        장애등급제 폐지와 입법의 영향

        정부의 장애등급제 개편은 지체할 수 없는 국가적 과업이 되고 있다. 이를 위해 지난 정부에서 실패했던 상황논리를 극복하고 구체적인 입법개선이 요구된다. 법령 또는 법령에 내재되어 있는 제도개선이 있게 되면 관련 입법의 제정과 개정이 수반된다. 이러한 과정에서 객관적이고 과학적인 방법을 통해 입법의 영향을 분석·평가하고 그 결과를 해당 법령에 반영하여 최적의 입법대안을 창출하여야 한다. 여기에서 고려되어야 하는 것이 법치주의적 관점에서 논의되는 법합치성과 입법의 체계정당성 원리이다. 이는 입법과정에서 준수되어야 할 헌법원리이자 입법기술이다. 본 논문에서는 규범적 영향분석기법의 하나인 법합치성 원리에 따라 장애등급제 개편에 따른 관련 법령을 전수조사하였고 향후 법제개선을 위한 과제를 도출하였다. 그 결과 정부가 추진하고 있는 중·경증장애 체계에 대한 심오한 고민과 전문적 조정전략이 필요한 법령 21건과 단순히 중증·경증장애정도로 개편이 가능한 사례 15건을 발굴하였다. 이러한 결과는 장애등급제의 개편이 「장애인복지법」에서 그치는 것이 아니라 수많은 관련 입법의 정비까지 함께 도모되어야 할 필요가 있음을 말하고 있는 것이다. 이를 위해 본 논문에서는 장애등급제 개편에 따른 가장 바람직한 입법대안의 정립을 위해 고려되어야 할 정책사안을 제시하였다. The reform of the disability grade system of the government is a national task that can not be delayed. For this reason, it is necessary to overcome the logic of the situation that failed in past governments and to improve concrete legislation. If there are improvements in the laws and regulations or the systems inherent in laws and regulations, the establishment and revision of related legislation is accompanied. In this process, we must analyze and evaluate the impact of legislation using objective and scientific methods, reflect the results in that law, and create optimal legislation alternatives. It should be considered here and is the principle of legitimacy of the law conformance performance system being discussed from the point of view of legalism. This is the constitutional principle to be observed in the legislative process, it is legislative technology. In this thesis, we investigated all related laws and regulations based on reform of the disability grade system based on the principle of law conformity, which is one of analytical methods of normative influence, and derived tasks for improving future legislation. As a result, we discovered 21 laws and ordinances that require profound distress and professional coordination strategies for the severely handicapped and mild disability system that the government is pursuing. In addition, we identified 15 cases that could be reorganized as simply severe or mild disability. These results say that the reorganization of the disability grade system should not necessarily end with the 「Act on Welfare of Persons with Disabilities」 but also need to be involved together until the establishment of many relevant legislation. For this reason, this paper presented factors to be considered for the formula of the most alternative legislative options by reforming the disability grade system

        하상구조에 따른 4개 하천의 어류 분포 특성 비교

        This study was conducted to compare the characteristics of fish distribution according to sand type stream and cobble type stream the 4 stream selected every season. The collected Korea endemic species during the survey period were 24, including Acheilognathus gracilis. Dominant species of Hongcheon stream and Muju Namdae stream was Zacco koreanus, each accounting for 39.9% and 28.4% in order, and dominant species in Yanghwa stream was Rhodeus notatus, 13.6%, and those in Gap stream was Z. platypus, by 26.0%. As a result of community analysis, dominant index was 0.27~0.63, diversity index was 1.92~2.67, evenness index was 0.6~0.79, richness index was 3.09~3.53, and dominant index was the highest in Hongcheon stream, and the indices of diversity, evenness and richness were the highest in Yanghwa stream. As a result of tolerance guild analysis, Hongcheon stream and Muju Namdae stream with a variety of substrates accounted for relatively higher rate by 50.1% and 46.4% in sensitive species respectively, and Yanghwa stream and Gap stream with greater sand substrates had 0.5% and 5.3% scarce rate of sensitive species.         조기 위암의 임상적 고찰

        N/A Background: Stomach cancer is one of the most prevalent malignancy in Korea and usually has poor prognosis. However, the prognosis for the early gastric cancer has been reported excellent and this is why it has been emphasized on the early diagnosis and treatment of this grave problem. Method: The authors reviewed 319 cases of early gastric cancer which had been confirmed by surgery and pathologic examination from March 1974 to February 1993 at Hanyang University Hospital. Results: The incidence of early gastric cancer was 6. 0% of all gastric cancer and 17.6% of gastric resection for stomach cancer, and there was no annual increase in incidence of early gastric cancer. The greatest prevalence was in 5th decade (29.4%), and male to female ratio was 2.1:1 with male preponderance. The common sites were gastric antrum (55.7%), body (24.1%) and angle (18.8%) and along the lesser curvature (60.5%). The size of the lesions varied from smaller than 1.0 cm to larger than 5 cm but there was no significant difference between the size of the lesion and the depth of invasion or the lymph node involvement. In 141 case (44.2%), the lesions confined to mucosa, while 178 cases (55.7%) were extended to submucosa. The metastasis to lymph nodes were detected in 13 cases of mucosal cancer and 34 cases of patients with submucosal cancer, and there was statistically significant difference. According to the histopathologic type by WHO classification, signet ring cell was the most common (42.9%), The most frequently encountered types by macroscopic classification were type IIc and its variants, accounting for over 57.9% of the cases. Fnllow up studies were possible in 161 cases from August 1986 to February 1993, and 5yr-survival rate was 98.1%.

        가평천 상류역 어류군집의 장기변동

        2005년 4월부터 2013년 10월까지 가평천 상류역 어류군집의 장기적인 변화를 조사하였다. 조사기간 동안 출현한 어종은 총 6과 17종 이었으며, 우점종은 Zacco koreanus(상대풍부도 59.9%), 아우점종은 Pungtungia herzi(8.5%)이었다. 한국고유종은 Coreoleuciscus splendidus외 12종으로 확인되었다.법적보호종은 멸종위기야생생물 Ⅱ급인 Pseudopungtungia tenuicorpa와 Gobiobotia brevibarba 등 2종으로 조사되었으며, 천연기념물은 Hemibarbus mylodon 1종이었다. 가평천의 수질등급은 최근 9년간 환경부 기준고시에 의거할 때 “매우좋음” 등급을 유지하고 있었다. 육식어종인 Coreoperca herzi의 개체수는 감소하고, 잡식어종인 Zacco platypus는 증가하는 경향을 나타내었다. 군집분석 결과 우점도지수는 0.58∼0.86, 다양도지수는 0.94∼1.77, 풍부도지수는 0.99∼2.39의 범위로 나타났다. Rarefaction curve를 이용하여 연도별 기대 출현종수를 분석한 결과 151개체의 표본에서 예상되는 종은 최대 12종 (2005), 최소 5종(2007)으로 나타났다. 가평천 상류역의 Z. koreanus 개체군을 대상으로 전장-체중 상관관계를 분석한 결과 회귀계수 b값은 연평균 3.29±1.11, 비만도는 0.0034±0.0021로 안정적인 개체군과 양호한 생육상태를 유지하고 있었다. Long-term variation of the fish community in the upper region of Gapyeong Stream was investigation from April, 2005 to October, 2013. The collected species during the survey period were 17 species belonging to 6 families. Dominant species was Zacco koreanus(Relative abundance 59.9%) and subdominant species Pungtungia herzi(8.5%). Korea endemic species were 12, including Coreoleuciscus splendidus. The species of Hemibarbus mylodon was identified as natural monument, and Pseudopungtungia tenuicorpa and Gobiobotia brevibarba were endangered species. Water quality assessment of Gapyeong Stream, had lately maintained the rating of "very good" for nine years, based on the Ministry of the Environment standards notice. It was found that there was a tendency for populations which is Coreoperca herzi carnivorous species decreases, increases omnivorous species Zacco platypus. As a result of community analysis, dominant index was 0.58∼ 0.86, diversity index was 0.94∼1.77 and richness index was 0.99∼2.39. As a result of using the Rarefaction curve, were analyzed occurrence species expected each year, number of species is estimated from a sample of 151 individuals, up to 12(2005) was at least 5(2007) species. The regression coefficient (b) in relation to length-weight on Z. koreanus population were annual average 3.29±1.11, condition factor slope 0.0034±0.0021, which maintained good growth condition and stabilized population.

        정부의 사회서비스 공공성 강화전략과 입법과제

        본 논문에서는 사회서비스원 또는 사회서비스공단 설치로 예견되는 복지환경변화와 이에 따른 문제, 민간 사회복지법인 및 시설 등의 기능과 역할 재편전략을 살펴보았다. 이를 위해 정부의 사회서비스 공공성 강화전략과 국회에서 심사 중인 관련 법안을 심층 검토하였다. 본 논문에서는 사회서비스원 또는 사회서비스공단의 설립을 둘러싼 국내 복지환경에 변화에 대응하기 위한 민간 사회복지법인 및 시설의 생존전략을 모색하였다. 그리고 정부정책 및 관련 법률의 내용을 중심으로 그 문제점을 밝히고, 개선의 필요성을 제시하였다. 특히 국내사회서비스 분야가 공공과 민간으로 분리되는 현상에 착안하여 「사회복지사업법」의 전향적 개선을 통한 민간 사회복지법인 및 시설의 경쟁력 확보방안을 구상해보았다. 그 결과, 본 논문에서는 사회서비스원 또는 사회서비스공단 시대 복지제공 주체 간의 공생방안을 핵심으로 정부 주도의 사회서비스 직접 운영을 자제하고 보장국가론의 관점에서 사회서비스 분야의 민⋅관 경쟁체제 도입을 주장했다. 그리고 구체적 방법으로 「사회복지사업법」에 네거티브 규제의 도입, 협력적 복지거버넌스로의 체제전환, 규제수용도 개선을 위한 민간사회복지법인 및 시설 지원체계로의 개편 방안을 도출해 보았다. In this paper, we examined the changes in the welfare environment and the corresponding problems, functions and roles of private social welfare corporations and facilities, which are expected by the establishment of “The Social Service” or “The Social Service Public Corporation”. For this reason, the government s social service publicity strengthening strategy and related bills under consideration by the National Assembly were reviewed in depth. In this paper, we sought a strategy for survival of private social welfare corporations and facilities in response to changes in the domestic welfare environment surrounding the establishment of “Social Service” or “The Social Service Corporation”. It also revealed the problem with the contents of government policies and related laws and suggested the need for improvement. In particular, a measure was devised to secure competitiveness of private social welfare corporations and facilities through forward-looking improvement of 「Social Welfare Service Act」 in light of the current separation of the social services sector into the public and private sector. As a result, this paper advocated the introduction of a civil and government competition system in the field of social services from the perspective of a guaranteed national theory, while refraining from direct operation of government-led social services as the core of the social service provider. In specific ways, we drew up measures to introduce negative regulations, to change the system into a cooperative welfare governance, and to reform the private social welfare corporation and facility support system to improve regulatory acceptance in 「Social Welfare Service Act」.

        법학분야 사회보장법 교육 현황 및 개선방안

        오늘날 법학분야에서 사회보장법 교육은 복지국가화 경향과 더불어 그 중요성이 날로 강조되고 있다. 하지만 국내 사회보장법 교육현실은 여전히 개념법학, 수험법학의 한계에서 벗어나지 못하고 있는 실정이다. 이에 따라 학부단계를 비롯하여 법학전문대학원에 이르는 전 교육과정에서 사회보장법 교육의 협소성, 왜곡성의 문제가 나타나고 있다. 이를 극복하기 위하여 국내 사회보장법 교육은 열린체제로 이루어질 필요가 있다. 즉, 전통법학분야와 인접학문영역과 교류가 필요하다. 이러한 교류는 사회보장법을 둘러싼 입법론과 해석론, 관련 정책과 제도에 대한 통섭적 교육을 가능하게 할 것이고, 이를 통해서 사회보장법 교육의 내실화를 기할 수 있을 것으로 기대된다. 이를 위하여 이 논문에서는 첫째, 수험법학에서 탈피하여 교육현장에서도 사회보험법, 공공부조법, 사회서비스법을 균형성 있게 교육할 수 있는 체제로 전환할 것을 제안하였다. 둘째, 사회보장입법과 제도평가를 기초로 법규범과 법현실의 상관관계를 분석하는 교육을 반영할 것을 제안하였다. 셋째, 사회보장법 교재발간, 교육과정 운용(팀티칭 또는 Capston Design 등) 등에 있어서 법학과 사회복지학의 교류를 제안하였다. 마지막으로 사회보장법 교육을 둘러싼 학부, 일반대학원, 법학전문대학원 간의 역할 분담을 제안하였다. Today s the education of Social Security Act has been increasingly emphasized, its importance, with the welfare state tendency in the field of Law. But the reality of domestic the Social Security Act is a situation that not escape from the limits of the examination and concepts educational law. Accordingly, it appears problems as well as narrowness and distortion of the education Social Security Act in all curricula from faculty of Law to the Law School. In order to overcome this, domestic s education of the Social Security Act needs to be done in an open system. In other words, it is required exchanges the traditional academic areas of Law and the adjacent disciplines These exchanges will enable the consilience education for legislation and Interpretation of Law, related policies and institution in the Social Security Act area. And expect that to be able to the substantiality of education of the Social Security Act. To this end, this paper proposes the following: First, proposed to break away from the examination of Law, that can be converted to balanced education system to social insurance law, public assistance law, social services law. Second, proposed to basis to the social security legislation and institutional assessment, that reflecting education to analyze the relationship between the rule of law and a law reality. Third, proposed to in publishes textbooks of the Social Security Act, management of curriculum(such as team teaching or Capston Design) an exchange of Social Welfare Studies and Law. Finally, proposed to the division of roles in the education of Social Security Act, between the Faculty, Graduate School and Law School.

        공생발전을 위한 사회보장법의 과제

        이 논문은 국정지표의 하나인 “공생발전”의 개념과 헌법적 근거, 공생발전을 위한 법 원리를 제시하고, 이를 기초로 사회보장법 영역에서 공생발전을 구체화할 수 있는 방안을 모색하였다. 공생발전은 이미 사회복지국가를 선언하고 있는 우리 헌법 체계와 사회보장기본법에 의하여 선언되고 있다. 다만, 이를 구체화하고 있는 사회보험, 공공부조, 사회서비스 법제에서 제대로 반영되고 있지 못할 뿐이다. 따라서 공생발전형 사회보장법을 구상하기 위한 전제로서 보편적 복지와 선별적 복지가 유기적으로 조화되는 입법체계를 구축해야 한다. 그리고 이러한 이상적 입법체계는 현행 사회보험 및 공공부조 법제에서 노정하고 있는 수급요건 등의 개선을 통해 달성될 수 있을 것이다. This paper presents parliamentary indicators, one concept of “eco-system development” and constitutional grounds, the principles of law for the development of symbiotic. And I was exploring a plan to be able to embody the eco-system development in the field of social security on the basis of this law. By the social security system and the Basic Law of our Constitution that are basically social welfare state philosophy of eco-system development, has already been declared. However, it just does not accurately reflect the social insurance that embody this, public assistance, social services law. Therefore, as a prerequisite to visualize the development of the Social Security Act in eco-system development type, there is a need to build a system and sorting welfare legislation has been harmonized universal welfare organically. And these legislative system would be achieved by improving the legal requirements, such as various types of which are specified by the law of the current social insurance and public assistance.
