        한국·미국노인에 있어 지역사회 AIP(Aging in place)를 위한 물리적 고령친화도시환경 중요요인 비교연구

        To identify the characteristics and differences in the important factors of the physical age-friendly urban environment to create AIP for the older adults in Korea and the United States, AARP's age-friendly urban environment evaluation tool was divided into community characteristics, community facilities, transportation and road environment, and public transportation. For the older adults in Korea, environmental factors such as well-managed streets such as cleaning and maintenance, easy-to-read traffic signs, divided bicycle lanes and pedestrian paths, and well-managed and safe parks were significantly related to AIP. For the older adults in the United States, environmental factors such as autonomous crime prevention guards, public sports places where they can exercise in their neighborhoods, and public places with enough chairs were significantly related to AIP. The characteristics of the common factors of the older adults in Korea and the United States for AIP were outdoor places and facilities, and the difference was that the older adults in Korea secured safety according to movement and the older adults in the United States secured safety such as security. Therefore, it is necessary to develop an environmental development project that reflects the opinions of local residents rather than the government's uniform policy because the important factors of the physical age-friendly urban environment for AIP vary depending on the characteristics of the community where the older adults live.

        현행 응급의료비미수금대불제도에 대한 법리적 고찰

        현대사회를 살아가는 누구에게나 응급의료를 제공받아야 할 상황이 발생할 수 있고, 응급의료제공에 있어 치료비 등 경제적 요인이 장애가 되어서는 안 된다. 이에 응급의료제공에 따른 권리와 의무를 규정하고 현실화하기 위한 제도가 마련되었다. 즉, 응급상황시에 국민의 생명과 건강을 보호하기 위한 응급의료가 경제적 사유로 인하여 적기에 응급의료를 제공받아야 할 응급환자에게 지연되거나 거부되지 않도록 하기 위해 마련된 제도가 ‘응급의료비미수금대불제도’이다. 하지만, 현행 응급의료대불기금제도는 그 운영 등 여러 가지 점에서 본래의 취지에 맞지 않게 운영되는 문제점을 나타나게 되었다. 이러한 문제점의 근본적인 부분을 법리적 해석을 통하여, 적용대상, 심사제도의 타당성, 구상권 범위, 권리구제상의 문제, 소멸시효, 처벌규정 및 위탁기관의 적합성 등에 대한 문제점과 개선방안을 알아보고자 한다. This study was carried out to investigate the present conditions and discuss the issues of the Subrogation payment system in emergency medicine. Hitherto preceding study is focusing on controversial of management or efficient control of Subrogation payment system in emergency medicine. The object of this study is legalistic study of the Subrogation payment system in emergency medicine. The current legalistic issues of subrogation payment system in emergency medicine are the following aspects; Firstly, there are a claimant conformity to the standard limit. Secondly, the review system is not propriety of the promptitude. Thirdly, there is a lack of propriety claim for compensation of a support responsible person. Fourthly, there are objectivity and fairness of administrative appeal system. Fifthly, the point where one starts counting of extinctive prescription. Sixthly, the administrative punishment is an illogical system. Lastly, equity and fairness of the Review Agency, as an insurance company and an review Agency are sameness In conclusion, we ought to improvement an unnecessary obstructions of promptitude in the Subrogation payment system in emergency medicine, and ensure a right of emergency medicine without delay.

        백세시대의 노인연령 규범에 대한 함의

        고령사회(aged society)는 전체인구 중 노인 인구 즉, 65세 이상의 인구가 14%가 넘는 경 우를 말한다. 우리나라는 2018년 고령사회에 진입하고 또 2026년에는 20%가 되는 초고령 사회(super-aged scosiety)에 진입한다고 하는데, 여기에 대한 충분한 대책을 마련하지 못하고, 또 고령화의 기준이 애매한 실정이라서 고령 사회의 도래부터 우선 거부하고 싶다. 거부라 는 의미는 바로 노인의 기준부터 다시 점검해 보자는 뜻이다. 노인의 기준은 생물학적, 사회 학적, 법률적 등 여러 측면에서 고려할 수 있 지만, 여기에서는 법률적인 측면의 기준에 초 점을 맞추고자 한다.

        국민건강보험법상 보험료부과체계에 관한 법적 고찰 - 지역가입자 생활수준 및 경제활동 참가율 부과기준 중 성과 연령을 중심으로 -

        While the local health insurance and the employment-based insurance were integrated in July 2000, the insured is divided into employment-based insured and the local insured and the relevant premium has been applied to both groups. The health insurance premium having the feature of social solidarity has to be determined depending on income, that is, the ability to pay in accordance with the principles of social insurance. While employment-based insurance premium has been determined depending on the earned income, the local insurance premium for the local insured has been determined by scoring gross income(evaluated income), property and possession of automobiles. A variety of improvement approaches has been implemented including introduction of the employment-based insurance premium ceiling system (2002) and the change of property scoring system for the local insured (2006). However, the health insurance system which was merged in 2000 has been implemented up to now without significant change even though there were lots of socio-demographic change including increase of income level and the population structure such as low birth and aging. In other words, it is required to implement the premium rating system securing the income-based equity. Nevertheless, it was inevitable to apply the diverse rating standards in the early stage because it was very difficult to verify the income of the self-employed. Although the income verification rate was significantly increased from 23% in 1989 to 44% in 2010, the irrational standards including property, automobiles, living standard and activity rate have been still applied to the local insured because it is difficult to secure the validity of insurance premium rating system and it severely lacks of security. This paper investigated whether the current insurance premium rating system for the local insured imposing the premium on the basis of ‘gender’ and ‘age’ complies with the basic human rights secured by the current Constitution of the Republic of Korea with respect to the practical and theoretic irrationality of insurance premium rating system and standards for he local insured. In accordance with the analysis results, this paper proposed the approach to improve the system.

        건강보험과 자동차보험의 선택적 우선적용에 대한 고찰 - 경과실 자기신체피해 교통사고를 중심으로-

        A person is injured in car accident caused by his/her slight negligence except he/she causes accident by his/her willfulness or gross negligence. Because the National Health Insurance Corporation(hereinafter called “Corporation”) shall not provide any insurance benefit “when he has intentionally or through gross negligence caused a criminal conduct or intentionally contributed to the occurrence of an accident” referred to in Article 48(1) 1 of the National Health Insurance Act. So, if he/she is insured by his/her own bodily injury coverage, he/she can be compensated for his/her medical expenses. The injured have the rights to file either National Health Insurance claim and Automobile Insurance claim but there is no clear and definite adjustment clause. The claim disputes between National Health Insurance(hereinafter called “NHI”) and Automobile Insurance(hereinafter called “AI”) in the own bodily injury coverage makes some problems. Firstly, there are some differences in co-payments which he/she chooses between NHI and AI. Profit per a patient is higher in the NHI than in the AI. Secondly, it can provoke criticism that people shall unnecessarily pay double contributions. Lastly, it can raise moral hazards. For example, if he/she can cover the compensations when the insured receives the compensations from his/her insurer, the Corporation can be claimed by medical care institution payment of the health care benefit costs. In conclusion, first of all, to improve the national health and preserve the insured's rights the Corporation shall keep notice these facts.

        외식산업진흥을 위한 관련 법률 제정의타당성에 대한 입법학적 연구: 양승조의원 및 신성범의원 입법안을 중심으로

        According to the increasing the scale and the importance of the foodservice industry, there is a need of the systematic policy for the foodservice Industry like “the Globalization of Korean Food and Traditional Liquors”. The promotion of foodservice industry affects the growth of economy and employment, in addition to the realization of leisure and the well-being society. Although there are many Acts about foodservice industry, for example FOOD INDUSTRY PROMOTION ACT, FOOD SANITATION ACT etc. but there is no direct law in promotion of foodservice industry, Lately, members of National Assembly introduced the bills relating to the promotion of the foodservice industry. In this study, total review was conducted for Acts and journals related to promotion of foodservice industry. So the findings of the study propose the direction for making the Act of Foodservice Industry Promotion in Korea.

        고령친화도시 환경 요인과 노인의 삶의 질에 관한 연구 : 원주시를 중심으로

        The purpose of this research is to identify age-friendly environmental factors that affect the improvement of the quality of life of the elderly. This research conducted a survey among 370 elderly people aged 65 or older living in Wonju, a city in Gangwon province. It also conducted an investigation using the ‘American Association of Retired Persons (AARP)’s Aged-Friendly Environmental Evaluation Tools (7 Areas) and Quality of Life.’ As a result of the study, it was found that ‘Well-managed safe parks’, ‘Housing offered at various prices with well-equipped public facilities’, ‘Easy-to-read traffic signs’, ‘Reliable public transportation’, and ‘Respect from neighbors’ were important. And regarding improving the quality of life of the elderly, ‘Residential environment’, ‘Relationship with neighbors’, and ‘Residential safety’ were found to be important. Based on these results, as a way to improve the quality of life of the elderly in Wonju, this research proposed expanding convenience facilities for the elderly and building a social network among neighbors, etc. In addition, the necessity and importance of creating an environment for an elderly-friendly city were emphasized.

        한국과 미국노인에 있어 삶의 질 향상을 위한 물리적 고령친화거주환경 중요요인 비교연구

        노인에게 있어 주거환경은 주택의 입지와 함께 사람들과의 상호관계로서 형성된 물리적•정신적 생활영역이며 가치와 행동에 직•간접적으로 영향을 미치고 있기 때문에 노인이 지역사회에서 거주할 수 있도록 주거환경을 개선하는 것은 노인의 삶의 질뿐만 아니라 복지서비스 체계와 관련성이 있다. 따라서 본 연구는 삶의 질 향상을 위해 노인이 물리적 고령친화 거주환경요인 중 무엇을 중요요인으로 생각하고 있는지를 파악하고 한국과 미국 노인에 있어 어떠한 차이가 있는지를 비교 연구하기 위해 미국은퇴자협회(AARP)의 주민중심의 고령친화도시환경 평가도구를 사용하여 조사하였다. 그 결과 노인의 삶의 질 향상을 위하여 물리적 고령친화거주환경 요인 중에 영향을 미친 중요요인은 한국 노인은 「운동할 수 있는 공공장소의 충분성(시기준)」과 「신체기능과 활동에 상관없이 모두 이용할 수 있는 공공건물 및 시설」이 유의한 영향관계가 있는 것으로 나타났고 미국 노인은 「적정주거비용으로 거주(시 기준)」, 「의자가 충분한 공공장소」,「청소, 정비 등 잘 관리된 거리」로 나타났다. 따라서 노인들이 노후에도 지역사회에서 거주할 수 있도록 고령친화적 거주환경 중에서 중요하게 개선되어야 할 요인은 건강 증진과 유지를 위해 신체활동을 할 수 있는 시설 및 설비와 신체적 기능저하에 대응할 수 있는 공공시설과 도로환경이 확보된다면 삶의 질은 향상될 것이다.
