The premise of this study is that the relationship between human beings and residence can be understood when a house is identified from the perspective of occupant. From an internal point of view rather than an external point of view of a traditional house, it is intended to reveal the meaning of the relationship between humans and residence from the lives of residents. The type of housing has changed according to way of human life for a long time, and humans have conveyed the meaning of life through various actions within it. This study reveals the residential usage and meaning of house by investigating their residential behavior that have been passed down from generation to generation, in Nampa old house, one of the representative houses of Jeonnam-do. 본 연구는 내부인의 관점에서 집을 파악할 때, 인간과 주거와의 관계를 읽어 낼 수 있다는 전제를 가진다. 즉, 전통주택의 외부적인 관점이 아닌, 내부적인 관점에서 거주자의 생활로부터 인간과 주거와의 관계 속에서 주거의 의미를 밝혀내 보고자 하는 것이다. 주거는 오랜 세월 동안 인간 삶의 형태에 따라 그 형태가 변화해 왔으며, 그 속에서 인간은 다양한 행위를 통해 삶의 의미를 담아왔다. 이것에 대해 본 연구는 전라남도 지방을 대표하는 근대가옥 중 하나인 남파고택을 대상으로 대대로 이어져 내려온 그들의 주거생활 행태를 살펴봄으로써 이 집의 주거사용법과 공간의 의미를 밝혀내고 있다.

In the sense that a right of retention is a legal real right granted by way of security,special lien-exclusion agrement that prevents a right of retention from ocuring evenif other statutory requirements are met is frequently made in the busines world. Thejudgment states that “a right of retention is a legal real right granted by way of securityto protect the interests of creditors. The parties can make a special agrement to preventa right of retention from ocuring in advance, and such a special agrement is valid.”A right of retention is not established by a contract betwen the owner of the objectand the creditor, but is established by having certain objective requirements prescribedby law. A right of retention of the contractor for construction works is a system preparedby taking a certain burden on real estate security transactions based on the specialprotection value of claim of the price for construction. If the establishment of such rightof retention is excluded acording to the intention of the parties, it wil result in virtualdenial of the legality of a right of retention and its existence as wel. A right of retention has a stronger efect than any other real rights granted by wayof security in that it acts as a virtualy high-priority security right due to its absolute right to refuse delivery, and it is actualy based on the principle of aceptance that doesnot become extinct in the auction proces. However, since the strong security capacityof a right of retention acts as a cause of the special waiver agrement, it is necesaryto improve the problems of a right of retention regarding its efect and those in theauction proces due to its existence. The special agrement that excludes the exercise of a right of retention, which is aright held by the construction contractor in terms of fairnes for the recovery of claimof the price for construction, is for financial instiutions to secure a priority in theexecution of security rights, so it is unilateraly advantageous to these instiutions andunfairly disadvantageous to the recipient. Considering the purpose of the lien system as a legal real right granted by way ofsecurity, special protection value of construction contractor's claim of the price forconstruction, and dominance relationship betwen the contractor, contracte and financialinstiution, it is reasonable to regard the exclusion agrement of a right of retentionwhich prevents the ocurence of a right of retention before its establishment as invalid. It is necesary to provide a provision in Framework Act on the Construction Industry,stating that “a prior waiver agrement that excludes the recipient’s right of retention isinvalid.” The special waiver agrement of a right of retention after its establishment isvalid as in the case of other restricted real right. 유치권은 법정담보물권이라는 점에서 다른 법정요건이 충족되더라도 유치권이 발생하지 않도록 하는 유치권 배제 특약이 빈번하게 이루어지는 것이 거래의 현실이다. 대상판결은 「유치권은 채권자의 이익을 보호하기 위한 법정담보물권으로서, 당사자는 미리 유치권의 발생을 막는 특약을 할 수 있고 이러한 특약은 유효하다」고 한다. 유치권은 목적물의 소유자와 채권자 사이의 계약에 의하여 설정되는 것이 아니라 법이정하는 일정한 객관적 요건을 갖춤으로써 성립하는 권리이다. 건설공사 수급인의 유치권은공사대금채권의 특별한 보호가치에 기초하여 부동산 담보거래에 일정한 부담을 주는 것을감수하면서 마련된 제도이다. 이러한 유치권의 성립을 당사자의 의사에 따라 배제하도록한다면, 유치권의 법정성 나아가 유치권의 존재 자체를 실질적으로 부인하는 결과에 이르게 된다. 유치권은 대세적 인도거절권능으로 인하여 사실상 최우선순위 담보권으로 작용하며, 경매절차에서 소멸하지 않는 사실상 인수주의에 입각하고 있다는 점에서 다른 어떤 담보물권보다 강력한 효력을 가지고 있다. 유치권의 강력한 담보력은 유치권 포기 특약의 원인이된다는 점에서 유치권의 효력상의 문제점, 그리고 유치권의 존재로 인한 경매절차상의 문제점은 개선이 필요하다. 건설공사 수급인이 공사대금채권의 회수를 위하여 공평의 관점에서 보유하는 권리인 유치권의 행사를 배제하는 특약은 대출금융기관이 담보권실행에 있어서 우선적 지위를 보장받기 위한 것으로서 대출금융기관에 일방적으로 유리하고 수급인에게 부당하게 불리한 것으로 볼 수 있다. 법정담보물권으로서 유치권제도의 취지, 건설공사 수급인의 공사대금채권의 특별한 보호가치, 도급인과 수급인 그리고 대출금융기관 사이의 힘의 우열관계 등을 고려한다면, 유치권이 성립하기 전에 미리 유치권의 발생을 막는 유치권 배제 특약은 무효라고 보는 것이 타당하다. 유치권은 건설공사 수급인이 취할 수 있는 가장 실효성 있는 채권확보수단이라는 점에서 건설산업기본법에 「수급인의 유치권을 배제하는 사전 포기 약정은 무효로 한다」는 내용의 규정을 마련할 필요가 있다. 유치권이 성립한 후의 유치권 포기 특약은 다른 제한물권의 경우와 마찬가지로 유효하다.

幸徳秋水の社会主義に関する考察 - 進化論との関係を中心に -

本稿は、幸徳秋水の代表作である『社会主義神髄』や週刊『平民新聞』を中 心に展開された社会主義に関する言説を再照明することを目的にする。とりわけ、幸徳秋水が陥った欠陥として指摘されてきた社会進化論的な解釈を中心に検討を試みた。先行研究では、幸徳が唯物史観を社会進化論と混同したため、マルクス主義の歴史的意義を充分に感得できず、やがてアナーキズムに運動の突破口を求めたという評価がなされた。そして、その原因を英米の概説書を主な参考資料として社会主義を理解したことに求めた。だが、英米の書物には社会主義を進化論的に解釈するのに注意を促していた。幸徳が参考にしたと思われるのは、むしろ西欧マルクス主義者の動向であった。もちろん、これには明治期における進化論受容の日本的特徴を背景にしている。また、倫理的性格を濃厚に帯びている彼の言説を儒教的な特徴として論じてきたが、その論の立て方からみるとこれこそ英米の改良的社会主義から得た特徴であると推定できる。

Robust motion profiles for the residual vibration reduction of an undamped system

This paper proposes two robust motion profiles to reduce the residual vibration of an undamped system: trigonometric and trapezoidal acceleration motion profiles. The proposed motion profiles are defined by the total traveling, accelerating, and rising times in acceleration for each profile. Due to their simplicity, implementation of the proposed motion profiles is relatively easier when compared to previous input-shaping motion profiles. Furthermore, the proposed profiles are more robust in terms of system modelling errors than previous scurve motion profiles. It is found in this paper that the zero vibration and robustness conditions are satisfied if the total traveling, accelerating, and rising times are half-integer multiples of the natural period for the trigonometric profile and integer multiples for the trapezoidal profile.

입학사정관 전형 신입생과 타 전형 신입생의 특성 비교 연구 : 입학사정관 전형 종합평가의 타당성 분석

This study aims to confirm the validity of holistic evaluation, a new admissions system for higher education institutions. This study sampled 1,590 freshmen from four universities in Seoul and three provincial universities from 2011 to 2013. The analytical subjects of this study, the students, were organized into three categories based on the admission criteria by which they were chosen: holistic evaluation (673), selection for high school GPA (504), and selection for national academic aptitude test scores (413). The major findings of the study are as follows: 1) Students selected through the holistic evaluation system are more active in class and more satisfied with school life than students selected according to other admission criteria. 2) Students selected through the holistic evaluation system are stronger in terms of character than students selected according to other admission criteria. 3) Students selected through the holistic evaluation system have a greater sense of self-efficacy when it comes to deciding on their career paths than other students. 본 연구에서는 입학사정관 전형의 전형 방법인 ‘종합평가’의 취지에 부합하는 제도 운영이 이뤄지고 있는지를 알아보기 위하여 전형유형에 따른 신입생 특성(고교교육 참여도 및 만족도, 인성, 진로결정 자기효능감)을 비교 분석하였다. 본 연구의 분석 대상은 2011학년도부터 2013학년도까지 서울 4개교, 지방 3개교에 입학한 총 1,590명이었으며, 전형 유형별로는 ‘입학사정관전형’ 673명, ‘수시 일반전형’ 504명, ‘정시 일반전형’ 413명이었다. 분석결과 입학사정관 전형으로 입학한 신입생이 수시 일반전형 및 정시 일반전형으로 입학한 신입생에 비해 고교교육 참여도 및 만족도, 인성, 진로결정 자기효능감이 높았다. 특히 고교교육 참여도의 하위영역인 ‘비교과 활동 참여도’, 고교교육 만족도의 모든 하위영역 ‘인간관계 만족도’, ‘교육과정 운영 만족도’, ‘학교생활 만족도’, ‘수업만족도’, 인성검사의 하위영역 ‘활동성’, ‘안정성’, ‘지배성’, ‘사회성’, ‘자율성’, 진로결정 자기효능감 하위영역인 ‘목표선택’, ‘문제해결’, ‘미래계획’ 등에서 유의한 차이를 보였다. 연구 결과 입학사정관 전형의 전형 방법인 ‘종합평가’가 본래의 취지에 부합하게 이뤄지고 있는 것으로 확인되었다.

전압제어형 능동전력필터를 이용한 비선형부하의 고조파저감 및 역류개선

본 논문애서는 비선형부하에서 발생하는 고조파 문제와 역률 저하 문제의 해결을 위한 능동필터를 제연하었다. 인버터와 수동필터로 구성된 능동전력필터 비선형부하에 병렬로 위치하고 전압제어방식으로 동작된다. 제안된 전압제어방식은 기존의 전류제어행 방식에 비해 입럭전압 변동에 강인한 특성을 갖는다. 능통전력필터의 작용으로 부하에 필요한 유효전력은 상용전원에서 공급되며 능동진력필터는 무효전력을 공급하에 입력 역률을 개선하­였다. 또한 부하전압을 정현적으로 유지함ㅇ 따라서 부하전압, 입럭전류 고조파 성분이 저감되있다. 본 논문에서 전압제어용 제어기의 구조를 딘순화하여 전체 시스템의 안정성을 높였다. 다수의 시뮬레이션과 실제 실험을 통하여 제안된 제안된 방식의 타당성을 검증하였다. In this paper, voltage control APF(Active Power Filter) is introduced to improve power factor and reduce harmonics generated from nonlinear load. The voltage controlled APF which is consisted of inverter and passive filter operates with nonlinear load simultaneously. Real power supplies from main power to load and reactive power provides from APF to load. According to the results o experiment and simulation, it is proved that the proposed system has the performance of improving power factor and reducing harmonics.
