      Loyalty to the King and Love for Country: Confucian Traditions, Western-Style Learning, and the Evolution of Early Modern Korean Education, 1895–1910

      The encounter between Confucianism and western learning is often portrayed as a confrontation between Confucianism, associated with passivity and hierarchy, and the western philosophical tradition, connected with independence and rationality. This bifurcating tendency is pronounced in the historiography of nineteenth-century Korean history, when Koreans established westernstyle schools and published modern textbooks. This article is neither a defense of Confucianism nor an endorsement of the western model, but a proposal to reexamine this dichotomization that is predominant in current scholarship and the assumption that the two were irreconcilable. A comparison of Korean readers demonstrates that the process of the incorporation of western ideas was less one of linear progress based on the displacement of Confucianism than an amalgamation of different ideas and values. Thus, from a more broadly defined Confucian framework emerged a new sense of civil duties that allowed intellectuals and government bureaucrats to discuss nationalism, citizenship, and the public sphere.

      근대 국제법상 강대국 일본의 약소국 한국 병합에 대한 고찰

      In August 1910, the Small state of Korea was annexed by the Great Power of Japan. Here, ‘Small States’, ‘Great Powers’, and ‘Annexation’ are terms used in international law. Therefore, tracing the international legal significance of Japan's annexation of Korea requires a systematic approach to these terms. Both Small States and Great Powers are recognized as sovereign states and International Persons. While politically distinct from Great Powers, Small States legally retain their status as International Persons. There have been instances where even the status of a Small State has shifted to that of a Great Power. In 1905, Korea became a protectorate of Japan, and thus naturally lost its status as a full International Person, and was considered a Small State in the broadest sense. In the Family of Nations, Great Powers have been defined as major powers that have led international conferences since the Congress of Vienna in 1815. Japan was recognized as a Great Power by the Family of Nations, along with the United States, the United Kingdom, France, and Italy, in the Treaty of Versailles, which concluded World War I in 1919. Next, annexation signifies the disappearance of a state as a International Person. As evidenced by the 1795 annexation of Poland by Russia, Austria, and Prussia, annexation of a Small State by a Great Power was possible even within the same civilization. Although very limited, intervention of third Power in annexation may exist. The existing Great Powers did not intervene in Japan's annexation of Korea in 1910. However, when Japan declared war on these powers, the Allied leaders of the United States, Republic of China, and the United Kingdom belatedly intervened in Japan's annexation of Korea through the Cairo Declaration in December 1943, and this was ultimately realized.

      로버트 필리모어의 『국제법해설』과 조일수호조규

      1876년 조일수호조규 체결 직전 일본의 特命全權公使 森有禮는 淸으로 파견되었다. 이때 그는 조선의 국제법적 지위를 이집트, 세르비아 등과 비교하면서19세기 영국의 법학자 로버트 필리모어(Robert Phillimore)의 『國際法解說』 (Commentaries upon International Law )을 활용했다. 필리모어는 국가의 형태를 크게 단일주권국가와 연방국가로 분류하였다. 그리고 단일주권국가를 다시 단일주권 단독국가, 物的同君聯合, 人的同君聯合, 進 貢·封臣國 등으로 분류하였다. 여기서 주목할 것은 進貢·封臣國으로 오스만 투르크와 봉건적인 관계를 유지하고 있는 국가들이었다. 아프리카에 튀니지, 트리폴리가 있었으며 유럽에는몬테네그로, 몰다비아, 왈라키아, 세르비아가 있었고 별도로 이집트가 존재하고 있었다. 필리모어는 이들을 사실상 독립국이라고 하였다. 그럼에도 불구하고 서구 열강들은 이들에 대한 오스만 투르크의 宗主權을 인정하였다. 森有禮는 이러한 필리모어의 『국제법해설』을 참고하여 조선을 독립국이라고 하였다. 그러면서도 淸의 屬國(Dependent State)임을 冐稱하고 있는 점을 들어 오히려 오스만 투르크의 종주권 하 세르비아같이 취급하여 公使를 파견하지 말고 領事를 파견해야 한다고 주장하였다. 이는 일본이 조선과 조약을 체결하면서도 조선을 純然한 독립국으로 인정하지 않겠다는 태도를 피력한 것이었다. Just before concluding the Joseon-Japan Treaty in 1876, Envoy Mori Arinori(森有禮) of Japan was sent to Qing. He quoted a 19th century English jurist, Robert Phillimore’s Commentaries upon International Law, comparing Joseon’s international legal status with Egypt and Serbia. Phillimore categorized the state as largely one or more States under One Sovereign and Several States under a Federal Union. In addition, it is classified as one or more States under One Sovereign, a state under one Sovereign, a real union, a personal union, and a state paying tribute as standing in a Feudal relation to other States-The Turkish Province, etc. It is worth noting here that the state paying tribute was maintaining Feudal Relations with the Ottoman Turks. There were Tunisia and Tripoli in Africa and Montenegro, Moldavia, Wallachia and Serbia in Europe, and there was separately Egypt. Phillimore called them de facto independent states. Nonetheless, the Western powers recognized Ottoman Turks’ Suzeraineté for them. Mori Arinori called Joseon as Independent State by referring to Phillimore’s Commentaries upon International Law. However, taking as an example the fact that it is the Dependent State of Qing, he insisted sending Consul rather than dispatching Minister by treating like Serbia under the Suzeraineté of Ottoman Turks. This was a sign that Japan would not recognize Joseon as an independent state, even though Japan concluded a treaty with Joseon.

      The Suzerainty Concept in the East and West

      A groundbreaking study edited by Okamoto Takashi of Kyoto Prefectural University, Sōshuken no sekaishi: Tōzai Ajia no kindai to hon’yaku gainen (A world history of suzerainty: A modern history of East and West Asia and translated concepts; hereafter, A World History of Suzerainty) moves beyond the prevailing perspective on the history of international relations in modern East Asia. Ever since the Treaty of Nanjing was signed in 1842, the scholarship has been dominated by the conventional narrative that the system of Western international law was introduced to the East Asian world and collided with the existing Chinese world order. However, this book’s attempt to understand both Western international law and the Chinese world order through a single concept of suzerainty (zongzhuquan 宗主權) shakes that notion. It is a common perception that Western international law is based on equality whereas the Chinese world order assumes hierarchical order. Nevertheless, A World History of Suzerainty reveals that hierarchical relationships also existed between the suzerain state and the dependent state governed by the suzerainty concept under Western international law, which calls for the need to rethink and begin anew in describing the modern history of East Asian international relations.

      조선의 국제법적 지위에 대한 독일제국 외교관의 인식

      1876년 조일수호조규 체결로 인하여 독일제국은 비교적 일찍부터 조선의 자주와 독립을 인지하였다. 그러면서도 조선에 대한 청국의 종주권 행사와 조선의 속국 여부를 관심을 가졌다. 그런 가운데 주조선독일영사 부들러와 젬부쉬가 강대국 보호 하의 조선 중립화를 제기하였다. 그리고 조선의 자립은 불가능하다고 보고 있었다. 마찬가지로 주청독일공사 브란트는 조선이 청국과 봉건적인 관계를 가지고 조공을 보내는 속국이라고 보고하였다. 1885년 거문도사건 이후에는 심지어 조선의 병합 내지 보호국론이 제기되기도 하였다. 주조선독일총영사 크리엔은 조선이 청국의 속국이라는 사실을 드러났다고 보고하였다. 1894년 청일전쟁 개전은 청국에 대한 조선의 국제법적 지위를 두고 일어났다. 일본은 청국 군대를 조선에서 철수하게 만듦으로써 조선이 독립국임을 입증해보라고 요구하였다. 조선으로서는 물론 그렇게 할 수 없었고 결국 일본은 조선의 독립을 구실로 조선의 경복궁을 점령하고 조선 침략을 감행하였다. With the signing of the Joseon-Japan Treaty in 1876, the German Empire recognized Joseon's Self-reliant(Selbstständigkeit) and Independence(Unabhängigkeit) from a relatively early age. At the same time, they were interested in the exercise of Qing's Suzerainty(oberhoheit, Suzeränität) over Joseon and whether Joseon was Dependent State(Abhängigkeit). Meanwhile, German Consul Budler and Zembsch in Korea raised the neutralization of Joseon under the protection of the great powers. And it was believed that Joseon's independence was impossible. Similarly, the German Envoys in Qing reported that Joseon was a Dependent State(Abhängigkeit) that sent Tributes(Tributpflichtigen) with a Vassal(Vassallen) relationship with the Qing Dynasty. After the Geomundo incident in 1885, the Annexation(Annektieren) of Joseon or the theory of a Protectorate(Schutzes, Protektorat) was even raised. Krien, the German Consul General in Korea, reported about a Dependency Korea of China(Abhängigkeit Koreas von China). The opening of the Sino-Japanese War in 1894 took place over Joseon's international legal status over the Qing Dynasty. Japan demanded Joseon prove to be an Independent State(Unabhängigkeit) by forcing Qing troops to withdraw from Joseon. Joseon was, of course, unable to do so, and eventually Japan occupied Gyeongbok Palace in Joseon and invaded Joseon under the pretext of Joseon's independence.

      임오군란 이후 조선의 국제법적 지위에 대한 일본의 인식

      Qing(淸) arranged for the conclusion of the JoseonAmerica Treaty in 1882, and regulated the JoseonChina Regulation after suppressing the ImO Military Rebellion and defined Joseon as a SemiSovereign or Dependent State based on the Elements of International Law. SemiSovereign or Dependent State is a superior State under whose protection they are placed, that is, a state dependent upon Suzerainty which has a limited foreign sovereignty such as the rights of legation. The important thing is that Japan also accepted Qing's theory of SemiSovereign or Dependent State(半主・屬國) as to Joseon. After ImO Military Rebellion, Japan's officer Inoue Kowasi(井上毅) recognized Joseon’s position of SemiSovereign or Semi Dependent State, through Boissonade's legal counseling. For example, it is the view that Joseon gains the status of permanent neutrality, and five states including Qing and Japan become protectors. If so, Joseon would gain the international legal status of protectorate and his sovereignty should be limited. Ito Hirobumi(伊藤博文), who played an important role in making decisions over Joseon, also showed an attitude to acknowledge Joseon Dependent State theory through Theory of Joseon’s Sovereignty and Dependence(朝鮮主屬論文件). For example, he noted the case of Romania, which was the Vassal State and SemiSovereign or Dependent State of Ottoman Turks. He compared Joseon with Dependent States of Ottoman Turks such as Tunisia, Tripoli, Romania, Serbia and Egypt by examining Tokyo Daily Newspaper(東京日日新聞)’s Joseon independence theory(朝鮮獨立論). This contrasts with the previous research stream that Japan pursued Joseon’s independence.
