특허권의 제한과 전략적 선택 ― 운송수단을 중심으로 ―

1925년 산업재산권 보호를 위한 파리협약 제5조의3 규정의 신설을 계기로 운송수단 특허권 제한 법리가 국제적으로 통용되게 되었다. 우리나라를 포함한 대부분의 운송수단 특허권 제한 국내법 규정들은 파리협약 제5조의3 규정에서 비롯된 것이다. 이 규정의 목적은 국제 통상을 장려하여 국가 전체의 산업발전을 도모하고자 하는데 있다. 파리협약 제5조의3 규정에 해당하려면 첫째, 외국의 선박, 항공기, 또는 차량일것, 둘째, 운송수단이 파리협약의 동맹국에 일시적으로 또는 우발적으로 들어갈 것, 셋째, 특허 장치는 운송수단의 필요에만 사용될 것 등이 요구된다. 우리나라의 경우 아직 이 규정을 해석한 판례가 존재하지 않지만 영국, 독일, 미국 등 각국의 법원들은 국제 통상의 장려라는 목적 아래 폭넓게 해석하고 있다. 이는 세계화 시대에 각국의 상이한 특허법 규정으로 인해 국제 통상이 방해받지 않으려는 운송수단에 관한 특허권 제한 법리 목적에 충실한 것으로 보인다. 하지만 운송수단 특허권 제한 법리는 운송수단의 소유자가 운송수단의 국적을 임의로 선택하여 운송수단이 특허침해책임에서 사실상 완전히 면제되어버릴 수 있는 문제가 존재한다. 즉, 운송수단의 소유자가 특허제도가 약한 국가에서 운송수단을 등록하거나 운송수단이 결코 운항하지 않을 국가에서 운송수단을 등록한다면 특허권자는 운송수단에 관한 본인의 특허발명을 보호받기가 어려워진다. 따라서 운송수단에 관한 특허권 제한 법리는 국제 통상을 장려하고자 하는 그 본래 목적의 실현과 더불어 본 법리의 남용으로 인한 운송수단에 관한 기술 발전 및 투자가 감소되지 않게끔 조화로운 해석이 요구되고 이를 위하여 파리협약 제5조의3 개정 역시 필요할 것이다. The temporary presence exception adopted internationally in the Paris Convention for the Protection of Intellectual Property. To avoid liability under article 5ter of the Paris Convention, foreign means of transportation must meet certain prerequisite conditions. First, they must be vessels, aircraft, or land vehicles. Second, they must enter another Paris Convention country temporarily or accidentally. Lastly, the patented device must be used exclusively for the needs of the means of transportation. Courts in each country have a broad interpretation of these conditions. However, means of transportation are still subject to the patent laws of their country when they are in that country. Inherent in the reciprocity requirement of the temporary presence exception is a condition that all means of transportation have a particular nationality. Since means of transportation owners can select their transportation`s nationality, they can profitably choose one of the national patent system. This Article argues that the temporary presence exception was not designed to allow means of transportation owners the ability to choose patent system and it is necessary to revise Article 5 of the Paris Convention in accordance with the present time.

인공지능 기술의 발전은 현실이다. 이것을 통해 인류는 보다 풍요롭고 편리한 삶을 구가할 수도 있지만, 영화 터미네이터가 그린 미래의 단면처럼 존멸의 위협에 직면하게 될 수도 있다. 이에 2016년 이래로 세계 각국에서는 인공지능 윤리에 대한 담론이 활발하게 전개되고 있다. 윤리담론을 통해 규범체제의 기초작업을 수행하여 놓으려는 의도가 담긴 것으로 보인다. 이러한 윤리담론은 추후 컨센서스를 형성하며 국제적인 규범을 형성하고 개별 국가가 수용함으로써 법제도를 이루게 될 것으로 예상된다. 이에 본 연구는 기술발전에 따른 부작용에 대처하고자 제시되는 규범적인 대응방안을 검토해 보고자 한다. 우선 ①현재 전개되고 있는 변화의 중심에 서 있는 인공지능 기술에 대한 소개와 ②지금까지 인공지능을 대상으로 발표되어 온 세계 각국의 윤리원칙들을 체계화하였다. 이를 바탕으로 오늘날 규범적으로 논의가 가장 많이 진전되어 국제규범을 형성할 정도에 이른 ③자율형 살상무기시스템에 대한 기존 법적 태도와 향후 발전될 구체적 윤리원칙을 제시하였다. 이를 통해 여러 분야에서의 인공지능 기술의 발전에 따른 규범적인 대응방안을 살펴 보고 현실적인 응용가능성을 타진해 봄으로써 추후 전개될 담론에서 주도적인 역할을 할 수 있을 것으로 기대한다. The advancement of Artificial Intelligence technology is reality. Through this, mankind could have a richer and more convenient life, but may face the threat of extinction, like the scene by the movie Terminator. Accordingly, since 2016, discourses on Artificial Intelligence Ethics have been actively developed in countries around the world. It seems that there is an intention to carry out the basic work of the normative system through ethical discourse. These ethical discourses are expected to form a consensus in the future, form international norms, and form legal systems of each countries. Therefore, this study intends to review the normative solutions to cope with the side effects of technology development. First of all, we will briefly introduce the Artificial Intelligence technology to the level necessary for the thesis. Second, ② systematically organize the AI ethics related literatures around the world that have been published so far. Based on this, ③ Introduce the main issues of international humanitarian law regarding the autonomous weapons. For gaining concrete implications on this issues, ④ this research will conduct a case study to see how the above discussions can be applied into the real case concerning autonomous warships. Through this, by examining the normative solutions along the development of Artificial Intelligence technology, we seek ways to play a leading role in future discourses.
