WWW상에서 운용되는 전자 메일 시스템의 설계 및 구현

인터네트 사용자가 급격히 증가함에 따라 PC에서도 전자 메일 기능이 요구되고 있다. 기존의 유닉스 시스템이 메일 기능을 지원하고 있으나 이는 텍스트만으로 한정되어 있으며, 인터네트 메일의 표준인 RFC 821/822 역시 7bit 텍스트만으로 제한되어 있어 다양한 멀티미디어 정보를 표현하는데 한계가 있다. 멀티미디어 관련 기술의 발전으로 대부분의 서비스가 멀티미디어화 됨에 따라 다양한 미디어를 지원하는 전자 메일 시스템 개발이 더욱 절실히 요구되고 있다. 본 논문에서는 다양한 OS상에서 실행 가능한 전자 메일 시스템을 구현하기 위해 Java를 이용하였고, 다양한 미디어의 지원을 위해 MIME(Multipurpose Internet Mail Extensions)를 표준으로 하였으며, SMTP(Simple Message Transfer Protocol)와 POP3(Post Office Protocol) 프로토콜을 기반으로 하여 설계 및 구현함으로써 PC상에서 전자 메일 시스템이 가능하도록 하였다.

무역서류의 전자화에 따른 법제도적 과제 : -전자어음법과의 관련을 중심으로-

전통적으로 중앙 집중식 운영 모델에서는 무역 금융과 거래자가 비즈니스 프로세스를 처리하는 방식을 관리했다. 그러나 분산원장기술(DLT)로서 블록체인은 점점 더 주목을 받고 있으며 신용장(L/C)으로 지불하는 것과 같은 기존 금융절차를 붕괴시킬 가능성이 있다. 국제무역 행위자는 블록체인 및 스마트계약 기반 플랫폼의 구현을 통해 금융 프로세스의 기술 리엔지니어링의 이점을 누릴 수 있다. 한편 전자 환어음의 사용은 문서화 절차를 간소화함으로써 매도인과 매수인 모두에게 혜택을 제공한다. 그러나 우리나라의 전자어음법에 따르면 전자어음의 발행이 불가능하게 되어 있다. 전자환어음과 관련하여 위 법의 법적 쟁점과 개정 방향을 검토할 필요가 있을 것이다. Purpose : This study aims to analyze the legal and institutional issues involved digitalization of trade documents considering how they are linked to the Electronic Promissory Note Act. Research design, data, methodology : Electronic trade documents were examined through a literature review of academic papers, and internet data were analyzed. Results : Traditionally, the centralized operating model has governed trade finance and the manner in which traders handle business processes. However, blockchain, as a distributed ledger technology (DLT), has attracted growing attention and has the potential to disrupt legacy finance procedures such as payment by letter of credit (L/C). Conclusions : International trade players may benefit from the technological reengineering of financial processes through the implementation of blockchain- and smart contract-based platforms. In other words, the use of the electronic bill of exchange can be beneficial to both sellers and buyers in streamlining the documentation process. However, under the Electronic Promissory Note Act, it is impossible to issue electronic bills of exchange in Korea. This study reviews the legal issues arising from the above Act and suggests directions for the revision of the Act focusing on electronic bills of exchange.

사례로 살펴본 부당행위계산부인 제도에 관한 연구

본 연구는 국세청 국세법령정보시스템에 수록된 2005년부터 2013년까지 법인세 부당행위 계산부인관련 심사청구, 심판청구, 조세소송 불복처리건수는 370건으로 이중 인용(패소)건 216건의 자료를 중심으로 분석하여 개선방안을 제시하였다. 첫째, 부당성 판단기준이 개별세법별로 매우 추상적으로 규정되어 있고, 각기 다르고 모호하여 과세관청에서는 국고주의적으로 판단하는 경향이 있다. 따라서, 부당성 판단기준을 시행령이 아닌 법률에서 규정하고 공통내용은 국세기본법에서 규정하는 방법으로 통일성 있게 법령을 정비해야 한다. 둘째, 법인세법시행령에서 시가가 불분명한 경우 감정가액과 상증법상 평가방법에 의한 가액으로 한정하여 획일적인 평가․계산방법을 적용하도록 규정하고 있는 것은 유사한 상황이 없는 거래 등 모든 상황을 반영하지 못하는 한계가 있다. 이에 대한 대안으로 합리성이 충분히 검증된 현행 국제조세조정에 관한 법률의 정상가격 산출방법을 활용하는 방안을 제안한다. 셋째, 특수관계인 범위에 있어서 친족범위가 비현실적이고, 사용인의 친족 및 주주 등의 범위가 광범위하고 불명확하기 때문에 과세관청이 해석 및 적용에 있어서 남용의 소지를 지니고 있다. 친족의 범위를 축소하고, 사용인의 친족범위에서 ‘경제적 의존관계에서 생계를 함께하는 친족’을 제외하고, 주주의 범위를 ‘지배주주 등’으로 한정하는 등 범위를 현실에 맞게 축소해야 한다. 넷째, 부당행위계산부인에 따른 소득처분으로 발생하는 이중과세 문제와 관련하여 이자, 배당, 기타소득 등의 경우 이중과세 조정규정을 명문화하고, 양도소득의 이중과세 조정규정도 현행 법률 및 시행령에 나누어진 것을 법률로 규정하여야 한다. 소득 경합 시에는 거래 또는 분여받은 이익의 성격에 따라 양도소득 또는 증여세가 먼저 과세되도록 개선하고, 부당행위계산부인의 당사자인 거래상대방에 대한 대응조정을 인정하지 않아 현존하는 이중과세문제는 현행 국제조세조정에 관한 법률의 대응조정 규정을 도입·보완하여 해결해야 한다. In this study, 370 cases of administrative, tax tribunals and judicial courts(mostly focusing on 216 relevant cases) concerning rejection system which were posted up in tax information system(taxinfo.go.kr) of National Tax Service during year 2005 to year 2013 were collected and analyzed with recommendations for improvements. Firstly, the criteria for judging unfairness in respective tax laws is so abstract, different and vague that tax authorities often lead to "in dubio pro fisco". The criteria for judging unfairness should be enacted in law(not in enforcement ordinance) and commom rules should be enacted in tax basic law. Secondly, because the regulation in corporate income tax law which stipulates in the absence of market price to refer only to the amount of certified evaluation firm or that of the regulations in inheritance and donation tax doesn"t reflect all the circumstances including the situation of lack of no similar transactions arm"s length methods of law on reconciliation of int"l tax the reasonableness of which was fully verified should be introduced. Thirdly, since the scope of kindreds in persons with special relationship is unrealistic and the scope of kindreds of employees and shareholders is broad and uncertain, which leaves the possibility of abuse from tax authorities, kindreds under same livelihood with economic dependance from the scope of kindreds of employees should be excluded and the scope of shareholders should be restricted to controlling shareholders. Lastly, concerning the double taxation problems aroused by the income disposition of rejection system, regulations on double taxation adjustment of interest, dividend and other income should be clearly enacted and regulations on double taxation adjustment of alienated income should be enacted in law(not in law and enforcement ordinance separately). In case of collision of types of income, in the first place alienated income tax or donation tax should be imposed according to the characteristics of transactions or granted profit. Corresponding adjustments in law on reconciliation of int"l tax should be introduced and supplemented to eliminate double taxation which exists in current tax laws.

무역금융분야에서 블록체인기술의 활용 필요성과 과제

4차 산업혁명을 대표하는 혁신기술 중 하나인 블록체인은 무역금융분야에서의 활용도가 높을 것으로 기대되고 있다. 기존 무역금융은 거래절차가 복잡하고 시간과 비용이 많이 소요되는 단점이 있으므로 블록체인 적용으로 거래신뢰성을 높이고 비용절감 효과를 가져올 수 있다. 블록체인 적용시 스마트계약을 통해 동일한 무역정보를 동시에 다수의 이해관계자에게 전달할 수 있으므로 거래절차가 단순해지고 수수료 등 부가비용을 줄일 수 있으며 관련 서류를 보다 안전하게 보관 및 관리할 수 있다. 그러나 블록체인의 무역금융 적용시도는 아직 초기 단계라 할 수 있으나 관련 규정 및 제도의 마련 등 금융기관의 정부·당국의 지속적인 관심과 노력이 필요하다. 즉, 정부는 발전초기단계인 블록체인기술의 활용도를 높이기 위해 스마트계약 관련 용어 정의, 계약효력, 성립시기 등 구체적인 사항을 규정하고 법적으로 정리할 필요가 있다. 또한 기업은 무역금융내 제공서비스유형에 맞게 블록체인을 적용하되, 기존시스템 대비 효율성을 확인하며 사용자 입장의 비즈니스모델을 개발해 갈 필요가 있을 것이다. 본 연구에서는 블록체인 기술의 무역금융분야에 대한 활용 필요성(가능성)을 분석한 후 그에 따른 과제를 고찰한다. Blockchain, one of the innovative technologies representing the 4th industrial revolution, is expected to be highly utilized in the field of trade finance. Existing trade finance has a disadvantage that the transaction procedure is complicated and takes a lot of time and cost, so the application of a block chain can increase transaction reliability and bring cost reduction effects. When blockchain is applied, the same trade information can be delivered to multiple interests at the same time through smart contracts, thus simplifying the transaction process, reducing additional costs such as fees, and more securely storing and managing related documents. However, the attempt to apply the blockchain to trade finance is still in its infancy, but it requires continuous interest and efforts from the government and authorities of financial institutions, such as the preparation of related regulations and systems. In other words, in order to increase the utilization of blockchain technology, which is the initial stage of development, the government needs to stipulate and legally arrange specific matters such as definition of terms related to smart contracts, contract effectiveness, and timing of establishment. In addition, companies will need to apply the blockchain according to the type of service provided in trade finance, check the efficiency compared to the existing system, and develop a business model for users. In this study, after analyzing the necessity (possibility) of using blockchain technology in the field of trade finance, it will consider the challenges.

WWW를 기반으로 하는 HTML문서는 동적인 문서로 이용할 수 있는 CGI기법을 이용해 다양한 표현이 가능하였지만, 기존의 상호간의 대화 시스템에서는 단순한 HTML 위주로 활용할 뿐 표현의 향상을 얻지 못하고 있으며, 다수 참여자가 동시에 사용할 때 인터넷의 전송 부하와 서버 부하를 분산시키지 못하고 하나의 서버에만 의존하고 있다. 본 논문에서는 사이버 공간에 체계적인 상호 동작을 표현 할 수 있는 인터페이스에 대한 개발과 함께 각각의 사이버 공간에 특징을 부여할 수 있는 프로젝트 파일을 이용해 사이버 공간의 속성을 결정하여, 그룹웨어 방식으로 사이버 공간의 설립 및 소멸이 가능한 분산된 사이버 공간 프로토콜(Eistributed Cyber Space Procotol:DSCP)을 제안한다. DCSP는 사이버 공간 서버의 부하를 분산시킬 수 있도록 허용하고 있으며 독립적인 그룹을 가질 수 있도록 프로토콜을 설계하여 CGI기능과 연동되어 가상의 교육장 및 사이버 채팅을 할 수 있는 공간을 제공한다.

유·무선 환경에서의 게임명령 히스토리 재전송 기법 기반 실시간 네트워크 게임 시스템

본 논문에서는, 다중 플랫폼 기반 비디오 게임을 지원하기 위한 네트워크 게임 시스템을 제안하였다. 제안 시스템은 다수 사용자 게임으로 진행할 수 있도록 설계 하였으며, 실시간 네트워크 게임 진행시 발생되는 네트워크의 부하변동과 지연을 극복할 수 있도록 클라이언트의 초기지연 버퍼링 기법을 이용하여 안정적인 게임진행이 유지되도록 하였다. 또한, 게임 명령의 히스토리 기반 재전송 기법으로 UDP 통신 수단의 패킷 손실 또는 패킷 에러에 대한 단점을 보완하였다. In this paper, we suggest a network game system that can support video game based on multi-platform for multi-user video game. Latency occurring from the load fluctuation in realtime network game is overcomed by using an initial delay buffering scheme on clients, when a real-time game is played, and shows that stable play for a game is achieved as the result of the scheme. Also, We suggest a retransmission algorithm based on the history of game commands, and this Algorithm supplement shortcomings for packet loss and packet error on UDP communication.
