탄핵심판의 측면에서 본 현행 재판관 제도의 문제점과 해법

Many problems have been raised regarding the current Constitutional Justice(hereinafter reffered to as “CJ”) system. This paper focuses on the problems of the vacancy of in the Constitutional Court(hereinafter reffered to as “CC”) and the composition of the CC that might cause some adverse effects on the legitimacy of the CC’s decision in a relatively direct way. Since the impeachment trial shows the severity of these problems most clearly, we could understand in this procedural background how these problems arise, why they become critical, and how they could be ameliorated. The impeachment trial has a greater political character than any other jurisdiction of the CC, so it is very difficult to appoint a replacement when a CJ’s term comes to an end during the trial. In addition, in case of impeachment against a CJ, the CJ should be excluded from the trial, which also leads to the vacancy of the CC. This is why the impeachment trial, whether for political or legal reasons, is closely linked to the problems of the vacancy of the CC. In this paper, we examined the system of temporally continuing the duties of CJ and the substitute CJ system as a solution, but both were insufficient, so increasing CJs and restructuring the CC was suggested as alternatives. Concerning the composition of the CC, it has been criticized for the weak democratic legitimacy of nomination by the Chief Justice of the Supreme Court and the fact that nomination by the President causes difficulties for realizing the proportion of CJs consistent with that of people’s political support. In addition to these arguments, this article shows that nomination by the President and the Chief Justice of the Supreme Court, who are subject to the impeachment trial, could cause some serious problems for the well-functioning of the trial. In this respect, we again come to a conclusion that it is most recommendable that the National Assembly elect all CJs. 현행 헌법재판소 재판관 제도에 대해서는 여러 문제점들이 지적되어 왔다. 본고는 그중에서도 결정의 정당성에 보다 직접적으로 부정적 영향을 끼칠 수 있는 재판관 결원의 문제와 재판관 구성방식의 문제에 주목했다. 이들 문제의 심각성이 탄핵심판과 관련하여 가장 뚜렷하게 부각된다는 점에서, 탄핵심판이라는 구체적 절차 속에서 이 문제들이 어떻게 발생하고, 왜 심각한 문제가 되며, 이를 어떤 방식으로 해결해야 할 것인지를 살펴보았다. 탄핵심판은 헌법재판소의 어느 다른 심판보다도 정치적 성격이 크므로, 탄핵심판 진행 중 재판관의 퇴임 등 결원이 발생하면 그 후임 재판관을 임명하기가 매우 어렵다. 또 재판관에 대한 탄핵사건에서는 필연적으로 재판관의 결원이 발생한다. 탄핵심판이 정치적 이유에서든 법적 이유에서든 재판관의 결원 문제와 긴밀히 연결되어 있는 이유이다. 본고에서는 이 문제의 해법으로 재판관 직무계속제도, 예비재판관제도를 검토했으나 모두 미흡하다고 판단해 재판부 확대와 구조변경을 대안으로 제시했다. 재판관 구성방식의 문제와 관련하여, 대법원장의 지명권에 대해서는 약한 민주적 정당성이, 대통령의 지명권에 대해서는 국민의 정치적 의사비율과 비례하는 재판관 구성비율의 실현을 저해한다는 점이 비판을 받아 왔다. 본고에서는, 이에 더하여, 탄핵심판의 대상자인 대통령과 대법원장이 자신에 대한 탄핵심판을 수행할 재판관의 지명권을 가지는 것이 탄핵심판제도의 원활한 작동과 이 제도에 대한 국민의 신뢰를 훼손할 우려가 크다는 측면에서 상당한 문제를 초래한다고 보았다. 국회가 재판관 전원을 선출하는 방안은 이 측면에서도 가장 합당하다는 것이 본고의 관점이다.

Judicial participation has been discussed in terms of judicial democratization, but this paper examines it from the aspect of social integration. Citizen involvement in public affairs can be significantly conducive to social integration. This is also the case for judicial participation. While the discussions so far have focused on the issue of participation in trials, such as the jury system or layman judge system, this article attempts to broaden the scope of discussion by dividing judicial participation into direct participation, indirect participation, and participation in public opinion on justice. Direct participation as a jury has been recognized as a classic example of judicial participation, but that is not a common experience for ordinary citizens. There are some limits to the indirect participation in that we don’t choose an election system for judges. Therefore, this paper pays attention to the meaning of participation through litigation and participation in public opinion formation. Judicial participation and social integration are not in a simple proportional relationship. Constitutional principles governing judicial system concern not only democracy, but also professionalism and independence, all of which are important social resources for social integration. Emphasizing the principle of democracy alone can undermine those of judicial professionalism and independence, which can be a hindrance to social integration. This paper is in a position that the power of judicial participation to make societies get integrated could be effectively exercised as far as it strengthens the principle of democracy while the judicial professionalism and independence could be respected and preserved. In this regards, it is necessary to consider plans for reform to further expand the scope of the lay participation in trials, which is currently limited to a few trials, and to reinforce the representativeness of the citizen participating in trials. To make judicial participation more efficiently, among others, the disclosure of the judgment must be expanded. 사법참여는 그 동안 사법의 민주화 측면에서 논의되어 왔으나, 본고에서는 이를 사회통합의 측면에서 살펴보았다. 시민의 공적 업무에 대한 참여는 사회통합에 기여할 수 있다. 이는 사법에 대한 참여 역시 마찬가지이다. 그간의 논의가 배심제와 참심제 같은 재판참여 문제를 중심으로 해 왔다면, 본고는 사법참여를 직접참여, 간접참여, 여론참여로 구분해 논의범위를 넓히고자 했다. 배심원으로서의 직접참여는 사법참여의 대표적인 방식이지만, 이는 일반국민이 흔히 경험하는 일이 아니다. 간접참여는 우리가 법관에 대한 선거제를 채택하고 있지 않다는 점에서 한계가 있다. 이에 본고는 소송행위를 통한 참여와 여론형성을 통한 참여의 의미에 주목하고자 했다. 사법참여와 사회통합이 단순 비례관계에 있는 것은 아니다. 사법을 지배하는 헌법적 원리에는 민주성뿐만 아니라, 전문성, 독립성 등도 있으며, 이들은 모두 사회통합을 위한 사회적 자원이다. 참여만을 강조하다보면 사법의 전문성, 독립성 원리가 훼손될 수 있는데, 이는 사회통합을 저해할 수 있다. 본고에서는, 사법참여의 사회통합적인 힘이 사법의 전문성과 독립성을 존중, 보존하는 가운데, 민주성을 강화하는 범위에서 원활하게 발휘될 수 있다는 입장을 제시했다. 이 측면에서, 현재 일부 재판으로 국한된 국민참여재판의 대상범위를 좀 더 확대하는 방안, 재판참여 국민의 대표성을 강화하는 방안 등을 고려할 필요가 있다. 그리고 효과적인 사법참여를 위해서는 무엇보다도 판결서 공개가 확대되어야 한다.
헌법재판과 대의민주주의 - 헌법재판을 포용한 대의민주주의의 정당성과 효용성 -

입법을 무효로 만들 수 있는 헌법재판은 그것이 선출되지 않은 재판관에 의해 이루어진다는 측면에서 민주적이지 않다는 비판과 직면해 왔다. 그러나 오늘날 헌법재판은 민주헌정을 추구하는 대다수의 국가들에서 수용되고 있다. 헌법재판이 민주적 손실을 가져옴에도 불구하고 기본권보호와 같은 더 큰 이익을 성취할 수 있다는 것이 일반적인 설명이나, 본고는 그 이유로 헌법재판이 민주적 이익을 달성할 수 있는, 즉 대의민주주의를 더 나은 민주주의로 만드는 역할을 수행한다는 측면에 주목하고자 한다. 이를 위해 먼저 헌법재판이 대의민주주의와 모순되지 않음을 살펴본다. 민주주의는 다양한 해석에 개방되어 있고, 입헌의 차원에서 헌법재판 역시 주권자의 민주적 의사결정으로 볼 수 있다. 근대 민주주의가 비선출직이 수행하는 입법적 역할의 정당성을 인정해 온 상황 또한 고려될 수 있다. 헌법재판은 따라서 민주주의의 규범적 이상에 어긋나지 않는다. 그러나 헌법재판이 대의민주주의의 자명한 귀결이라는 입장도 아니다. 헌법재판의 포용 여부는 성과와 효용의 문제일 뿐이다. 헌법재판은 이러한 성과와 효용이 인정되는 한에서 지지될 수 있는데, 본고에서는 대의민주주의의 개선과 민주적 증진에 있어서 상당한 성과를 산출할 수 있다는 측면을 집중적으로 검토해 보았다. 이러한 성과는 대의민주주의의 형식 개선, 결함 보완, 민주적 지향성 강화 측면에서 확인할 수 있다.
폴란드 헌법재판소의 위기와 그 헌법적 함의 — 헌법재판소와 정치권력 간의 긴장관계를 중심으로 —

This article analyzes the causes and the progress of the crisis in the Polish constitutional court/tribunal since 2015 and reflects on the constitutional implications of the Polish case from the perspective of the tension between the constitutional court/tribunal and political power. The constitutional court/tribunal checks political power and should be independent of political power. At the same time, however, the constitutional court/tribunal is in a situation where it is dependent on political power, both in terms of the composition of its personnel and the formation of its judicial system. This conflicting relation between the need for independence and the need for dependence creates a certain tension between the constitutional court/tribunal and political power. Political powers, especially those with a parliamentary majority, are exposed to the incentives to tame a constitutional court/tribunal that binds them and to enjoy arbitrary rule. If these incentives are not managed stably, the constitutional court/tribunal can become an ally or supporter of the political power. Poland has failed to do so, causing a constitutional court/tribunal crisis. In this article, we focus on the institutional aspects. The Polish system gave the parliamentary majority a monopoly on the composition of the court/tribunal and did not provide sufficient means for the opposition to check it, which made it easy for the parliamentary majority to mold the court/tribunal into its political cronies. This paper is on the position that this case can serve as a lesson for improving our system. Also noteworthy in the Polish case is the constitutional court/tribunal's response to several legislative attempts to undermine it. This article considers possible solutions for our constitutional court system by analogizing this situation to our own. 이 글은 2015년 이후 폴란드 헌법재판소가 겪은 위기상황의 원인과 흐름을 분석하고, 헌법재판소와 정치권력 간의 긴장관계라는 관점에서 폴란드 사례의 헌법적 함의를 곱씹어 본 글이다. 헌법재판소는 정치권력을 견제하는 기관이므로 정치권력으로부터 독립되어 있어야 한다. 그러나 그와 동시에 헌법재판소는 그 인적 구성이나 재판제도의 형성 측면에서 정치권력에 의존하고 있는 상황에 처해 있다. 독립의 요청과 의존의 필요성이라는 길항적인 구도 속에서 헌법재판소와 정치권력 간에는 일정한 긴장관계가 형성된다. 정치권력, 특히 의회의 다수를 점한 집권세력은 자신을 구속하는 헌법재판소를 길들여 편의적 통치를 누리려는 유인에 노출되어 있다. 이러한 유인을 안정적으로 통제하지 못한다면 헌법재판소는 정치권력의 동료집단 혹은 서포터로 전락할 수 있다. 폴란드는 그러한 통제에 실패해 헌법재판소의 위기를 불러왔다. 이 글에서는 그 원인으로 특히 제도적 측면에 주목하고자 했다. 폴란드 제도는 의회 다수세력이 헌법재판소에 대한 구성권을 독점하도록 하면서도, 야당 등이 이를 견제할 수 있는 수단을 충분히 마련해 놓지 않았다. 그로 인해 의회 다수세력이 헌법재판소를 자신의 정치적 동료집단으로 주조할 수 있는 시도가 손쉽게 성공할 수 있었다. 본고는 이 사례가 우리 제도의 개선을 위한 교훈이 될 수 있다고 보았다. 정치권력이 헌법재판소를 약화하기 위해 시도한 여러 입법적 공세에 대하여 헌법재판소가 내놓은 해법도 폴란드 사례에서 주목할 부분이다. 본고는 이러한 상황을 우리의 것으로 가정해 봄으로써 우리 헌법재판제도 안에서 가능한 해법들이 무엇인지를 생각해 보았다.
헌법재판소에 대한 견제- 감시자를 감시하는 방식에 관한 고찰 -

헌법의 수호자로서 헌법재판소는 국가권력을 감시하고 견제하는 역할을 한다. 그러나 헌법재판 역시 국가권력 작용이므로, 헌법재판소에 대한 감시와 견제도 헌법학적으로 규명되어야 할 중요한 문제이다. 다만 헌법재판소에 대한 견제는 헌법재판의 독립, 소수자 보호 문제와 일정한 긴장관계를 형성하고, 재판소의 기능과 권위를 약화시킬 우려가 있음에 주의해야 한다. 헌법재판소에 대한 견제는 재판관의 임명절차에 대한 관여, 재판관 탄핵을 통해 이루어질 수 있다. 또 헌법재판소가 합당한 근거 없이 법률에 대한 위헌결정을 내릴 때에는, 그 법률을 다시 입법하거나 혹은 그것을 헌법으로 도입할 수도 있다. 만약 헌법재판소로 인한 문제가 도를 지나쳐 이 제도를 그대로 유지할 수 없다고 판단된다면, 이 기관의 권한을 축소 혹은 폐지하거나, 이 제도 자체를 없애는 것도 가능한 선택이다. 그러나 이러한 방식의 활용이 언제나 정당화되는 것은 아니다. 우선 이 견제는 헌법재판소의 문제에 상응하는 수준에서 이루어져야 한다. 무엇보다도, 헌법재판소의 기능을 제약하거나 훼손하는 조치는 각별한 신중함을 필요로 한다. 이는 결과적으로 헌법상 안전장치를 제거하는 것이 되어, 이후 민주주의와 인권보장에 유해한 상황을 초래하기 때문이다. 따라서 이들 조치는 그로 인한 해악과 다른 대안적 수단에 대한 면밀한 검토 위에서 매우 신중하게 고려되어야 한다. 또한 이 견제는, 다수의 현실적인 의사나 감정 혹은 사회의 오랜 편견에 기초한 실천이 아닌, 민주주의와 법치주의, 자유와 평등, 정의와 연대 같은 헌법의 기본원칙과 이념을 실현하고 관철하기 위한 실천이어야 한다. 헌법재판소는 우리 헌법이 이러한 견제수단을 마련해 두고 있음을 언제나 의식하고 있어야 한다. 이 견제는 헌법재판소가 헌법의 기본원칙과 이념의 실현이라는 임무를 소홀히 하거나 그 권한을 남용할 때 혹독하게 가동될 수 있음을 유념해야 한다. 바람직한 형태는, 이 견제수단이 현실적으로 활용되지 않더라도 그 존재만으로 헌법재판소를 항상 깨어 있게 하고 자신의 임무를 올바르게 수행하도록 만드는 모습일 것이다. As a guardian of the Constitution, the Constitutional Court oversees and checks state power. However, since the Constitutional Court is also part of the state power, the check on the Constitutional Court is an important subject that needs to be treated in constitutional theory. It should be noted that the check on the Constitutional Court is in tension with the independence of the Court and the protection of minorities, and it may weaken the functions and authority of the Court. The check on the Constitutional Court can be performed through involvement in the appointment process of constitutional judges and impeachment of them. In addition, when the Constitutional Court makes unconstitutional decisions on statutes without any reasonable argument, it can be re-enacted or introduced into the Constitution. If the problems caused by the Constitutional Court are too serious to keep the adjudication system intact, it is also possible to reduce or abolish its functions, or eliminate the that system. However, the use of these instruments is not always justified. First of all, this check must be proportional to the faults of the Constitutional Court. There should be special prudence for measures that restrict or undermine the functions of the Constitutional Court, especially. This would result in the removal of constitutional safeguards, which could later lead to detrimental conditions for democracy and human rights. In this connection, these measures must be considered with great prudence under a close examination of the evils that could be brought about by them and other alternatives. This check should be practices aimed at realizing and carrying out the basic principles and philosophy of the Constitution, such as democracy and rule of law, freedom and equality, justice and solidarity, rather than those based on temporary views and emotions of the majority or long-standing prejudices of the society. The Constitutional Court must always be aware that the Constitution provides many instruments to check on the Court itself. It should keep in mind that these instruments could be used severely when the Court neglects its task or abuses its power. It would be most desirable that the existence of such instruments sufficiently make the Constitutional Court stay awake at all times and carry out its duties well, without those being put in practice.

Since the constitutional interpretation is based on the constitutional text, the constitutional interpretation against the constitutional text may sound like a contradiction. However, this interpretation, though rarely, is applied to the constitutional cases and claimed as a doctrine. In this article, I have examined why this phenomenon occurs, what cases and arguments can be found in terms of this interpretation, and under which conditions this interpretation can be justified. Among cases of domestic and foreign Constitutional Courts and arguments in our academic society, there are those that can be regarded as the constitutional interpretation against the constitutional text. The interpretation of the Constitutional Court of Korea on whether foreigners can be the subject of basic rights, some scholars’ claims related with it, the interpretation of many foreign constitutional courts on the jurisdiction to review constitutional amendments, and some of the interpretations on the Article 8 of the current Constitution, and on the Article 53 paragraph 4 of the 1972 Constitution can be explained from this point of view. The problem of the legal norm which is legitimate formally, but illegitimate materially is generally said to be resolved with the notion of the hierachy of norms with the limited government, and the constitutional review that fulfills the supremacy of the Constitution. However, since the Constitution doesn’t have norms superior to it, this problem is still latent at the level of the Constitution. The constitutional interpretation against the constitutional text is considered as a solution to this exceptional problem. The specific provisions of the Constitution are not always right and just. However, such provisions don’t always justify the constitutional interpretation against it. This kind of constitutional interpretation can be taken into account in a situation where the basic principle and philosophy of the Constitution are seriously undermined when the constitutional text is applied as written. When the problem caused by it may be resolved by a rapid constitutional amendment or by harmonious interpretation, namely practical concordance, it is desirable that this interpretation be restrained. 헌법해석은 법문언을 기초로 하므로, 문언에 반하는 헌법해석은 모순적으로 들린다. 그러나 드물기는 하지만 이 해석기법은 재판에 활용되고 학설로도 주장된다. 본고에서는 왜 이러한 현상이 생겨나는지, 그러한 해석사례들로는 어떤 것들이 있고 또 이것이 실제로 존재하는 해석이라면 과연 어떤 조건하에서 정당화될 수 있는지를 살펴보았다. 국내외의 사례들과 우리 학계에서의 주장들 중에는 문언에 반하는 헌법해석으로 볼 수 있는 것들이 있다. 그 중에서 외국인의 기본권주체성에 관한 우리 헌법재판소의 해석, 그와 관련된 일부 학설들, 헌법개정의 위헌여부 심사권에 관한 여러 해외 헌법재판소들의 해석, 그리고 현행헌법 제8조 제4항과 유신헌법 제53조 제4항에 관한 일부 학설들의 해석을 짚어 보았다. 형식적으로는 정당하지만 내용적으로는 부당한 법의 문제는 헌법을 최고규범으로 하는 규범서열과 헌법에 의한 국가권력의 구속과 제한을 추구하는 제한정부 관념, 그리고 이를 관철할 수 있는 위헌법률심사 제도를 통해 성공적으로 해결되었다고 평가된다. 그러나 헌법은 그보다 더 우월한 규범이 없기 때문에, 헌법의 차원에서는 이 문제가 여전히 잠재되어 있다. 문언에 반하는 헌법해석은 이 예외적인 상황에 대한 해법으로 고려될 수 있다. 헌법의 개별 규정이 늘 옳고 정의로운 것은 아니지만, 헌법에 부당한 내용이 포함되어 있다 해서 문언에 반하는 헌법해석이 언제나 정당화되는 것도 아니다. 그 조항이 헌법의 기본원칙과 이념을 심각하게 훼손해 헌법의 문언에서 벗어나는 해석만이 헌법의 기본원칙과 이념을 보호할 수 있는 경우에 한해 그러한 해석이 예외적으로 정당화될 수 있다. 그 조항으로 인한 문제가 조속한 개헌을 통해 혹은 조화적 해석을 통해 해결될 가능성이 있을 때 이러한 해석은 자제되어야 한다.
구체적 규범통제사건의 심사방식에 관한 소고 : 당해사건 고려 및 재판전제성 인정범위 문제를 중심으로

The Constitutional Court of Korea(hereinafter referred to as “the Court”) has the jurisdiction over concrete norm control. That procedures are composed of a constitutional review of statutes requested by ordinary courts and a constitutional complaint under para. 2 of Art. 68 of the Constitutional Court Act(hereinafter “a complaint under §68-2”). There are two contradicting necessities in these concrete review proceedings. On the one hand, the Court should make judgments upon the minimized scope of laws, the constitutionality of which is a prior question in its original case. On the other hand, for a decision of unconstitutionality nullifies statues and has an erga omnes binding force, the Court is faced with the necessity to examine the constitutionality of legislation in its entirety independent of its original case, i.e. from all constitutional points of view. This paper aims at exploring various ways to take original case into consideration while the Court scrutinizes the constitutional validity of legislation from all constitutional points of view. Provisions on review should be reduced to the most essential part being at issue at the underlying trial. For that, the Court should establish strict standards for clarifying the subject of review and checking whether preconditions of a trial are fulfilled. In addition the Court’s decision should be expressed in a way to be of help in dealing with its original case. Decisions of limited constitutionality or unconstitutionality to the constitution can be made efficient use of here. Making decisions of nonconformity with an order granting temporary application or prohibiting application, the Court could be allowed to offer its original case special and different treatments. The purpose of a constitutional review of statutes requested by ordinary courts puts relatively greater weight on keeping judgments and the entire legal order constitutional. To the contrary a complaint under §68-2 is an institutional device for a petitioner to be given a chance to win his trial with the decision of unconstitutionality. On this account, if a petitioner can’t win his trial with that decision, precondition of a trial does not seem to be fulfilled. For example, in those cases, where a decision of unconstitutionality has an effect only on reasons for the judgment in its original case or only on interlocutory judgment without changing any final judgment, precondition of a trial doesn’t be considered to be met. 우리 헌법재판제도는 구체적 규범통제제도를 채택하고 있으며, 위헌법률심판제도와 제68조 제2항 심판제도가 여기에 속한다. 우리의 구체적 규범통제제도에는 “구체적”에 주목해 심사범위를 당해사건에 연관된 범위로 제한할 필요성과 “규범통제제도”의 객관성을 중시해 당해사건에 구속되지 않고 보편적 관점에서 심사해야 할 필요성이 공존한다. 이 글에서는 헌법재판소가 전체 헌법적 관점에서 법률의 위헌여부를 심사할 때, 당해사건을 보다 적극적으로 고려하는 방식에 관하여 생각해 보았다. 우선, 본안판단 대상을 당해사건과 관련된 범위로 최대한 한정하여야 하는데, 이를 위해서는 심판대상의 확정이나 재판의 전제성 심사에서 보다 엄격한 입장을 취할 필요가 있다. 다음으로, 전체 헌법적 관점의 심사를 행함에 있어서도, 심사의 결론은 당해사건을 타당하게 해결할 수 있도록 표현되어야 한다. 여기서 한정위헌결정이나 한정합헌결정이 유효한 기법으로 활용될 수 있을 것이다. 잠정적용이나 적용중지를 명한 헌법 불합치결정에 있어서도 당해사건에 관해서는 구체적 타당성을 위해 특별한 취급이 요구된다. 한편, 위헌법률심판은 재판권의 합헌적 행사, 객관적 법질서의 합헌적 유지 등의 목적이 상대적으로 더 큰 반면, 제68조 제2항 심판은 심판관련 당사자가 당해소송의 소송상 목적을 달성하기 위한 측면이 더 강하다. 따라서 제68조 제2항 심판에서는 위헌결정으로 당사자가 당해소송에서 승소결과를 얻을 수 없는 경우에는 재판의 전제성을 부정함이 타당하다. 가령, 위헌결정이 판결주문에는 영향을 주지 못하고 오직 판결이유에만 영향을 주는 경우, 일부 중간재판 중 위헌결정으로 중간재판의 효력이 상실되더라도 본 재판의 결론에까지 영향을 미치지 않는 경우 등에서는 재판의 전제성을 부정할 필요가 있다.

The name of Adam Smith is inextricably linked with modern economics. The most fundamental goal of his academic life, however, was the study of the principles of law and government. He formally declared this goal, pursued it throughout his life, and wrote The Wealth of Nations as a partial fulfilment, contributing to his immortality as a thinker. Although Smith was not a scholar dedicated to the study of democracy, he did explore the principles of law and goverment, and his writings contain rich discussions of political decision-making issues from which we can infer his understanding of democracy. This paper reconstructs them through the lens of realising and limiting majoritarianism. While Smith's view was that majoritarianism should be at the centre of political decision-making, and he emphasised the role of elections as a means of realising majoritarianism, this does not mean that the path to majoritarianism is limited to elections. Rather, this paper argues that Smith saw the role of public opinion in influencing public deliberation as an important means of realising majoritarianism. In this regard, Smith identified the problem of class bias in public opinion based on socioeconomic conditions as a reason for the adoption of mercantilism, and recognized the role of the state in addressing this problem. Smith's discussion has significant relevance to the problem of the limited political role of the people in today's democracies, and the need for the active exercise of political liberty to prevent the implementation of unjust policies that violate liberty. At the same time, Smith also touched on the possibility of the limiting majoritarianism. Majoritarianism is typically realised through representative legislation, and Smith recognized the existence of a higher normative content that guided statutory law by regarding such parliamentary legislation as aiming to be consistent with the rules of natural justice that arise from the sympathy of human nature. Smith also emphasized the existence of the state's duty of equal treatment as a normative principle that guides legislation in the area of police. Essentially, Smith recognized that representative decision-making is constrained by more fundamental norms. On the other hand, by locating the source of this limitation in the moral principles or political will emanating from the members of the state as a whole, Smith is credited with showing that the limitation of representative decision-making and the ideology of majoritarianism may not be incompatible. By viewing a constitution based on popular sovereignty as a product of the will of the majority, being higher democratic law-making than ordinary legislation, Smith's position has a similar logical structure to the current debate that even if a constitution appears to limit representative legislation, it can ultimately be reconciled with the ideology of majoritarianism.
