정다운 가천대학교 법학연구소 2024 가천법학 Vol.17 No.1
The duty to disclose information is the obligation of the owner of the subject matter of the contract to provide important information about the subject matter that may affect whether or not the contract is concluded. In case of violation of the duty to disclose information, if the contract is fundamentally impossible, the person obliged to provide information must compensate for reliance damages. In addition, in cases where the contract is terminated due to violation of the obligation to provide information, or even when the contract is intended to be maintained, it may be reasonable for the victim to claim reliance damages. If a contract is concluded based on a violation of the duty to provide information, it can be expected that if important information about the subject matter of the contract had been provided, the contract would not have been concluded or the contract would have been concluded with a lower amount of compensation in return. These relience interests includes lost opportunity, expenditure and damage on defect of goods. In the case of a violation of the duty to disclose information, receiving compensation for damages for lost opportunities among these relience damages may be the most reasonable and clear compensation method.
