지방체육회의 재정 안정을 위한 법적 연구

2020년 국민체육진흥법이 개정되면서 지방체육회는 대한체육회와 마찬가지로 독립된 체육단체로서 지위를 갖게 되었다. 대한체육회가 대한민국의 전문체육과 생활체육을 관장하는 명실상부한 대표적인 체육단체로서 역할을 수행하는 것처럼, 지방체육회도 해당 지방자치단체의 유일한 체육단체로서 지위와 위상을 갖고 역할을 수행하게 되었다. 대한체육회는 전국을 대표하는 체육단체로서 중앙정부의 행정기관인 문화체육관광부의 관리를 받는데, 지방체육회 역시 지방자치단체로부터 재정지원을 받는 만큼 관리를 받게 되어 있다. 지방체육회는 지역사회의 체육 진흥을 위한 각종 사업과 활동을 하기 위하여 관할 지방자치단체의 장의 인가를 받아 설립된다. 그런 이유로 지방체육회는 관할 지방자치단체의 다양한 체육사업과 활동을 해야 한다. 국민체육진흥법은 지방체육회의 운영과 활동을 위하여 국가와 지방자치단체가 필요한 경비나 연구비의 일부를 보조받도록 하고 있다. 특히 국민체육진흥법은 관할 지방자치단체가 지방체육회에 대하여 예산의 범위 내에서 운영비를 지원하도록 하고 있다. 그리고 이에 관한 내용은 조례로 정하도록 하고 있다. 국민체육진흥법은 지방체육회의 재정에 관하여 기본적인 내용을 규정하여 지방자치단체의 예산에 포함하고 있다. 과거 지방자치단체의 장이 당연직으로 지방체육회장을 겸직하였을 때는 지방체육회의 재정문제가 발생하지 않았다. 그런데 지방체육회장을 직접 선거를 통하여 선출하여 지방자치단체와 분리하여 독립성을 부여하면서 재정문제가 불거졌다. 지방체육회의 재정 안정은 적극적인 운영과 활동을 위하여 중요한 문제가 되었다. 지방체육회의 재정 안정은 지방체육의 발전을 위하여 중요한 문제이다. 지방체육회가 국민체육진흥법에 규정된 사업을 추진하고 활동을 위해서는 무엇보다도 재정 확보가 필요하다. 그런 점에서 지방체육회와 관할 지방자치단체 간의 재정확보를 위한 예산 편성 협의체가 필요하다. 그리고 지방체육회에 대한 국가 보조는 중요한 재정확보이기 때문에 규모를 확대하는 것이 필요하다. 이외에도 지방체육회는 자체 수익사업을 개발하여 적극적으로 추진해야 한다. 스포츠지도자와 스포츠지도사 자격제도에 관한 법적 연구

스포츠지도자는 체육지도자를 말하는 것으로 국민체육진흥법에 따르면 체육지도자에는 스포츠지도사와 건강운동관리사, 장애인, 유소년, 노인스포츠지도사 등 분야별로 자격을 가진 사람을 분류하여 규정하고 있다. 그런데 2021년 제정된 스포츠기본법에는 체육지도자란 용어는 없고 스포츠지도자란 용어만 언급되어 있다. 그래서 스포츠기본법이 스포츠와 체육을 구분하고 있어서 스포츠지도자와 체육지도자도 구분해야 하는 문제가 발생할 수 있다. 스포츠지도자에 관한 현행법은 국민체육진흥법이다. 국민체육진흥법은 체육지도자라는 용어를 사용함으로써 스포츠기본법에서 사용하고 있는 지도자와 동일한 의미를 갖는지 문제가 된다. 국가의 실정법이 스포츠와 체육을 구분함으로써 스포츠지도자와 체육지도자도 구분될 수밖에 없는데, 국민체육진흥법은 용어의 관점에서 볼 때 협의의 개념인 체육지도자에 광의의 개념인 스포츠지도자 또는 자격사라는 의미에서 스포츠지도사를 포함하고 있다. 실정법상 스포츠와 체육이란 용어의 구분으로 인하여 발생하는 문제 이외에도 스포츠지도자의 자격에 관해서는 국민체육진흥법 시행령에서 스포츠지도사, 건강운동관리사, 장애인스포츠지도사 등에 관하여 규정하고 있다. 그런데 국민체육진흥법상 유소년스포츠지도사와 노인스포츠지도사에 관해서는 구체적인 자격 기준을 규정하고 있지 않다. 이는 국가가 자격을 부여하는 국가자격사라는 점에서 구체적인 기준이 필요하다고 본다. 국가자격제도는 2009년 자격기본법이 제정되면서부터 기본법체계 하에 정비되기 시작하였다. 자격기본법은 국민의 생명과 재산, 국가안보 등 중요한 분야의 전문자격제도는 개별 법률에서 규율하도록 하고, 국가산업분야의 국가기술자격에 대해서는 국가기술자격법에 근거하여 개별법상 근거를 두고 주무관청에서 관리하도록 하고 있다. 스포츠자격사제도도 이에 근거하여 자격제도를 규율할 수 있다. 국가자격제도의 관점에서 보면 체육지도자는 국민체육진흥법에 근거하여 동 시행령에 규정되어 있다. 그런데 체육지도자 중 건겅운동관리사는 스포츠분야보다는 보건복지분야의 자격에 해당한다고 할 수 있어서 이에 대한 정비가 필요하고, 청소년스포츠지도사와 노인스포츠지도사는 구체적 기준이 명확하지 않는 문제가 있으며, 스포츠가 체육보다 광의의 개념이란 점에서 용어의 정리가 필요하다. 스포츠가 국민의 생활에 일부가 된 현실과 생활체육의 활성화라는 관점에서 스포츠지도사는 전문체육 분야의 스포츠지도사뿐만 아니라 생활체육과 학교체육에서도 스포츠지도사 자격을 법률로 명확하게 규정하여 국가자격으로서 스포츠지도사를 규율하는 것이 필요하다. 그래서 스포츠기본법에 근거를 두고 스포츠지도사 자격에 관한 특별법을 제정하거나, 아니면 국민체육진흥법을 개정하여 법률상 근거를 명확하게 정비해야 한다.

This paper presents an experimental study on the behavior of CFT Column to H-Beam Endplate Connections with penetrated H/T bolts under monotonic loading. The object of this study is to estimate accurately the effect about the thickness of endplate and the arrangement of H/T bolts which was not got a grip on the results reported in the previous paper. Main parameters are the thickness of endplates (12㎜, 16㎜) and the arrangemement of H/T bolts (EP1, EP2, EP3 Type). The experimental results were compared and analysed. 1) The specimens were classified by Bjorhovde's and EC3's method. 2) A formula to predict the ultimate moment of connection was derived based on the T-stub model, and theoretical value (_tM_u) computed by the formula corresponded to the experimental value (_eM_u).

도형 개념에 대한 교사 지식에 관한 연구

The study was planned to analyze the figure concepts teachers have according to the years of experiences based on the two aspects, the subject matter knowledge and the pedagogical content knowledge. Further, it aims to have the results utilized in teacher education and training, and ultimately to help elementary school students to establish the accurate figure concepts. We administered the test to the random sample of 77 elementary school teachers of the grade 3 to grade 6, from nine schools of the Daegu, Ulsan and Gyeongsangbuk-do districts, and we analyzed the results. Correlational analysis between the years of experience and the knowledge showed that the content understanding and knowledge decreases as the years of experience increases, while the experiential knowledge related to the understanding of the students and the pedagogical methods increases as the years of experience increases.
