여성의 노인수발부담 완화를 위한 정책적 연구

급속한 노령화추세는 핵가족화로 인한 가족구조와 기능 및 의식의 변화와 함께 노인수발을 가중시키고 있다. 또한 최근 치매노인인구의 급증은 수발부담이라고 하는 새로운 가족문제 및 사회문제로 부각되고 있다. 우리나라 노인수발형태는 전통적 가부장적 이데올로기와 효 사상에 근거하여 사회부양보다는 가족부양에 의존하고 있는 실정으로, 노인수발의 주책임자는 며느리나 부인 등 여성이 대부분을 이루고 있다. 그러나 최근 여성의 고학력화, 여성지위의 향상 등으로 여성의 취업이나 사회참여가 증가하고 있는 상황에서 장기적으로 보호를 요하는 의존적 노인의 간호와 수발에 있어서 많은 문제를 야기하고 있다. 특히, 사회생활을 하고 있는 기혼여성의 경우, 노인수발의 주수발자로서의 역할과 함께 또 다른 가족원으로서의 역할과 같은 다중적인 역할요구는 증가할 것으로 보여진다.

토석류 사방댐 시나리오 자동분석 프로그램 개발 및 적용

최근 집중호우의 빈발로 산지 유역의 토석류 위험이 증가하고 있으며, 이를 저감하기 위한 구조적 대책으로 사방댐이 널리 활용되고 있다. 그러나 사방댐의 저감효과는 설치 위치와 설계 조건에 따라 달라지므로 다양한 대안을 정량적으로 비교할 필요가 있다. 본 연구에서는 지형자료와 토석류 수치모형을 연계하여 사방댐 후보지를 자동 생성하고 설치 시나리오별 저감효과를 평가하는 자동분석 프로그램을 개발하였다. 이를 2019년 포항시 기북면 토석류 사례에 적용한 결과 사방댐의 저감효과는 설치 위치와 높이에 따라 크게 달라졌으며, 개발된 프로그램은 다수의 설치 대안을 효율적으로 비교·평가할 수 있는 것으로 나타났다. 본 프로그램은 사방댐 계획 및 설계 단계에서 활용 가능한 의사결정 지원 도구로 기대된다. Debris-flow hazards in mountainous watersheds are increasing due to more frequent and intense rainfall, and check dams are widely used to reduce these risks. However, mitigation performance varies depending on installation location and design conditions, necessitating a quantitative comparison of multiple alternatives. In this study, an automated scenario-analysis program was developed that integrates topographic data with a debris-flow numerical model to generate candidate check dam sites, construct installation scenarios, and evaluate mitigation effects. The program was applied to a 2019 debris-flow event in Gibuk-myeon, Pohang, South Korea. The results showed that mitigation effects varied substantially by dam location and height, and that the proposed framework can efficiently compare multiple alternatives, supporting practical check dam planning and design.

몽골 근대사의 문학적 형상화 -차드라발 로도이담바의 '맑은 타미르 강' 연구

현재 몽골에서는 많은 학자들이 한국문학 연구에 관심을 기울이고 있다. 이는 우리에게는 고무적인 일이다. 이런 현 시점에 우리도 몽골 문학에 대해 깊은 관심을 가질 필요가 있다. 이런 점에서 차드라발 로도이담바의 장편소설 맑은 타미르 강은, 우리가 특히 관심을 가질 만한 작품이다. 로도이담바는 몽골의 현대 문학사상 가장 빛나는 작가 중 한 명이며, 맑은 타미르 강은 그의 대표작으로 몽골인이 가장 사랑하는 소설이기 때문이다. 맑은 타미르 강의 시간적 배경은 1914년에서 1932년이다. 이는 몽골 근대사의 핵심에 해당되는 시기이다. 몽골의 근대화 과정은 한마디로 중국으로부터의 완전 독립과 사회주의 정 부의 수립 과정이라고 할 수 있으며, 이러한 근대화 과정에서 황교 개혁은 뿌리 깊은 문제로 부각된다. 이 소설은 역사적 사건, 역사와 유관한 서사적 사건, 역사와 무관한 서사적 사건이 라는 세 층위의 구조로 이루어져 있으며, 그것들은 서로 긴밀한 내적 관계를 유지하며 전개 된다. 맑은 타미르 강의 인물 구성도 이 소설의 문학적 성과에 크게 기여하고 있다. 이 소설의 등장인물들은 개성적이며 생동감 있게 조형되어 있다. 선과 악의 경계는 비교적 명확하지만, 선인과 악인들은 각각 다종다양한 인물형의 스펙트럼으로 드러난다. 이 소설의 등장인물도 세 층위로 나눌 수 있는데, 여기서 역사와 유관하고 서사적 사건에서도 중요한 역할을 담당하는 인물들이 특히 중요하다. 이 중 에르덴과 바트 등은, 게오르그 루카치가 말한 ‘중도적 인물’에 해당한다. 이들은 서사와 역사를 매개하고 통일하여 민중의 삶과 역사적 사건을 총체적으로 드러내는 역할을 담당한다. 이 소설 전반에 드러나는 민중적 성격도 이 소설의 문학적 성취에 기여하는 바가 크다. 몽 골의 민중성은 이 소설의 토대를 이룬다. 이로써 이 소설은 몽골 근대의 핵심을 뿌리 깊은 전통 위에 형상화한다. 결국 이 소설은, 세 층위의 구조와 그에 대응되는 인물 구성, 그리고 민중적 성격을 통해, 몽골 근대 근대의 핵심적 시기를 총체적으로 형상화하는 데 성공하고 있다. This thesis is written to examine the modernity of Mongol in ‘The clear Tamir river’ by Chadrabal Rodoidamba. Chadrabal Rodoidamba is the national novelist and ‘The clear Tamir river’ is the Mongolian national novel so beloved by Mongolian people. The modernity of Mongol were also embodied by this talented artist in this novel. Two kinds of projects were suggested to the modernity of Mongol in this novel. One is the establishment of the socialist system and the other is the reformation of Mongolian Lamaism. In this novel, he embodied these projects for the modernity of Mongol from the two sides. One is the side of the structure and the other is the side of the character. This novel is constructed by three layers. The first is the historical layer, the second is the layer involved in history and the third is the layer unrelated to history. The composition of the character is similar to this structure. It is important that the relation of these three layers were natural and harmonious internally. The historical and political issues about the modernity of Mongol are suggest naturally. Therefore he embodied the modernity of Mongol in the literary form successfully.

영장발부에 있어 구속사유 판단의 문제 - 개정 형사소송법 제70조 제2항을 중심으로 -

The rectification of criminal procedure code can speak that had deduced a lot of interests and product of hard works for damage rehabilitation of victim as well as personal rights patronage of suspected person or indictee at detective prosecution and procedure in a public trial. Improvement of detention system was also own diversification in big frame called embodiment of idea of this criminal procedure code, and introduction of article §70 ② paragraph is a ready front the instance. It is the value of this rectification that the new criminal code accepted the criminal consideration element. The obligatory considerations are criminal importance, danger of second offence, worry of danger and injury to the victim and key witness which are recognized unwritten. The problem is the interpretation of obligatory consideration matter. Definite estimation about cross relationship between definite standard and such individual factors should be attained and it has to be analyzed individual factor such as criminal importance etc, and the harmornious relationship between existent reasons for detention and obligatory considerations that analyze should be solved. Alternation of the reasons for detention clause is the reflection of the great idea which is virtual constitutionalism and reasonable inclination. But reflection of this criminal procedure code kyugis not the rectification about reasons for detention. However, interpretation and application of newly introduced clause devolved in the court now. Depart in past traditional pratice simply, we must try to reflect obligatory consideration matter without damaging written grounds for detention, embodying institute of nonrestraint judgement and law emotion of citizen and crimianl illegality. And rectification work about ground for detention of §70 ① should be achieved by legislation. Because there is plain difference between restrion ground and obligatory cosideration matter. 개정 형사소송법은 형사소추 및 공판절차에서의 피의자 또는 피고인의 인권보호뿐만 아니라 피해자의 피해회복, 나아가 국가형벌권의 적정한 행사에 대한 제고라는 점에서 형사소송법 제정 이후 50년 만에 매우 의미있는 개정으로 평가할 수 있다. 구속제도의 개선 역시 이러한 새로운 형사소송법의 이념의 구현이라는 측면에서 나름의 변화가 있었는데, 제70조 제2항의 도입이 바로 그것이다. 범죄의 중대성, 재범의 위험성, 피해자 및 중요 참고인 등에 대한 위해 우려라는 의무적 고려사항은 구속여부 결정시 기존에 불문으로 인정되던 형사정책적 고려사항을 명문으로 인정하였다는 점에서 의의를 찾을 수 있다. 문제는 이제 이러한 의무적 고려사항의 해석에 달려있다. 범죄의 중대성과 같은 개별 요소를 어떻게 인정할 것인지에 대한 명확한 기준과 이러한 개별 요소들간의 상호관계에 대한 명료한 판단이 이루어져야 하며, 기존의 구속사유들과 조화적 해석의 문제가 해결되어야 하는 것이다. 기존의 실무의 필요를 반영하여 구속 근거 조문을 변경한 것은 실질적 법치주의라는 대이념의 반영이며, 타당한 경향으로 볼 수 있도 있을 것이다. 그러나 이번 형사소송법의 개정은 구속사유에 대한 개정이 아니라는 점을 유의하여야 한다. 그렇지만 여전히 새로 도입된 조문의 해석과 적용은 법원에 맡겨졌다고 할 수 있다. 법원은 더욱 어려운 과제를 떠안게 된 것이다. 단순히 과거의 구속영장 발부 재판의 관행에서 벗어나, 불구속재판의 원칙을 구현하면서도 명문의 구속사유를 훼손하지 않고, 의무적 고려사항을 반영하여 국민의 법감정과 범죄의 불법을 제대로 형량한 구속여부 판단을 위해 명쾌한 척도를 개발하려는 노력을 다하여야 하는 것이다. 아울러 이제는 과거의 과잉구속의 잘못된 관행을 벗어나, 점점 흉포화되어 가는 범죄에 대한 대책으로서의 구속의 기능에 대한 재검토가 필요하다. 따라서 개정된지 얼마 지나지 않은 시점에서 성급할 수도 있으나, 입법적으로는 형사소송법 제70조 제1항의 구속사유에 대한 개정작업이 이루어져야 할 것이다. ‘구속사유’와 ‘구속사유 판단시 고려사항’ 사이에는 분명한 차이가 존재함을 인정하여야 한다. 이를 위해서는 실무의 관련예규에 대한 개정작업이 동반되어야 할 것이다.
