        한.중 국제중재제도의 비교와 시사점

        The rapid growth of Korea-China trade that was since the establishment of diplomatic relations in 1992, led China to surpass the United States and Japan to become Korea's largest trading partner in 2009. "The largest trade" also means "the most disputes", so it is essential to study on dispute settlement and enforcement system of the two. Therefore, in order to make the traders correctly understand and use the arbitration as a dispute settlement method in both China and Korea, this article makes a comparative study on arbitration system between the two countries. And finally, it analyzes the enforcement situation of arbitral award in China, then provides the author's personal recommendations as a countermeasure against the poor enforcement system in China.

        장애학생 관련 변인에 따른 비장애 학생의 통합태도 연구

        장애학생 관련 변인에 따른 비장애 학생의 통합교육에 대한 태도 및 장애학생에 대한 친근감을 알아보기 위하여 본 연구를 수행하였으며, 연구 대상은 대구광역시 초등학교 5개교15학급 477명을 선정하였다. 연구 결과 장애학생의 통합에 대한 비장애 학생의 태도에 영향을 미치는 변인은 장애유형, 장애학생 성별, 장애학생의 청결상태이며, 영향을 미치지 않는 변인으로는 장애학생 부모의 관심도, 장애아 가정의 경제적 수준 그리고 장애학생의 학습 능력인 것으로 나타났다. The purpose of this study is to determine the attitudes for integration education and the intimacy with disabled students of Nondisabled students influenced by disabled students. For such purpose, 477 students of 15 classes from 5 elementary schools located in Daegu Metropolitan City were selected as the object of this study. Integrated Attitudes was measured through an investigation equipment by Oh Won-Seok and Seo-Yeong Ran which adapted and modified a testing document called Inclusion of Students who are Deaf or Hard of Hearing Inventory (ISDHH) invented by Hsin-Ling Hung(2005). The result indicated that the factors which influence the Attitudes of nondisabled students regarding integration with disabled students are the type of injury, the gender and the cleanness of the disabled student. The factors which do not influence the above are interests of the disabled student``s parents, economic level of the family and the learning ability of the disabled student.

        턴키계약체결시 국제적 강행규정에 의한 준거법 제한에 관한 사례연구

        This article examines the limitations of the choice of law caused by Internationally Mandatory Rules in Entering into the Turn-Key Contracts. In June 2007, Clough Engineering, a corporation based in Western Australia, approached the Federal Court of Australia seeking injunctive relief and leave to commence proceedings against an entity located outside Australia, the Oil & Natural Gas Corp of India (ONGC). Clough had contracted with ONGC to provide a range of services in relation to the construction of gas and oil wells off the coast of India. The contract was governed by Indian law, and included a clause by which the parties agreed to submit their disputes to arbitration. Yet the Federal Court assumed jurisdiction over the dispute, principally because Clough had framed its claim as a plea for relief for contraventions of Australia's Trade Practices Act 1974. The result of this cases that it is possible for an arbitral tribunal to hear a claim made under the Trade Practices Act even if that claim arises “in connection with”a contract the proper law of which is not the law of Australia. However, in Transfield Philippines Inc v Pacific Hydro Ltd, the turnkey contract included a choice of law provision, selecting the law of the Philippines, and a clause providing that all disputes arising out of or in connection with the agreement were to be arbitrated under the ICC Rules, with the seat in Singapore. Hearings were in fact conducted in Melbourne, Australia, although all awards were published in Singapore. The result of this cases that it would not be appropriate for an Australian court to adjudicate claims for misrepresentation under Australian statutes dealing with misleading and deceptive conduct, once the arbitral tribunal had determined, applying appropriate choice of law rules, that such claims are governed by the law of the Philippines. To do so would lead to a multiplicity of proceedings, usurp the jurisdiction of the tribunal and deny the intention of the parties as expressed by them in the arbitration agreement. In short, the Internationally Mandatory Rules as an active part of public order create limitation of party autonomy in choice of law rules in a different way. The court is fully entitled to refuse to use those rules of law applicable on the contract which are in the contradiction to the internationally mandatory rules of law of the forum. And the court may give an effect to those Internationally Mandatory Rules that form a part of a law of foreign country when deciding about applicability of certain rules of applicable law.

        일반학급에 통합된 청각장애아동에 대한 비장애아동들의 태도 연구

        청각장애아동과의 통합교육 경험이 비장애아동들의 청각장애아동의 통합 교육에 대한 태도에 미치는 영향을 알아보기 위하여 본 연구를 수행하였으며, 연구 대상은 초등학교 6학년 아동으로 통합학급 아동 54명과 일반학급 아동 70명을 선정하였다. 검사는 1년의 학교생활이 마무리되는 2월에 실시하였으며, 검사지는 통합에 대한 태도, 친근감, 학급 구성원의 기대에 대한 인식의 세 영역으로 구성되었다. 연구 결과 청각장애아동과의 통합 경험이 있는 통합학급 아동들이 일반학급 아동에 비하여 청각장애아동의 통합교육에 대한 태도가 긍정적인 것으로 나타났다. 또한 통합학급 아동들이 청각장애아동에 대하여 친근하게 느끼는 것으로 나타났으며, 학급 구성원들의 기대에 대하여서도 청각장애아동의 통합에 대하여 긍정적으로 인식하고 있는것으로 나타났다. This study was to investigate nondisabled students` attitudes toward the integrated education with hearing-impaired students. The subject of this research was 54 nondisabled six-graders who had experience in inclusive education with pupils of hearing disability and 70 nondisabled six-graders who had no experience in inclusive education. The selection of subject was done in elementary schools located in Daegu-si. The comparative group students were chosen from classes under the similar environment to the selected inclusive classes. The investigation tool of this research was the Inclusion of Students who are Deaf or Hard of Hearing Inventory: ISDHH, part of which was translated and adjusted to domestic circumstances. The conclusions of this study based on its results were as follows: First, there was significant difference between groups in students` attitudes toward inclusive education according to whether they experienced the inclusive education experience or not. Especially the students who had experience bore very positive attitudes on the inclusive education with hearing-impaired students. Second, there was significant gap between groups in level of friendliness for handicapped students according to the existence or non-existence of integrated classroom experience with hearing-impaired students. Those who ever had experienced integrated class experience felt friendly for students with hearing difficulties. Third, it appeared that significant gap existed in the awareness of expectation to class members in groups according to whether they experienced the inclusive education experience or not. The pupils who were once educated in inclusive classrooms with disabled students understood that class members had positive anticipation to inclusive education with hearing-impaired pupils. By enlarging the opportunity of contact with non-disabled students through mutual interaction, the integrated education with deaf students had contributed to form positive attitudes toward the inclusive education with handicapped students, to enhance friendliness for disabled pupils and to establish positive perception on inclusive classroom as a group. Thus it was verified that the extended application of the inclusive education was very effective method in providing opportunity of proper understanding for the students subjected to special education, and forming positive attitudes toward hearing impaired students.

        RDID-GAN: 비식별화 이미지 데이터 복원을 통한 효과적인 학습데이터 생성

        최근 여러 사회 문제들을 예방 및 신속하게 대처하기 위해 CCTV가 설치되고 있고 인공지능을 활용해 이를 효과적으로 처리하는 방안이 연구되고 있다. 하지만, CCTV에서 수집한 데이터는 개인정보 침해의 우려가 있어 비식별화 작업 없이는 자유롭게 사회문제 해결을 위한 모델을 연구하는데 사용할 수 없다. 따라서, 본 논문에서는 RDID-GAN을 제안하여 비식별화된 사람의 얼굴을 임의로 복원하여 개인정보 침해의 우려를 줄이고 네트워크 학습에도 부정적인 영향을 주지 않는 효과적인 데이터셋 제작 방안을 제안한다. RDID-GAN은 attention module을 활용해 비식별화된 부분에 집중하여 합당한 결과를 생성할 수 있도록 하였다. 우리는 실험을 통해 해당 모델과 기존의 제안된 image-to-image 변환 모델을 정성적 및 정량적으로 비교하였다. Recently, CCTVs have been installed to prevent or handle various social problems, and there are many efforts to develop visual surveillance systems based on deep neural networks. However, the datasets collected from CCTVs are inappropriate to train models due to privacy issues. Therefore, in this paper, we proposed RDID-GAN, an effective dataset de-identification method that can remove privacy issues and negative effects raised by modifying the dataset using a de-identification procedure. RDID-GAN focuses on a de-identified region to produce competitive results by adopting the attention module. Through the experiments, we compared RDID-GAN and the conventional image-to-image translation models qualitatively and quantitatively.

        통합학급 교사의 장애아동과 관계 인식, 자기 효능감 및 소진감 간의 관계 분석

        본 연구는 통합학급 교사의 장애아동과 관계 인식이 교사의 자기 효능감 및 소진감과의 관계를 알아보기 위하여 초등학교 통합학급 교사 198명을 대상으로 연구를 수행하였다. 본 연구에서 활용한 척도는 Ang(2005)의 교사-학생 관계 인식 척도, Cheung(2006)의 교사 효능감 척도 그리고 Kristensen 등(2005)이 개발한 소진감 척도이다. 연구 결과에 따른 결론을 제시하면 다음과 같다. 첫째, 통합학급 교사들의 장애아동과 관계 인식은 대체로 긍정적이며, 특히 통합교육 경력이많거나 특수교육 관련 연수 이수 시간이 많은 교사들이 긍정적인 관계 인식을 가지고 있다.둘째, 통합학급 교사들의 자기 효능감은 대체로 긍정적이며, 통합교육 경력과 교직 경력이 많은 교사들이 그리고 특수교육관련 연수 이수 시간이 많은 교사들이 자기 효능감이 높다.셋째, 통합학급 교사들의 소진감에 있어서는 학생 관련 소진감이 개인적 또는 업무적 소진감에 비하여 높았으며, 통합교육 경력이 적은 교사들이 학생 관련 소진감 정도가 높다. 넷째, 통합학급 교사의 장애아동과 관계인식은 자기 효능감 및 학생 관련 소진감에 의해설명될 수 있으며, 자기 효능감이 높을수록 그리고 학생 관련 소진감이 낮을수록 긍정적이다. 이상의 결론에 따르면 효율적인 통합교육의 수행을 위해서는 통합학급 교사 자격 제도의 도입을 통한 전문성 신장에 노력하여야한다. The aim of this study is to examine teacher’s self-efficacy and exhaustion as a result of recognizing the relation between the teacher and children with disabilities in inclusive classes. To achieve such goal, a questionnaire survey was conducted to 198 elementary school teachers of the inclusive education. The scales used in this study were Teacher-StudentRelation Recognition Scale by Ang(2005), Teacher Self-Efficacy Scale byCheung (2006), and Burnout Scale by Kristensen et al(2005). The results of this study are as follows. First, a relation recognition of the teachers in inclusive classes with children with disabilities was mostly positive. Teachers who had long-term experiences in inclusive education or completed longer hours for special education training courses had positive recognition in particular. Second, a self-efficacy of the teachers in inclusive classes was mostly positive. The longer general teaching experience and teaching experience in inclusive education, more positive the self-efficacy became. The hours of the special education training courses completed by teachers also had a positive influence on the self-efficacy. Third, regarding burnout of the inclusive class teachers, student-related burnout was higher than that of the personal and occupational burnout. Moreover the shorter the teaching experience in inclusive education, the higher the student-related burnout became. Fourth, a recognition of the relation of the inclusive class teachers with children with disabilities can be explained by the self-efficacy and student-related burnout. The relation recognition was positive as the self-efficacy became higher and the student-related burnout became lower.

        지적 장애인의 사회적 통합에 대한 대학생의 태도 관련 변인 간 관계 연구

        본 연구는 지적 장애인에 대한 대학생들의 태도를 알아보기 위한 연구로서 대학생 253명을 대상으로 하였다. 특히 지적 장애인의 사회적 통합, 사회적 거리감, 개인적 권한 및 차별적 신념에 대한 배경변인과의 관계를 확인하고, 사회적 통합에 대한 관련 변인간의 관계 모형을 개발하기 위해 수행되었다. 본 연구의 결과를 살펴보면 먼저 연구 도구의 타당도와 신뢰도가 검증되었다. 둘째, 지적 장애인에 대한 대학생의 태도는 여학생이 보다 긍정적인 태도를 가졌으며, 1학년이 4학년보다 긍정적이고, 특수교육관련학과에 재학생이 보다 긍정적이었다. 그리고 지적 장애인의 사회적 통합은 학년, 만남정도, 봉사활동의 정도에 의해 설명될 수 있으며, 사회적 거리감은 성별, 학년, 전공, 만남정도, 활동 경험에 의해, 개인적 권리는 성별, 만남정도, 봉사활동에 의해, 그리고 차별적 신념은 성별, 학년, 만남, 봉사활동 변인에 의해 설명될 수 있다. 셋째, 지적 장애인의 사회적 통합에 대한 대학생의 태도 관련 변인간 관계 모형은 개인적 배경 변인 중 간접 경험의 정도와 봉사활동 정도에 의해 가장 잘 예측할 수 있으며, 사회적 거리감과 차별적 신념에 대한 정도에 따라서도 매우 차이가 있는 것으로 나타났다. 전체 설명량은 R2=.574로 나타났다. This study examined university students`` attitudes towards people with intellectual disabilities. The subjects of the study included a total of 253 university students. The study aimed at identifying the explanatory variables of social integration, social distance, private rights, and subtle derogatory beliefs of intellectually disabled people and developing a relational model of variables related to their social integration. The study generated the following results. First, the validity and reliability of the study instrument was proved. Second, female students showed more positive attitudes towards people with intellectual disabilities than their male counterparts. In addition, first year students and students majoring in special education related subjects displayed more positive attitudes than senior students and students whose majors were not related to special education. University students`` attitudes towards the social integration of intellectually disabled people can be explained by what school year they are in, their meetings with the disabled, and degree of their participation in voluntary activities. The social distance of intellectually disabled people can be explained by what school year students belong in, their gender, majors, meetings with disabled people, and their activity experiences. In addition, intellectually disabled people``s private rights can be explained by students`` gender, meetings with the disabled, and their voluntary activities. Furthermore, subtle derogatory beliefs towards intellectually disabled people can be explained by what school year students are in, their gender, meetings with the disabled, and voluntary activities. Third among personal variables, the degrees of students`` indirect experiences and voluntary activities was found to be the best predictors of the relational model of variables related to university students`` attitudes towards the social integration of intellectually disabled people. The relation also displayed significant changes with regard to the social distance of intellectually disabled people and subtle derogatory beliefs about them. The entire amount of explanation was R2=.574.
