          설계공모지침 분석을 통한 국내 어린이집 공간구성의 획일화 원인 분석

          Nursery is a very important space for the development and growth of children. Domestic national nurseries mostly have uniform space composition, and there is no significant difference from the general architecture. Therefore, this study focused on presuming the cause of uniformity in domestic nursery space configuration through analysing the competition guidelines. For this purpose, we reviewed the procedure of the competitions and collected 57 competition guidelines for the last 10 years. The competition guideline was divided into design guidelines and evaluation items, and each of them were analysed focused on the contents of the items and the changes over time. The derived results suggested the problems which seem to affect the uniformity of the domestic nursery in three aspects: design guidelines, evaluation items, and the current procedure of nursery competitions.

          This study examines the impacts of ethnic restaurant image on intention to participate in food tourism. Survey were conducted in ethnic restaurants located in Seoul, Korea. A total of 427 were used for further data analyses. Results show that food and atmosphere among the image of ethnic food restaurant have significant effects on intention to food tourism. This signifies that traditional foods tasted in an ethnic restaurant and the atmospheres of a restaurant built by the country's traditional style have important influences on tourists' intention to participation. Thus, above all, the roles of Korean restaurants located in each country are very important to raise awareness on Korean food and attract foreigners through food tourism. Therefore, it is essential to develop differentiated and unique menus suitable for foreigners' tastes to arouse foreigners to visit Korea and eat the foods, and the interiors of Koreans restaurants should be renovated into traditional and antique atmospheres matched with Korea's images, and be redecorated into spaces where Korea's traditional styles and culture. This will be able to raise awareness on Korea and intention to participate in food tourism for foreign tourists who visit Korean restaurants.

          The Seoul subway line No.2 is the one of the busiest metro service line of the passenger transportation in Seoul metropolitan city. The number of the passengers served by the Seoul subway line No.2 is more than 1.9 million in a day according to the transportation reference of 2004, which is about 15% of the whole population in Seoul metropolitan city. This is the reason why the Seoul Metropolitan Subway Corporation(SMSC) is implementing the refurbishment of the current ATS signalling system of Seoul Line No.2 into the most advanced ATO system with the continuous air-gap telegram transmission through the track circuit without any suspension of the train service either in when or in where, which is the first in the world in its attempt to refurbish the old signalling system under service without any suspension of the train operation

          호텔 F&B조직의 리더십이 신뢰 및 조직몰입에 미치는 영향

          This study examines structural relationships among leadership (transformational and transactional), organizational trust and organizational commitment (continuous commitment and affective commitment). Research hypotheses were developed based on previous literature, and data were collected from 248 employees in the randomly-selected three five-star hotels' foodservice divisions. The collected data were then analyzed using frequence, reliability, exploratory and confirmatory factor analysis, and SEM (structural equation modeling) with IBM SPSS 21 and AMOS 20. The result of SEM analysis provided the following model fits: χ2=315.730, d.f.=183 (χ2/d.f.=1.725), p=.000, NFI=.905, NNFI=.951, CFI=.957, RMSEA=.052, This result demonstrates a good fit, and thus further analyses were conducted. Major findings proved that the both transformational leadership and transactional leadership had positive effects on organizational trust, and organizational trust also had positive effect on the organizational commitment. And the managerial implications of these results were examined.

          화물인도지시서의 법적성질과 보세창고업자의 법률상 지위에 관한 고찰

          복합운송주선업자가 계약운송인의 지위에서 House 선하증권을 발행한 경우, House 선하증권 소지인과 계약운송인과의 임치계약에 따라 화물을 보관하고 있는 보세창고업자 사이에는 아무런 계약관계가 없지만 보세창고업자는 House 선하증권 소지인에 대해 불법행위의 일반법리에 따라 손해배상책임을 부담할 수는 있다. 이 때 제3자에 대한 불법행위책임의 성립요건으로서의 과실여부의 판단은 동종 업계의 관행과 개별 사안에서 운송물인도를 둘러 싼 제반 사정을 감안하여, 보통의 표준적 보세창고업자가 동일한 상황에서 어떻게 행동하였을 것인가에 따라 판단하여야 한다. 한편 국내의 경우 운송인이 자신의 대리점이나 보세창고업자에게 운송물인도지시를 하는 소위 자기 앞 화물인도 지시서 의 법적 성질에 관해서는 견해의 대립이 있으나, 최소한 자기 앞 화물인도지시서의 면책증권성에 관해서는 이견이 없다. 그렇다면 보세창고업자는 면책증권인 화물인도지시서에 의해 화물인도를 함에 있어, 화물인도지시서의 형식적 유효성이나 화물인도지시의 진정성에 관해 합리적 의심을 가질 만한 특수한 사정이 없었다면 화물인도를 함에 있어 고의 또는 중대한 과실이 없는 한 화물인도지시서 소지인에 대한 화물인도로써 면책된다 할 것이고, 별도로 운송인의 화물인도지시 여부에 대해 운송인에게 확인할 필요는 없다고 볼 것이다. When a Freight Forwarder issues a house bills of lading(hereafter "house B/L) as a carrier, a bonded warehouse may be liable for the damages to the holders of the house B/L even if a bonded warehouse does not have contractual relation with holders of the house B/L. As Korean tort laws require tort-feasor"s negligence for the establishment of tort liability, a warehouse shall be negligent upon delivering the goods to the third parties who is not authorized to receive the goods. A warehouse"s negligence, however, can be figured out by placing other warehouse-men to the same situation where the goods were delivered without production of the delivery order from the carrier. Meanwhile, the legal characteristics of the delivery order is controversial among scholars, it seems evident that a warehouse is not responsible for any damage to the third party when the warehouse delivered the goods to the holders of the carrier"s delivery order demanding the warehouse to give the goods to the holder of that document. Therefore, a warehouse shall be immune from any liability when it delivered the goods to the third persons upon production of carrier"s delivery order with which a warehouse does not have any reasonable causes to think the delivery order was not authorized by the carrier. It means that even with ordinary fault upon delivering the goods a warehouse can not merely be liable for any damages and does not need to check whether the delivery order was authentically issued or not.

          프랜차이즈 마케팅믹스에 관한 탐색적 연구

          This study, based on theoretical and practical understanding of franchising, aims to conceptualize franchising in terms of marketing mix and proposes new paradigm of franchising. New schema of the franchise marketing mix involves both customer gap and franchisee gap by including customer and franchisee contacts and sets activities that include components of franchise system as the factor of marketing mix. So we could suggest the franchise marketing mix, ‘4F' by introducing conventional marketing mix concept into this assumption. The 4F schema consist of four sub-dimensions: ‘Format', ‘Fee & Royalty', ‘Franchising Process', and ‘Franchise Communication', which correspond to ‘4P'. In perspective of marketing mix, we could divide the franchise system into primary activity and support activity, then we also could categorize the fundamental activity into four-classification system, 4F schema. We expect that franchise marketing mix, 4F can be useful both theoretically and practically as it not only is not too different from the conventional marketing mix, but it also proposes franchise value chain by including unique characteristics and contents of the franchise system.

          이슬람 문화에 대한 지각이 할랄 레스토랑 방문의도에 미치는 영향

          The purpose of this study is to investigate how people perceived Islamic culture which is composed of food, culture & religion and how this perception affects the intention of visiting Halal restaurants. 300 questionnaires were distributed and 240 copies were collected then 200 copies were used analysis after the removal of 40 unusable responses. The results of the study are as follows: First, Islamic culture has three factors such as food, culture, and religion. Second, Perception of Islamic culture had a significant on the intention of visiting Halal restaurant. Among them, food factor have a positive on the intention of visiting. Religion factor had a negative effect on the intention of visiting. And Culture factor did not had any significant. The implications showed up as follows: First, KTO(Korea Tourism Organization) & local governments should stress on which Islamic food is one of various ethnic foods. Therefore, it is necessary to actively promote the Internet homepage so that it can switch to a positive image. Second, in order to offset the negative perception of Islamic religion, it is necessary to strengthen the perception that religion is in a position equivalent to Buddhism, Christianity, and Catholicism through cultural activities such as Islamic exhibitions. Third, In order to eliminate misunderstandings and prejudices about Islamic culture, it is necessary to educate and respect other cultures. In other words, Muslim-friendly education should be preceded.

          증례 : 산전검사를 시행하지 않은 산모에서 태어난 신생아의단순 포진 바이러스 2형 뇌염 1례

          단순 포진 바이러스 뇌염은 적절한 산전진단과 관리로 최근에는 드물게 발생하고 있는 질환이다. 단순 포진 바이러스 뇌염은 중추신경계에 심각한 영향을 끼치며, 특히 측두엽과 전두엽에 영향을 준다. 고용량의 항바이러스제 정맥주사 치료를 조기에 시작하더라도 생존자에서 심각한 후유증을 남기기 때문에 단순 포진 바이러스의 조기 진단은 무엇보다 중요하다. 저자들은 적절한 산전관리를 받지 않은 산모에서 태어난 생후 14일된 신생아가 발열과 수유감소로 응급실을 통해 입원하여 바이러스 뇌수막염이 의심되어 입원 2병일째 항바이러스제 정맥주사 치료를 시작하였지만, 경련이 발생하였고, 이후 중합효소연쇄반응과 배양검사를 통해 제 2형 단순포진바이러스 뇌염으로 확진된 영구적인 뇌의 심각한 후유증을 동반한 증례를 경험하였기에 이에 보고하는 바이다. Neonatal herpes simplex virus (HSV) encephalitis is a rare disease nowadays because of prenatal screening test and management. It shows progressive central nervous system manifestations affecting predominantly temporal and frontal lobes. Early diagnosis of HSV encephalitis is important since even with the early initiation of high-dose intravenous acyclovir therapy, it results in serious morbidity among survivors. A 14-day-old neonate with fever and poor oral intake was admitted via emergency department. The next day she had seizures and the brain was damaged with permanent sequelae despite of early administration of intravenous acyclovir on day 2 of admission. We report a serious case of HSV encephalitis diagnosed as type 2 HSV by PCR and culture of a newborn who was delivered by a mother without proper prenatal screening test.

          영국보험법상 워런티의 한국법상 의의

          보험계약은 원칙적으로 사적자치의 원칙이 적용되는 채권관계로서, 보험계약의 중요한 내용에 관해서도 당사자들은 협상을 통해 계약내용을 형성할 수 있다. 그러나 보험계약은 계약일반과 다른 공익성·단체성을 주요 특질로 하므로, 여타 계약에 비해 다수의 소비자보호의 필요성이 더욱 강조된다. 상법 제663조는 보험계약자 등의 보호를 위해 당사자 간의 특약으로 보험계약자 또는 피보험자나 보험수익자의 불이익으로 변경하지 못하도록 규정하고 있다. 일반적으로 상법 제663조의 입법취지에 대해서는, 개별 보험계약의 특성에 따라 기업보험 등과 같은 대등한 협상력을 보유한 당사자 간의 보험계약체결에 관해서는 사적자치의 원칙을 최대한 보장하고 법률의 후견적 기능을 제한하겠다는 것으로 풀이할 수 있다. 우리나라의 경우, 해상보험계약에 소위 `영국법 준거약관`을 삽입함으로써 영국 해상보험법 특유의 워런티 조항이 널리 통용되고 있다. 그런데 한국선주책임상호보험조합 및 한국해운조합의 보험약관은 그 준거법을 우리나라 법으로 규정하고 있음에도 불구하고, 워런티제도를 규정하고 있다. 워런티는 그 본래적 의의가 보험계약 체결 시 보험계약당사자들에 의해 특정한 위험을 보험자의 책임범위에서 제외함으로써, 보험자의 보상책임의 범위를 명확히 한다는 점에 그 의의가 있다. 따라서 비록 워런티를 위반한 경우 보험자가 면책되지만, 이는 당사자의 특약에 의해 보험계약의 대상에서 제외된 특정 위험이 현실화한 것에 지나지 않는다는 점에서, 상법 제663조에 반하여 보험계약자 등에게 불리하게 계약을 변경한 것으로 볼 수는 없다. 다만 우리나라 법이 준거법인 경우의 워런티의 법적 효력을 인정한다고 하더라도, 워런티 위반은 보험자의 면책사유가 된다는 점에서 보험계약상 중요한 내용으로서 보험자는 워런티 조항에 대한 교부·설명의무를 부담하고 있다. As a contract of insurance is governed by the principle of freedom of contract, parties of an insurance contract may agree on major terms of their contract they wish to make. Since the characterization of an insurance contract as a contract of “the utmost good faith” lies at the heart of insurance contract law, insurance contract put the insurer to be more vigilant for the protection of consumers than other contracts. In this sense, section 663 of the Korean Commercial Code (hereunder `the KCC`) states that the provisions of this Part shall not be changed to the disadvantage of a policyholder, the insured or a beneficiary by a special agreement between the parties:Provided, That this shall not apply in cases of re-insurance, marine insurance and other similar types of insurance. It is generally accepted that the main purpose of section 663 of the KCC is to protect the interests of insurance buyers whose negotiating power and understanding of insurance law may be limited. In Korean insurance market, by the way, a warranty clause which is unique in the English insurance laws is widely used by incorporating a governing law clause which stipulates the interpretation of contract will be governed by the English law and practice. According to policy clauses of the Korean P&I Club and Korea Shipping Association, however, policy-holder shall abide by a warranty clause, although the governing law of their insurance contract is the Koran Laws. It is well noted that the intent of warranty in an insurance contract is to serve a very significant function that is, determining the scope of the cover agreed by the insurer. In this regard, even if non-compliance with a warranty will discharge the insurer from his liability, this only means that the risk excluded by the warranty has been realized. Thus, a warranty clause shall not be regarded as an alteration of insurance contract to the disadvantage of a policyholder, the insured or a beneficiary by a special agreement between the parties. However, since a warranty can be regarded as the important provision of the insurance contract, the insurer shall deliver the warranty terms to a policyholder, and inform him/her of its legal effect thereof, when it enters into an insurance contract.

          호텔기업 상사의 변혁적 리더십이 직무성과에 미치는 영향

          The purpose of study is to suggest the importances of transformational leadership of hotel leader. In 21c, management environment of tourism industry face increasing environment changes. To adopt and make sustainable organization, there are needs to be more efficient and effectiveness. The transformational leadership can motivate employee to have organizational commitment and job commitment that can increase firm"s efficient and effectiveness. So researcher focus on casual relationship among transformational leadership, organizational commitment and job commitment by using empirical method. For empirical study, the data was gathered from 232 people in Seoul, Busan and Jeju. Result of empirical study show us leader"s transformational leadership has positive effect on organizational commitment, job commitment and job performance. And organizational commitment and job commitment has intermediate effect between empowerment and job performance. In last, researcher insistence base on empirical study, transformational leadership can effect on performance by motivation and change management.
