        학교시설의 민자공급에 따른 학교시설관련 기술관료조직 제도개선에 관한 연구

        Korean government implemented the Build-Transfer-Lease (BTL) mechanism since 2005 as one of the privatization methods to procure the social infrastructure with private investment. The mechanism was originally prepared 10 provide such public properties as education facilities, child-care facilities, old generation recuperation facilities, medical welfare facilities, military personnel's apartments, environment facilities, and lease apartments. Since 2005, a total of 13.5 trillion won-valued private fund has been directed to the public educational facilities, which occupies 58% of the total private investment in the facilities of the seven categories. However, many officials in the local public entities have anticipated that the local entities need to be restructured or downsized because of the privatization in stead of providing the educational facilities by governmental finance. The main objective of this study is to identify the appropriate technocrat organization structures to manage the privatization procedures.

        공정거래소송 3심제 도입에 관한 고찰

        법적 분쟁은 궁극적으로 사법부에 의해 판단하는 것이 우리 법질서 하에서 기본 적인 원칙이며, 우리 헌법 하에서 이에 대한 권리는 기본권적인 것으로 이해되고 있다. 공정거래법과 관련하여 발생하는 법적 분쟁의 해결도 이러한 원칙에서 벗어 나 있는 것은 아니다. 구체적으로 우리 법질서는 사법 기관에 의한 분쟁 해결을 두 번의 사실심과 한 번의 법률심으로 구성된 3심제에 의하도록 하고 있다. 이러한 원 칙에 비추어 공정거래법 위반 사건에 대한 분쟁 해결이 2심으로 이루어지는 것이 타당한 것인지, 다시 말하면 현행 공정거래법에 의하여 규정된 2심제적인 분쟁 해 결 방식이 이러한 원칙에 반하는 것인지가 문제가 될 수 있다. 물론 현행 2심제에서 3심제로 변경할 경우에는 법원에서의 법적 분쟁이 강화될 것이고, 이를 뒷받침할 만한 법원의 전문성이 요구될 것이다. 현재의 법원 조직을 살펴보면, 이러한 요구가 당장에 실현되기를 기대하기는 어려울 것이다. 그러나 가정법원, 행정법원, 특허법원 등이 처음 설치되던 시기를 되돌아보면, 서울행정 법원 내에 공정거래사건 전담재판부를 두어 운영하는 방식 등을 도입할 경우에 공 정거래법 위반 사건의 전문성을 어느 정도 보완할 수 있을 것이며, 장기적으로는 공정거래법원의 별도 설립을 추진하여야 할 것이다. Where a person intends to file a lawsuit against any measure taken by the Fair Trade Commission under this Act, he/she shall do so within 30 days from the date of receiving a notice of disposition or receiving the written decision of the Fair Trade Commission against such appeal in clause 1, Article 54 in Monopoly Regulations and Fair Trade Act(hereafter MRFTA). And the Seoul Appellate Court having jurisdiction over the seat of the Fair Trade Commission shall have exclusive jurisdiction over any lawsuits for appeal cases filed pursuant to Article 54 in Article 55 in MRFTA. These rules mean 2 trial system about MRFTA cases. But to ensure due process about MRFTA cases, 3 trial system must be introduced.

        비정형 건축물 외장패널의 시공품질 개선을 위한 데이터 중첩비교기법 적용에 관한 연구

        The most critical issue in free-form buildings is how to construct the free-formed exterior facade panels. Their geometric complexity delivers many difficulties in fabricating and constructing their shapes. The overall construction quality of the panels depends on a various techniques including a panelization design technique, deliberate fabrication and construction techniques in conjunction with materials inherent tolerance, and considerate inspection techniques to measure as-built construction quality. Laser scanning technique is recently in the limelight as a new inspection alternative. The main objective of this study is to identify the policies which can enhance as-built construction quality of the free-form panels. A small domestic free-form building was identified as a case study to meet the research objective. The laser scanning technique was applied to capture as-built data of the building whereas as-planned data was modeled with Digital Project based on reverse engineering concept. An overlapping comparison method was applied to test the two data in view of how well the as-planned was embodied to as-built. Eight mock-up panels which represent the shapes of the case study building facades were made to confirm the problems that would take place in free-form façades construction and deliver the recommendations which would enhance as-built quality of the panels. 비정형 건축물의 건설에서 가장 어려운 공정은 복잡한 곡률로 이루어진 외장패널을 제작 및 시공하는 것이다. 이러한 곡면부재들의 시공 후 품질은 패널을 구획하는 설계기술, 설계서대로 정확하게 제작하는 기술, 패널 재료의 물성을 고려하여 시공하는 기술, 첨단 장비를 활용하여 제작과 시공결과를 검측하는 기술에 달려있다. 선진국의 경우는 많은 비정형 건설프로젝트 경험과 선행연구를 통해 이러한 기술들에 대한 다양한 Know-How를 축적하여 시공 후 품질 확보에 주력하고 있지만 국내 기술력은 지극히 초보적 수준이다. 본 연구는 국내에 건축된 비정형 주택건축물을 대상으로 3D 레이저 스캐닝 기술을 이용하여 비정형 외장패널의 설계 대비 시공결과를 비교하고 패널부재의 곡면 형태에 따라 어떤 문제점이 발생하는 지 파악하며 곡면 형태별로 Mock-Up 패널부재를 제작하여 파악된 문제점의 원인을 실증적으로 분석함으로써 향후 비정형 패널부재의 제작/시공 시 품질확보를 위해 프로젝트관리자가 고려하여야 할 사항을 제시하고자 한다.

        A Study on the Algorithm of Cash Flow Forecasting Model in The Planning Stage of a Construction Project

        Recently, due to the global liquidity crisis, construction companies are in bad condition financially. However, by monitoring their cash flows and setting up measures to avoid a liquidity crisis, in a proactive and timely manner, construction companies can manage themselves out of the crisis. This study suggests an algorithm of modeling future cash flow, to be used in the planning stages of projects of construction companies, in order to effectively manage liquidity. Also an algorithm which calculates the optimal cash level by considering elements such as time lags, cost categories and the weights of the cost categories to earned value and budget in the planning stage of a construction project. The algorithm also suggests a forecast of cash flow by comparing the variables of cash-in and cash-out, the output of which is derived through simulations made between such elements as billing time and time lag. Case studies regarding the application of the cash flow forecasting algorithm are also presented. This paper aims to provide a solution for any expected liquidity problems and the implementation of a measure to forecast an adequate cash flow level for construction companies.

        Measuring Risk-associated Activity's Duration: A Fuzzy Set Theory Application

        Uncertainty is inherent in the construction projects. Appropriately determining a project schedule under uncertainty is one of the most important factors for a contractor’s success in a project. However, when the likelihood of incurring risk events and the riskassociated consequences are uncertain, contractors often face difficulties in estimating project duration. While the Critical Path Method (CPM) has been widely used in scheduling a project, it has been frequently criticized because it assumes an activity’s duration deterministic without reflecting uncertainty involved in a project schedule. The Program Evaluation and Review Technique (PERT) and the Monte Carlo Simulation (MCS) technique have been used to reinforce the shortcomings of the CPM through applying probabilistic analysis approach. They, however, still impose a problem of identifying probabilities under the circumstances where schedule variables cannot be defined as probabilistic nature. The main objective of this paper is to present an alternative schedule risk quantification method based on the fuzzy set theory for estimating a risk-associated activity’s duration. A hypothetical case study is prepared to show how the proposed method can be put into practice. Interviews with industry experts are also held to verify the usability as well as to identify the pros and cons of the method.
