        논문(論文) : 대학자율화 정책의 법적 과제

        대학의 자율성은 대학의 목적인 학문의 연구 전수와 진리탐구 기능을 원활하게 수행하기 위한 필요 조건이다. 이러한 자율성은 대학이 시대적 산물이라는 점으로 인하여 국가나 시대에 따라 그 모습을 달리하여 왔다. 우리나라는 1980년대 후반에 이르러 정치 사회 환경의 변화에 따라 1987년의 개정헌법에서 「대학의 자율성 보장」규정을 신설하여 대학운영의 자율성을 크게 신장할 수 있는 계기가 되었으나, 정부의 소극적 접근과 대학의 여건 미흡 등으로 인하여 만족할 만한 변화를 이루지 못하였다. 현 정부는 불필요한 대학관치의 완전 철폐, 대학입시의 완전 대학자율화, 관치 없는 대학재정 지원 등을 선거공약 사항으로 하여 추진해 나가고 있다. 그러나 법치국가에서의 주요정책의 추진은 법률이 정하는 바에 의해야 하고, 또한 법률은 헌법 적합성을 갖추어야 한다는 점에서 정부의 대학자율화 정책은 다음과 같은 법적 과제를 안고 있는 것으로 보인다. 첫째, 현행 법령의 규정 중 헌법상 기본권제한 심사 기준에 비추어 적법성 논란의 여지가 있는 대학의 자율성 제한 규정들을 재검토하여 합리적으로 개정한다. 둘째, 현행 법령에 규정된 각종 대학 규제규정(금지, 제한, 인가, 승인, 보고 등에 관한사항) 중, 헌법상 기본권인 대학의 자율성과 사학의 특수성에 비추어 논란의 여지가 있는 부분은 재검토하여 폐지하거나 보완한다. 셋째, 현행 법령 중 일정한 목적이나 범위를 정하지 아니한 행정부의 대학 지도, 감독 규정들을 합리적으로 정비하고, 대학의 자율성 제한의 여지가 있는 새로운 정책은 법적 근거를 마련하여 추진해 나간다. The university autonomy is an indispensible requisite for the efficient performance in the original functions of academic research and teaching. Why the university autonomy is important is one thing, and the other is how to initiate it in the context of a nation with different historical background and educational dynamics among relevant agents in the higher education. In Korea, there was a nationwide democracy movement in the late of 1980s. One of the major outcomes was to enact a provision of the university autonomy in the Constitution. The article was successful for setting up a constitutional basis of the university autonomy policies, and universities were bestowed with the constitutional rights. But the provision in the Constitution did not mean the realization of the university autonomy. The reality was not so much as to initiate the progressive changes in the wide range of university policies. The government was still reluctant to issue policies for university autonomy to great degree, and many universities were not equipped with quite a few capabilities and responsibilities so much to persuade the government. With the advent of Lee Myung-bak administration, substantial and concrete policies are developed and implemented step by step in order to deal successfully with the past limitations. However, there are still legal problems left in the consideration of the constitutional needs. Basically, the constitutional scrutiny test is to be used to the provisions of acts involving reasonable suspicion, and if the result of the test is negative, relevant acts shall be revised in concert. Especially, the provisions with the legal effects of constraints should be analyzed in the view of the rule of law, and repealed to the range of necessity for the university autonomy and the speciality of private higher institutions. Moreover, the administrative guideline and paternalistic supervision beyond legitimate goal and limitations shall be reasonably rearranged and the government, if as much as possible, needs to get rid of them for the global competitiveness of universities.

        중소형 빌딩의 자본환원율 스프레드 결정요인에 관한 연구

        Recently based on the low interest rate trend, investor s interest in profitable real estate is rising. However, there are difficulties in gathering information necessary for investor decision making, which is lacking in research on small and medium-sized buildings. The purpose of this research is to analyze the determinants of the capitalization rate spread which is one of the useful investment indices for small and medium sized buildings. For empirical analysis, we have collected small and medium sized building data of Seoul area traded from 2009 to 2015. The empirical research shows the capitalization rate spread of small and medium building is affected by macro economy, commercial area, building, and ownership characteristics. Consumer price index and land price index are found to have a negative influence on capitalization rate spread. And the stock market index proves to have a positive influence. It has been found that it has different influences on the capitalization rate spread according to maturity of the commercial area. Buildings located in the downtown area like Jongro have a high capitalization rate spread, whereas the buildings in the newly developing commercial area like Shinsa-dong have lower capital returns. According to the characteristics of the building, when the total gross floor area is large or the building has been remodeled, the capitalization rate spread is high. On the other hand, the capitalization rate spread is low when building has been developed at low density or and its elapsed years is increased. Lastly, the building owned by the corporation has a lower capitalization rate spread than the building owned by the individual.

        대학법인 재산권 제한구조의 법적 과제

        대학법인은 일반적으로 대학교육기관을 설치·경영할 목적으로 사인이 소유재산을 출연하여 설립한 학교법인을 말한다. 대학법인 재산은 대학교육 활동의 필수재산으로서 국민 일반의 공교육을 목적으로 제공되었다는 점에서 국가는 그 재산이 학생들의 교육을 위해서만 사용될 수 있도록 재산권을 제한하고 있다. 현행 사립학교법은 대학법인이 그 재산을 매도·증여·교환 또는 용도변경이나 담보제공 등을 하고자 할 때 에는 교육과학기술부장관의 허가를 받게 하는 등 광범위 하고 세부적으로 규제하고 있다. 이러한 대학법인의 재산권의 제한은 국가가 국민의 공교육을 보호하기 위한 장치로서 불가피한 점도 있지만, 한편으로는 사학의 자율적이고 창의적인 교육활동을 방해하여 사립대학의 특성적 발전과 국제경쟁력 강화에 걸림돌이 될 수 있기 때문에 필요한 최소한도의 제한에 그치는 것이 바람직하다. 그리고 사립대학의 폐교로 인하여 대학법인을 해산하는 경우 그 잔여재산의 귀속에 관한 사립학교법 규정은 재검토할 필요가 있다. 당해 대학 설립·경영자의 부정이나 부실운영 등 과오에 의한 문책적 폐교의 경우와 대입적령인구의 급감 등 사회 환경 변화가 폐교의 주된 원인이 되는 경우를 구분하는 것이 타당하다. 현행 고등학교 경영 학교법인이 학생 수 격감으로 해산하는 경우 그 잔여재산 귀속특례에 관한 규정을 사립대학 폐교의 경우에도 유사하게 적용되도록 개선하는 방안이 대학 구조조정을 용이하게 하고 사립대학 설립정신을 존중하는 것이 될 것이다. The university foundation is an educational foundation established for the purpose of installing and managing private university with the property of a private unit. The property of university foundation is a public one that is provided for the purpose of university education. The function of university foundation`s property is citizen`s public education. Therefore, the country has the authority and responsibility to protect the educational rights of the students who are receiving education under this property. Consequently, the country has been restricting the free practice of property rights by enforcing private school laws. For example, universitys have to receive jurisdiction`s approval when they wish to sell, give, or exchange the basic property of university foundation. However, existing restricted system need to improve for the private university`s growth. The restricted structure of the residual property of the disbanded university foundation should be change. When a private university has to close down due to unexpected social changes such as a sudden decrease in the national number of students, the return policy of residual amount of property need to improve similar to the policy of high school foundation.

        수용성 키토산에 의한 중간엽 줄기세포에서 골아세포로의 분화에 대한 효과

        Chitosan is produced commercially by deacetylation of chitin, whiche is the structural element in the exoskeleton of crustaceans(crabs, shrimp, etc). Chitosan enhances the transport of polar drugs across epithelial surfaces, and is biocompatible and biodegradable. Chitosans are available for biomedical applications. In this study, we evaluated the effect of water-soluble chitosan on the osteogenic differentiation of mouse multipotent bone marrow stromal cells(D1 cells). D1 cells were cultured in osteogenic differentiation medium(ODM) for 6 days, and then treated with mevinolin for 2 days, and subjected to, ie, alizarin red S staining, MTT assays, energy dispersive X-ray spectrophotometry(EDX), fluorescence microscopy and FACS analysis. WSC 3K, WSC 5K, WSC 10K, HM1, HM2, HM3 and HM4 enhanced osteoblast differentiation as assessed in Alizarin red S staining. Furthermore, EDX analysis showed that WSC 3K, WSC 5K, WSC 10K, HM1, HM2, HM3 and HM4 enhanced calcium peak in cells and immunofluorescence staining and FACS analysis against surface molecules(CD44 and CD51), WSC 5K and HM2 were more increased surface molecules than ODM alone. We suggest that water-soluble chitosan enhances osteoblast differentiation through the induction of calcium deposit and the enhancement of surface molecules, such as, CD44 and CD51.

        상하이 오피스 임대료 결정요인에 관한 연구

        Despite of the rapid growth of the Chinese office building market, there is little research on this market. This study aims to broaden our understanding of the Chinese office building market by analyzing Shanghai office building market. This study analyzes 1,178 office buildings in Shanghai by regression analysis. The empirical results show office nodes such as Lujiazui district, Nanjing Road district, Huaihai Road district, and so on, have an impact on office building rents. Location characteristics such as accessibility to mass transportation and the inner ring highway have a positive influence on office building rents. This study also confirms that office building characteristics such as gross leasable area and the number of elevators have a significant positive effect on rents. On the other hand, office building age has a negative effect on rents.Although Shanghai office buildings previously converted from industrial factories or warehouses command lower rents than average, office buildings in mixed-used development command higher rents. Lastly, management characteristics such as presence of a professional management company, possession of a license to rent to foreign companies, and availability of interior services have a significant influence on Shanghai office building rents. The office buildings which have a license to rent to foreign companies, offer interior service, and are managed by a professional foreign or Chinese management company, command higher rent.

      • 신규분양아파트의 계약행동에 관한 연구

        The pre-sale results of newly sold apartments are very important for the stable operation of the project. Therefore, operators are trying to understand market demand. In addition, academic studies are conducted on the results of the sale. However, there is a limitation in analyzing the factor of the individual unit level because the study on the contract rate is mainly performed in the previous study. Therefore, this study analyzes whether the contract is made within the contract period considering the characteristics of individual units. The data used were data from 101,770 households in 180 counties nationwide from 1995 to 2016. The results of the analysis are summarized as follows. As the rate of increase in interest rates increases, the probability of contract decreases and the probability of contract increases as house price index rises. In addition, housing policy that restricts demand or supply has a significant effect on contract probability. In the complexity characteristics, the contract probability was affected by the size of the complex and the block design. In the characteristics of location, the probability of contract is higher when living facilities are nearby. In terms of sales characteristics, the probability of contract is high when the burden of the interest of the home purchase fund is reduced. In the generation characteristics, the contract probability is affected by the area, the private area rate, the ratio in the total unit number, the number of floors, and the direction.

        자연환기덕트를 통한 초고층 공동주택의 환기성능 분석

        The purpose of this study was to analyze the indoor ventilation performance by CFD simulation in the high-rise apartment according to the use of natural ventilaion duct. There are several ventilation problems in high-rise apartment becase of compact design. Natural Ventilation Duct(NVD) is devised for solving ventilation problem by air inflow from outdoor through Bernoulli’s effect. To analyze NVD performance, two theoretical model was designed. One is existing study model, and the other one is reform model which improve the performance of first model. The results of this study were as follows; the 1st model showed ventilation performance to some degree. But, there was the inverse ventilation. The 2nd model showed better ventilation performance than 1st model. Moreover 2nd model solved the inverse vetilation problem of 1st model. So, it could be possible to put NVD to practical use later.
