TBT협정과 주류 라벨링 제도에 대한 고찰

라벨링(labelling) 제도는 제품의 생산 및 소비에 따른 환경 오염 및 피해를 방지하고, 각종 제품 소비에 뒤따른 소비자의 안전보호를 위해 시행되는 것이다. 본고에서는 라벨링 제도 중에서도 특히 주류 라벨링과 관련하여 라벨제도의 특징과 유형, TBT협정에 따른 라벨조치의 쟁점을 알아보고, 대한민국의 국민건강증진법 시행 및 개정에 따른 주류 라벨링 제도가 TBT협정에 합치하는지 여부를 분석하겠다. 특히 주류의 경우 이에 부착되는 라벨은 알코올 등이 초래할 수 있는 간암, 치매를 경고하는 내용을 담게 되어 있고, 이는 국민 건강 보호에 반드시 필요한 조치임에도 불구하고, 각 나라별 주류 라벨의 내용이 표시 형식에 따라서 수출국 입장에서는 이를 무역장벽으로 인식할 가능성이 있다. 미국과 대한민국은 주류 관련 WTO 주세분쟁 사례가 있었다는 점, 보건 및 의료 분야 관련 마찰이나 협상이 많았던 점 등 감안할 때 한-미 주류 라벨링 관련 야기될 수 있는 분쟁에 사전에 대비하기 위하여 WTO TBT협정의 규정 및 합치성 여부를 분석하겠다. 주류 라벨링이 국민들의 건강과 맞닿아 있는 보건, 의료 정책 중 하나라는 점에 있어서 타당한 대응방안을 마련해야 하는 것은 필수불가결적 조치로 보인다. Labelling is essential as it protects environmental pollution and damages resulting from production and consumption of products and it is enforced to ensure the safety of consumers who buy and consume such products. Among various spectrum of labelling, particularly labelling on alcohol, its particulars and types are to be focused under this paper, and issues arising out of labelling in accordance with TBT agreement will be deep-dived. In addition, whether labeling on alcohol beverages pursuant to National Health Promotion Act of Korea is aligned with the TBT agreement is to be analyzed. Products of alcoholic beverages are required to contain a warning message that shows alcohol’s influence on liver cancer and dementia. This would be a pivotal action to protect consumers’ health, however exporters may regard it as one of barriers to trade based on contents and marks of labelling. It is known that there had been a dispute on liquor tax between the United States and Korea as well as some conflicts and negotiations relevant to the health and medical sector. Thus, it seems meaningful to find out alignment of Korean labelling on alcohol beverages with WTO TBT agreement provisions. As labelling on alcohol, one of health and medical policies, is closely connected with consumers’ health and safety, plausible actions to deal with any potential disputes need to be taken.

공군 병영도서관 운영 현황과 활성화 방안

Air Force library performs the functions of a library with respect to a specific group of Air Force. However, the development of Air Force library is beginning step, its facilities and services are not meet expectations. The analysis of operating status for entire Air Force libraries is so far not attempted. Focusing on this point, this study analysed for the first time evaluation regarding the overall operating status and activation of Air Force libraries at the levels of wing, group and squadron. The questionnaire was consisted of a total of 45 questions. The questionnaire was distributed to 101 Air Force libraries registered in currently August 2014. I was received the reply from 81 out of 101 Air Force libraries, but the responses of 4 libraries were poor, and analyzed the total 77 library responses excluding them. As the results of the analysis, this paper identified operational status and perception of activation of Air Force libraries as a whole, and pointed out the problems that have been identified regarding the operation of these libraries. Furthermore, this paper suggested concretely activation plan for the development of Air Force libraries. 공군 병영도서관은 공군이라는 특수 계층을 대상으로 도서관의 기능을 수행하고 있지만, 그 발전은 시작단계여서 그 시설 및 서비스 등은 기대에 미치지 못하고 있다. 현재까지 공군 병영도서관 전체를 대상으로 한 운영 현황분석은 시도된 바 없다. 이점에 착안하여 본 연구는 공군 병영도서관 전체의 운영 현황 및 활성화 방안에 관한 인식 평가를 단급, 전대급, 대대급으로 구분하여 실증 분석하였다. 총 45개 문항으로 구성한 설문지를 2014년 8월 현재 등록된 총 101개 공군 병영도서관에 배포하였다. 그 중 81개관으로부터 회신을 받았지만, 4개관의 응답은 부실하여 이를 제외한 총 77개관의 응답을 분석하였다. 분석 결과, 본 논문은 공군 병영도서관의 운영 현황과 활성화 방안에 관한 인식을 총체적으로 파악하였고, 공군 병영도서관의 운영상의 문제점을 지적하였다. 나아가 본 논문은 공군 병영도서관 발전을 위한 운영 활성화 방안을 구체적으로 제시하였다.

영업양도와 해고의 효력을 다투는 근로자의 근로관계 승계 문제에 대한 검토 : 대법원 2020. 11. 5. 선고 2018두54705 판결을 중심으로

‘영업’이란 일정한 영업목적에 의해 조직화된 유기적 일체로서의 기능적 재산을 말하고, 이는 영업을 구성하는 유형ㆍ무형의 재산과 경제적 가치를 갖는 사실관계가 서로 유기적으로 결합하여 수익의 원천으로 기능한다는 것과 유기적으로 결합한 수익의 원천으로서의 기능적 재산이 마치 하나의 재화와 같이 거래의 객체가 된다는 것을 뜻한다. ‘영업의 양도’는 일정한 영업목적에 의해 조직화된 일체, 즉 인적ㆍ물적 조직의 동일성이 유지되며 일체로서 이전하는 것으로, 우리 대법원은 이러한 영업양도가 이뤄진 경우에는 원칙적으로 해당 근로자들의 고용관계가 양수하는 기업에 포괄적으로 승계된다는 입장이다. 한편, 근로자가 노동위원회에 구제 신청 또는 소송으로 해고의 효력을 다투는 기간에 영업양도가 발생한 경우, 근로관계가 양수인에게 승계되는지에 관하여 기존 대법원 판결은 실제 계약체결일을 기준으로 근로관계의 승계 여부를 결정하는 취지의 판시를 해왔다. 그런데 대법원 2020. 11. 5. 선고 2018두54705 판결은 영업 전부의 양도 이전에 정당한 이유 없이 해고된 근로자의 근로관계는 양수인이 원칙적으로 승계한다고 판단한바, 이와 관련하여 영업양도의 법률적 효과인 근로관계 승계 여부에 대한 학설 및 외국의 입법사례, 해고의 효력을 다투고 있는 근로자의 근로관계 승계에 관한 학설 및 관련 판례를 검토하고 근로관계 승계의 법리를 구체화한 이 사건 판결의 판단기준의 타당성을 검토하겠다. This study aims at analyzing the legal concept of transfer of business in accordance with Korean Commercial Code, particularly focusing on the succession of employment in case where an employee claims the validity of layoff. Business refers to assets of companies as an organized and linked segment under a specific purpose of incorporation. In other words, any and all kinds of tangible and/or intangible assets along with other factual backgrounds retaining profitable values comprise the business, functioning as a resource of profits as well as an object of financial transactions. The legal concept of transfer of business connotes a succession of an organized segment under the particular business purpose, maintaining identical schemes. With regards to an issue whether an employment relationship would be succeeded with an integrity at time of business transferring, the Korean Supreme Court holds an affirmative stance on this issue. When an employee requests a relief for a wrongful dismissal to the labor association or files a lawsuit, case precedents have considered the effectiveness date of an employment agreement entered into and between the company and the dismissed employee. However, according to the Supreme Court’s decision with the case number 2018DO54705 dated on the fifth of November, it is concluded that the employment relationship is succeeded, therefore the transferee of the business has been assigned with such relationship, particularly where there is no reasonable ground for the layoff at all. In this study, the general standards provided by the Supreme Court’s decision will be deep dived with elaborating on theories, legislative movements in multiple jurisdictions, and the case precedents relating to the aforementioned of business.

일제강점기의 강제징용배상청구권 문제에 관한 고찰 : 대법원 2012. 5. 24. 선고 2009다22549 판결을 중심으로

국가에 의해 보장되어야 함이 자명한 개인의 생명, 신체, 재산에 관한 기본권이 보호받지 못했던 일제강점기가 있었다. 국가가 주권을 잃고 국민의 기본권을 보호할 수 없었던 일제강점기 말기에 일본정부에 의해 징용되어 히로시마에서 강제적으로 노역에 종사하였던 한국인 피해자들은 미쓰비시중공업을 상대로 손해배상을 청구하기에 이르렀다. 이에 우리나라 대법원은 2012. 5. 24. 하급심판결을 파기환송하고 원고 승소를 선언하였다. 대법원 2012. 5. 24. 선고 22549 판결은 고령의 피징용 근로자들에 대한 ‘구제’의 일환으로 민사법적 책임추궁의 방법을 모색했다는 점에서 큰 의의가 있는 기념비적 판결이라고 할 것이다. 이 글에서는 대상 판결이 국제법상 타당한 논리를 전개하고 있는지를 살펴보고자 한다. During Japanese colonial era, the fundamental rights as people’s lives, bodies, and properties were not protected by the government. Owing to the loss of sovereign power, the Korean victims were drafted into Hiroshima by force to labor unlawfully during the Japanese occupation. Thus, the Korean victims filed the suit, which sought to recover; and alleged that defendants—Mitsubish industry—should be held liable because of the unlawful compulsory manpower draft. The Supreme Court of Korea, on the 24th of May 2012, reversed the ruling of the Court of appeals, and rendered the judgment in favor of the plaintiffs. The ruling of the Supreme Court is monumental in that the Supreme Court suggests the ways to recover the damages in terms of the civil liability, regarded as ‘relief’ to the aged Korean workers. This study focuses on whether the ruling of the Supreme Court unfolds the logic reasonably, particularly in the relation with International public law.

C2C12 골격근 세포에서 산화적 스트레스에 대한 천심련의 보호 효과

본 연구는 천심련 추출물의 H2O2로 유도된 산화적 스트레스에 대한 근육세포 보호 효과에 대해 평가하였다. 천심련 추출물은 10 μg/mL의 농도까지 독성이 나타나지 않았으며, H2O2 처리로 감소한 세포 생존율을 농도 의존적으로 증가시켰다. 천심련 추출물은 1, 5 및 10 μg/mL 농도에서 H2O2에 의한 ROS 생성량을 각각 13.1, 14.4 및 17.3% 감소시켜 근육세포에서 H2O2 처리로 인한 산화적 손상으로부터 보호할 수 있음을 확인하였다. 산화적 손상으로부터 보호해주는 항산화 물질인 GSH 함량의 경우, H2O2 처리로 감소한 GSH 함량은 천심련 추출물 처리에 따라 유의적으로 증가하였다. 지질과산화물의 대표적인 물질인 MDA 함량의 경우, H2O2 처리로 증가한 MDA 함량을 천심련 추출물 1, 5 및 10 μg/ mL 농도에서 각각 23.3%, 33.4% 및 54.5% 감소시켰다. 또한 myoblast의 분화된 형태인 myotube에서 H2O2 처리로 근손상 지표인 LDH 및 CK 활성이 증가하였고, 이를 천심련 추출물이 유의적으로 억제하여 근손상을 억제할 수 있음을 확인하였다. 결론적으로 본 연구를 통해 천심련 추출물은 근육세포의 산화적 스트레스를 효과적으로 개선할 수 있는 사코페니아 개선 소재로 활용될 수 있을 것으로 기대된다.

대학생의 변혁적 리더십이 심리적 안녕감에 미치는 영향

본 연구는 대학생들의 변혁적 리더십과 심리적 안녕감 간의 관계를 검증하고자 한다. 즉 심리적 안녕감에 영향을 미치는 변인고찰과 변혁적 리더십이 심리적 안녕감에 미치는 영향을 알아봄으로써 대학생의 변혁적 리더십개발과 심리적 안녕감 향상을 위한 이론적 기반을 마련하는데 의의를 두었다. 이를 위해 서울소재 4년제 남녀 대학생 520명을 대상으로 설문지를 배부하였고, 회수된 설문지중 511부를 최종분석 자료로 사용하였으며 자료처리는 SPSS WIN 12.0 프로그램을 이용하였다. 연구결과 첫째, 학년과 리더경험 및 리더십교육경험은 변혁적 리더십과 심리적 안녕감을 높여줄 수 있는 변인임을 확인할 수 있었다. 둘째, 대학생의 변혁적 리더십과 심리적 안녕감에 영향을 미치는 요인은 자기효능감과 커뮤니케이션 능력임이 밝혀졌다. 셋째, 변혁적 리더십 수준이 높은 집단의 대학생이 그렇지 않은 집단의 대학생에 비해 심리적 안녕감이 높은 것으로 나타났다. 이상의 연구결과를 통하여 대학생 시기에 변혁적 리더십의 역량 개발은 심리적 안녕감을 유도하는 중요한 방안임을 확인할 수 있었다. 따라서 대학생 시기에 변혁적 리더십을 함양할 수 있는 교육의 기회를 경험케 함으로써 긍정적인 정서 즉, 행복함을 유도할 수 있을 것이며 이는 장차 성인이 되었을 때 원만한 인간관계 속에서 성숙한 사회인으로서의 능력을 발휘하는 토대로 작용할 것이다. Developing leadership is essential attribute for undergraduates to lead individuals and communities to grow and develop in a desirable direction. The objective of this study was to stress development of leadership by finding positive variables which enhance the quality of life through the relationship between transformational leadership and psychological well-being. In addition, this study was examined transformational leadership for psychological well-being for undergraduates Data for this study were collected from 520 undergraduates in Seoul, and 511 reponses were analyzed after data screening. The major findings of this study were as follows:1. Significant relationship was found between transformational leadership and psychological well-being for undergraduates. 2. It was found that self-efficacy and communication skills had direct influence on transformational leadership and psychological well-being. And this variables were identified as relatively important determining factors for transformational leadership and psychological well-being. Based on this study, it is expected to develop leadership programs for enhancing the degree of psychological well-being for undergraduates.

학교 부적응 중학생들의 학교 생활경험에 관한 내러티브 탐구

Narrative Inquiry of School Life Experiences of Middle SchoolStudents Maladjusted to SchoolUnjong Sung & Jung Ha Abstract: The purpose of this study was to understand the school maladjustment experience of middle school students, and data were collected through in-depth interviews from June 2022 to August 2022 with three middle school students maladjusted to school. The meanings of this study were ‘a school that endures by sleep’, ‘Outsider in family and school: A family who does not understand me’, ‘The invisible wall of mind: I want to talk but no one cares’, ‘Time Bombs and Thin Ice: How my friends and teacher see me’ and ‘Teacher who watches over me and scolds’. The results of the study are as follows. First, schools that endure sleep. Second, the outsider of family and school, and third, the invisible wall of mind. Fourth, it appeared as dysfunctional communication, and negatively recognized school maladjusted students also showed a positive attitude of reflecting and reflecting on their behavior. Based on the above results, the direction for future research was presented. 산소 및 향 발생이 운전자 피로에 미치는 영향

본 연구에서는 자동 산소 및 향 발생 시스템이 자동차 운전자의 피로에 미치는 영향에 대하여 검토하고자 하였다. 실험은 건강한 청년 10명을 대상으로 3시간의 시내주행을 실시하되 산소 및 향 발생이 있는 조건과 컨트롤 조건에 대하여 비교 검토하였다. 주관적 측정결과, 산소 및 향 발생 조건에서 컨트롤에 비하여 주행 3시간 후의 운전 피로감이 낮고, 주행 중의 쾌적감이 높으며, 주행 3시간 후에 신체부위별 피로감이 낮은 것으로 평가되었다. 생리적 측정결과, 산소와 향이 분사되는 조건은 주행전에 비하여 주행중에 부분적으로 뇌파에 의한 쾌적도가 증가하는 경향을 보였고, 주행중에 심박수의 변화가 현저하지 않고 안정된 수치를 나타냈다. 이상의 결과로부터 주행시 산소 및 향 발생 시스템을 사용함으로써 운전자의 피로가 경감될 수 있는 가능성이 시사되었다.
