최근 고속도로건설과 같은 공공사업을 둘러싼 환경이 변하면서 이와 관련한 분쟁이 증가하고 있다. 갈등의 관리와 해결에 관련한 기본법의 필요성이 제기됨에 따라 그에 대한 논의가 진행되었고, 갈등에 관한 법제도의 정비가 필요하다. 갈등이라 함은 공공정책을 수립하거나 추진하는 과정에서 발생하는 이해관계의 충돌을 의미하는데, 이해관계가 점점 복잡해짐에 따라 갈등의 원인과 특성을 정확히 파악하고 갈등예방과 해결의 기본원칙을 합의하는 작업이 필요하다. 그리고 갈등이 미치는 영향을 분석하는 방법에 대한 원칙과 절차를 확립하여야 할 것이다. 고속도로건설과 관련한 보상에 관한 갈등은 다양한 유형으로 분류할 수 있는데, 공공사업과 관련해서 지역 주민과 이해관계인의 이해나 협조 없이는 사업의 진행에 어려움이 있다는 점은 여러 갈등사례들을 통하여 확인할 수 있다. 그 해결방안으로, 보상과 관련된 법률정보를 주민보상설명회를 통해 상세하게 제공하고, 관련 법률을 쉽게 이해할 수 있도록 상담을 해주어 불필요한 갈등을 사전에 예방하도록 해야 한다. 사업단계별로 주민의견이 반영될 수 있는 제도적 보완이 필요하다. 사업추진 과정에 주민들이 보다 잘 참여할 수 있는 공공참여 제도의 도입이 검토될 필요가 있다. 이는 사업의 구상단계부터 주민참여를 활성화하고 참가의 빈도를 높여 주민이 사업내용에 대한 이해도가 증진된다는 점에서 의미가 있다. 공공사업을 시행하는데 있어 국민의 재산권과 편익을 조정할 수 있도록 법제도를 정비하여, 신뢰받고 일관성 있는 공공사업을 추진하여야 할 것이다. 또 최근에 우리의 관심을 끌고 있는 알선ㆍ조정ㆍ중재와 같은 전형적 사법기구에 의존하지 않는 대체적 분쟁해결절차(ADR) 등이 계속 연구되어 갈등해결에 기여하여야 하겠다. 뿐만 아니라 보상갈등의 기본법인 토지보상법에 대한 입법적 개선도 계속 추구되어야 할 것이다. It being changed circumstance of public utilities such as the building of highways, the number of disputes is on the increase. It is needed to discuss a fundamental law of conflict management and solutions that control disputes. Conflict means a public situation in which people or groups are involved in a serious disagreement or argument. It is needed to understand how people bring in a conflict and to do a work that principles of conflict management establish. And the principles will be settled by the process and method of analysis. The building of highways is related to conflicts classified into various patterns, however all cases which make a progress on construction of highway are needed to cooperation of residents. preventing conflicts from offering residents informations of compensation held a public hearing, governments should advise residents to understand the law in connection with compensation. Public opinion should be reflected in a plan of operation. Public participation system in which residents can be participated is required in a plan of operation. If this system promoted to residents' participation, and residents will comprehend a plan of operation more thoroughly. Preventing conflicts maintain legal system in relation to compensation to strike a balance between persons' property rights and public interests, if so, public utilities will be faithfully promoted.
