 <피해자의 성적 자기 결정권의 침해>를 받았다는 김지은의 진술을 신뢰할 수 없다고 하여 안희정의 무죄를 판결하였다. 그러나 김지은의 <피해자다움>에 대한 재판부의 대상적 차원의 기술은 표면상 무리가 있어 보인다. 재판부의 대상적 기술의 합리성을 구성하기 위해서는 판결문에 대한 의미론적 상승을 통한 상위적 기술로서 제도를 유지하고자 하는 보수적 해석학을 구성하고 그러한 해석학을 정당화할 상위체계로서 자연법적 체계를 제안하면, 자연법적 합리성이 얻어질 수 있다. 그러나 여기에 만족할 수 없다면 대안적 해석학이 요청되고 이는 인간법적 언어체계로 정당화 된다. 자연법적 해석학은 “입법정책적 문제 불개입”을 포함하고, 인간법적 해석학은 “사법적 도덕성을 확보할 수 있는 형평성”을 제시한다. 자연법적 해석학은 <불개입>이라는 조건으로 <부동의 의사에도 불구하고 수행한 성관계를 강간으로 처벌>하는 법은 존재 않기 때문에 안희정을 처벌할 수 없지만, 인간법적 해석학은 사법적 도덕성을 유지하기 위한 형평성으로 처벌해야 한다는 것이다. 그렇다면 재판부는 채택했어야 할 <사법적 도덕성을 확보하는 형평성> 원칙을 버리고 거부했어야 할 <입법정책 문제의 불개입> 원칙을 채택함으로써 사법적 도덕성, 피해자다움의 속성을 왜곡한 것이다.

The purpose of this study was to develop the evaluate scale for an early childhood teacher's role in the transition from kindergarten to elementary school. For this purpose, the evaluation scale was constructed and construct validity and reliability of the scale was tested. In the result of exploratory factor analysis, the evaluation scale was consisted of 5 factors. The result of confirmative factor analysis revealed that RMSEA(.06), GFI(.90), CFI(.92) and TLI(.91) was fit index, and reliability of the scale was supported with Cronbach α with .930. Finally the validity and reliability of the scale was verified, and factors of the scale was confirmed as teaching plan, partnerships with parents, social-emotional supports for children, improvement for learning ability of children, and instruction for children's basic life habits. 본 연구는 유초연계를 위한 유아교사의 역할을 평가하고 활용할 수 있는 평가척도를 개발하고 그 타당성을 검증하는데 목적이 있다. 이를 위해 평가 척도를 구성하고 이에 대한 신뢰도와 구인타당도를 검증하였다. 연구결과, 내적 합치도 검증에서 높은 신뢰수준을 나타내었고, 탐색적 요인분석 결과 5개의 요인이 추출되었으며, 확인적 요인분석 결과 주요 적합도 지수인 RMSEA(.06), GFI(.90), CFI(.92), TLI(.91)에서 적합한 것으로 나타났다. 이에 유초연계를 위한 유아교사 역할 평가 척도의 타당도와 신뢰도가 최종적으로 검증되었으며, 척도를 구성하는 요인은 교수계획, 부모와의 협력, 유아의 사회정서지원, 유아의 학습능력향상, 유아의 기본생활습관지도 5개 요인으로 확인되었다.

Now it’s the time to hear lots of talks about crisis of philosophy and disappearance of humanities. One can assume that the trend of such dialogues is related to a culture that conviction on the modernistic absolute truth is waning and belief’s on postmodernistic pluralism gets strong. How could postmodoernism gain such a strong momentum? I could offer a hypothesis for the question, that is, that philosophy of quantum mechanics played an important role. In my mind, Zhang Hwe-Ik’s book explains how postmodernistic quantum philosophy can replace Newton’s modernistic mechanics and it tries to offer a philosophical paradigm by his own Seoul interpretation on the quantum mechanics, paradigm which is comparable to the role of Kant’s philosophy toward Newton’s classic mechanics. Zhang seems to be successful to lead to be able to get a holistic world view and yet to have tasks to struggle with, one of which is how to offer a grammar of understanding of quantum mechanics without employing Newton-Kant’s notions like individual, identity, causality. 철학의 위기를 말하고 인문학의 소멸을 이야기 하는 시대이다. 그 배경에는 “진리는 유일 체계적으로 기술된다”라는 모더니즘이 쇠퇴하고 “진리는 다원적으로 기술될 수 있다”라는 포스트모더니즘의 등장이 있다. 포스트모더니즘은 어떤 힘으로 이렇게 사회적으로 착근되고 있는 것일까? 그 명제의 설득력은 무엇일까? “포스트모더니즘의 등장에는 양자역학의 철학이 중요한 역할을 했다”고 믿는다. 장회익의 저서는 포스트모더니즘적 양자역학이 어떻게 모더니즘적 뉴턴역학을 대체하고 있는가를 설명한다고 해석하면서 그것이 철학적 패러다임의 하나가 될 수 있다는 것을 보여주고 있다고 생각한다. 저자는 그동안 여러 저술들을 통해 온생명, 과학, 인식, 환경 등의 주제들에 대해 각각 심도 있는 연구를 해 왔지만, 이 책을 통해 그 모든 주제들을 하나의 실타래로 엮어 자신의 철학체계를 포괄적으로 나타낸다. <전집> 형태의 출판을 통해 자신의 체계를 보이고자 하는 시도들과는 대조적이다. 책 제목 또한 뉴턴의 Philosophia Naturalis Principia Mathematica를 닮아 자연에 대한 궁극적인 원리 추구의 열망을 담고 있다. 책의 10가지 주제들은 곽암의 심우십도(尋牛十圖)에 비견할 심학십도(尋學十圖)로 조감하게 한다. 그러나 심학십도의 10가지 주제들은 단순한 나열이 아니라 하나의 관점으로부터 체계화되어 있다. 그 체계적 관점은 양자역학에 대한 자신의 독특한 “서울해석”에 의해 주어지고 있다. 이 서평은 먼저 몇 가지 주제들을 중심으로 책을 요약하고(1~3절) 그리고 책에 대해 토론하고자 한다(4~6절).

Integrationality: A Metaphysical Basis for the Concept of Causation

Philosophers of dispositionalism deny the Humean account of causality in terms of constant conjunction, contiguity, temporal priority and contingency. And some of them go further to explain the causal relation not between events or objects, but between properties, in terms of reciprocity, simultaneity, ubiquity, intentionality and holism. But their exposition seems to remain fragmented even though they try to make use of the notions of intentionality and holism. I would inquire reasons why it is piecemeal, by analyzing that they employ these notions of intentionality and holism which has been constructed within the dualistic tradition. If one wants to make the dispositional project to be powerful, she should look for the notions of intentionality and holism which are free of the dualistic traits and which have been constructed in the tradition of naturalism. The concept of integrationality may be a candidate for such a task. This conception was coined in Zhongyong(中庸) under the name of cheng(誠) in that there is nothing without cheng(不誠無物), and was developed in one of Sok-hon Ham’ the world contains “seed” within it to realize objectives shared by all involved. Humans are privileged and distinct from other natures, but there is continuity between humans and all others. An example of the integrationality applied to the case of humans would be that realization of myself and realizations of all others are one and not two(成己成物). I would summarize notions of “cheng” and “seed” by offering the thesis that there is integrationality in any entity like dispositions such that the integrationality is a power to realize the embedded objective of it in the context where it interacts with all others. I would claim that integrationality is a metaphysical basis for a way of human thinking, by arguing that it is a necessary part of presupposition for our understanding of the world without which the world is not intelligible. The notion of integrationality is involved empirically as well as conceptually. Empirically, there are numerous reports from physics, biology and information science, which provide with a clue which may well be taken to show the ubiquitous integrationality. But some conceptual considerations would also indicate necessarily toward the same direction. These would include various theses of ontology, epistemology, disposition, modality, naturalized intentionality, fitting and topics like these. I will investigate some of them in order to justify my claim of this paper.

효율적인 대화형 천 시뮬레이션 기법

We present an interactive cloth simulation method based on the mass-spring model, which is the most widely used one in the field of cloth animation. We focus especially on the case where relatively strong forces are applied on relatively small number of mass-points. Through distributing the forces on some specific points to the overall mass-points, our method simulates the cloth in pseudo-real time. Given a deformed cloth, we start from resolving the super-elasticity effect using Provot's dynamic inverse method [9]. In the next stage, we adjust the angles between neighboring mass-points, to finally remove the unexpected zigzags due to the previous super-elasticity resolving stage. 본 논문에서는 질점-스프링 모델(mass-spring model)에 기반한 대화형 천 시뮬레이션(interactive cloth simulation) 기법을 제시하며, 특히 소수의 질점들(mass-points)에 상대적으로 강한 힘이 가해졌을 경우 사실적으로 천을 시뮬레이션하는 방법에 초점을 맞추었다. 본 논문에서 제시하는 방법은 소수의 점들에 대해 가해진 힘을 모든 질점들에 분산시킴으로써 의사 실시간(pseudo real-time) 내에 시뮬레이션을 수행하며, 이는 기존의 방법들에 비해 수행속도 면에서 매우 효율적이다. 또한, Provot[9]의 역동역학 방법(inverse dynamic method)을 사용하여 초탄성(super-elasticity) 현상을 해결한 뒤, 인접한 질점 간의 각도를 조정함으로써 초탄성 효과에 의해 발생하는 지그재그(zigzag) 현상을 제거하여 사실적으로 천을 시뮬레이션한다.
