대한민국은 수년간 양벌규정을 통해 사용자와 그 행위자를 처벌해왔습니다. 사용자는 법인 또는 개인이 해당하고 행위자는 법인이나 개인의 대리인·사용인 기타의 종업원이 해당합니다. 양벌규정을 통해서 행위자의 위법행위에 대해서 사용자에게 관리·감독의 책임을 물어 쌍방을 모두 처벌할 수 있고 사용자는 이를 피하기 위해 대리인·사용인 기타의 종업원의 위법행위를 방지·예방하기 위해 많은 주의를 가지게 되는, 즉 행정목적의 효율적 달성을 위해 단속의 실효성을 갖는데 그 취지가 있습니다. 이는 다르게 말하면 범죄능력이 부인되는 법인의 형사처벌을 가능하게 하며 처벌의 공백인 사용자가 행위자에 속하는 자를 통해서 위법행위를 한 경우 의무주체자는 직접행위자가 아니라거나 마찬가지로 실행행위자의 경우 의무 주체자가 아니라는 등의 이유로 처벌되지 않는 것과 같은 상황을 방지할 수 있습니다. 즉 양벌규정은 법인의 형사처벌을 가능하게 하고 처벌의 공백을 방지할 수 있습니다. 그렇지만 양벌규정의 법인 처벌은 여전히 논란에 있으며 그 외에도 여러 문제점이 제기되어 왔음에도 불구하고 지금까지도 양벌규정을 둘러싸고 그 문제점이나 효과에 대한 검토가 제대로 이루어지지 않았으며, 양벌규정의 법리에 대한 대법원의 판례의 입장도 명확하지 않은 실정입니다. 그럼에도 양벌규정은 법인이 중요한 역할을 담당하고, 법인을 통한 불법행위가 빈번하게 발생하고 있으며 이를 규제를 위해서는 필요성이 분명 존재한다고 보입니다. 현재 양벌규정은 여러 특별법에 통일되었다고 말하기는 어려운 형식과 체제로 존재되고 있으며 항공안전법에도 양벌규정은 규율되어있고 또한 개선이 필요한 부분이 있을 거라 생각되는데, 양벌규정에 있어 형법의 일반론적인 관점과 항공산업이라는 특수성을 중점으로 항공안전법의 양벌규정을 분석하고, 연구방향을 제시해 보고자 합니다.

Paclobutrazol이 花盆百合(Lilium spp.)의 生長과 開花에 미치는 影響

This study was carried out to investigate the growth retarding effects and flowering responses in Lilium spp. 'Enchantment' and 'Starling Star' by paclobutrazol treatments. Although there was difference in the cultivars, days to flowering showed no effects with the concentration and method of paclobutrazol treatment. The higher the concentration, the more the reduced height of plant, and plant height was reduced when treated at 2 weeks after planting. The growth regulation was more influenced with the soil drench than with the dip treatment. Flower diameter and floret number were not influenced by different treatment. It is, therefore, suggested that paclobutrazol can be used effectively for the potted Lilium spp. plant production.

국회 표결행위에 미치는 매스 미디어의 영향에 관한 연구 -머츠(Mutz)의 비대인적 영향력을 중심으로

This study investigated the effects of mass media on the lawmakers' voting decisions focused on Mutz's impersonal influence. A survey was conducted for 55 relevant members of the permanent committee (50 respondents and 90.9% of a response rate). In order to have a deeper understanding of the survey results, in-depth interviews were conducted for a total of three aides. The results of the survey showed that the lawmakers made their voting decisions based on 'their ideology and belief' rather than on public opinion. The reasons for such responses were confirmed through the interviews with the aides. Two aides out of three said that it was “because of the most general and easiest answer.” In terms of the paths of recognizing public opinion, both the permanent committee and the general meeting preferred human network, such as aides and colleague lawmakers the most. On the other hand, the responses that they figured out public opinion through mass media were relatively small in number. After checking the reasons for having such results through the interviews with the aides, it has been noted that the lawmakers varied in their use of mass media according to their disposition and tended to consider the political bias of the media concerned when using them. With regard to the effects of the recognition of public opinion on their voting decision, it has been found that the degree of their consensus was not high, but they made their voting decisions based on the public opinion recognized. 이 연구는 국회의원의 표결행위에 미치는 매스 미디어의 영향을 머츠의 비대인적 영향력을 중심으로 탐색하고 있다. 연구 대상은 18대 국회에서 상임위와 본회의의 표결결과가 바뀐 세 개 법안(금융지주회사법 개정안, 학교체육법안, 형사소송법 개정안)이다. 해당 상임위원 55명(응답자 50명, 응답률 90.9%)을 대상으로 설문조사를 실시했다. 이후 설문결과를 보다 깊이 있게 이해하기 위해 상임위와 본회의에서 표결변화가 발생한 의원 8명의 보좌진 중, 각 법안별 1명씩 총 3명의 보좌관과 심층인터뷰를 진행했다. 이를 통해 국회의원들이 표결행위를 할 때 여론을 얼마나 고려하는지, 여론을 어떻게 지각하는지, 여론지각이 표결행위에 영향을 미치는지 등을 검증했다. 연구결과, 국회의원들은 설문에서 여론보다는 ‘자신의 이념 및 신념’을 우선하여 표결행위를 하는 것으로 나타났다. 보좌관 인터뷰를 통해 이 같이 응답한 이유를 확인한 결과, 3명 중 2명이 “가장 일반적이고 무난한 답변이기 때문”이라고 답했다. 여론을 지각하는 경로에 대해서는 상임위와 본회의 모두 보좌진, 동료의원 등과 같은 인적 네트워크를 1순위로 꼽았다. 반면, 매스 미디어를 통해 여론을 파악했다는 응답은 상대적으로 소수에 불과했다. 보좌관 인터뷰를 통해 이 같은 결과가 나타난 이유를 확인한 결과, 국회의원들은 성향에 따라 매스 미디어의 이용 정도가 다르며, 이용할 때도 미디어의 정치적 편향성을 고려한다는 점을 알 수 있었다. 여론지각이 표결행위에 미치는 영향을 확인한 결과에서는 그 일치정도가 높지는 않았지만, 지각된 여론에 따라 표결행위를 하고 있는 것으로 나타났다. 보좌관 인터뷰를 통해 이 같은 이유를 확인한 결과, 여론에 대한 영향은 이슈에 따라, 당의 추진력의 강도 등에 따라 큰 영향을 받고 있음을 알 수 있었다.

본 연구는 백합의 수출과정에서 발생하는 문제점에 대한 해결방안을 마련하고 수출 증대를 위한 대책을 강구한 것이다. 수출용 백합 생산비의 대부분(50% 정 도)을 차지하는 구근 비의 절감을 위하여 수출국가가 선호하는 국내 품종을 개발하고 개발 품종의 구근을 대량으로 생산할 수 있어야 한다. 생산자 조직과 수출 업체의 협의체를 구성하여 수출전문생산단지를 구축하 고 현재 일본에 집중된 수출구조에서 가까운 러시아와 중국 등의 다양한 국가로의 시장 개척이 필요하다. 또 한 수출대상국 현지의 백합 소비 형태를 파악하여 백 합수입국의 요구 시기에 맞추어 상품을 개발하여야 한 다. 관세인하와 식물검역기간 단축 등의 국제적 교섭을 강화하고 차별화된 브랜드와 새로운 마케팅 방법의 도 입이 필요하다. The purpose of this study is to come up with ways for solving problems that arise in the course of export of the lilies and take measures for increasing exports. To reduce the cost of imports of the lily bulb that accounts for most of the production of export lilies. It is necessary to be able to develop domestic varieties preferred in export countries, and to produce the lily bulbs of developed varieties in bulk. It is also needed to construct a production complex specializing in the export by organizing a council between producer organizations and exporters and to expand into new markets in the Russian Far East and China which are geographical close to by coming out of the export system currently focused. In addition, it is required to develop products according to the season required by the importing country by figuring out the pattern of local consumption of the export market. Lastly, it is necessary to strengthen the international negotiations and to differentiate the brand new marketing methods to ensure tariffs are reduced and plant quarantine period is shortened.
