현행 1949년 제네바협약과 대한민국 : 6 · 25 한국전쟁 포로문제를 중심으로

한국전쟁을 계기로 하여 우리정부가 제네바협약에 가입하지 않은 채 일방적인 선언으로 제네바 협약상의 의무를 지키게 된 과정과 제네바 제3협약 제118조와 제7조를 둘러싼 유엔군과 북한 측 사이의 신경전을 살펴보았다. 그리고 제네바협약이 체결된 지 60년이 지난 지금 대한민국은 제네바 제3협약 제118조의 유보를 철회 할 숙제를 지니고 있으며, 미귀환 국군포로에 대한 숙제를 지니고 있음을 살펴보았다. 1999년 국제적십자사의 요청에 한국정부가 호응하여 제118조에 대한 유보를 철회하겠다고 한 서약이 아직 지켜지지 않고 있는 가운데, 법리적으로는 귀순자에 대해서는 송환의 의무가 주어지지 아니한다는 것을 상기시켰다. 귀순자 처리에 대한 관행과 관습국제법으로 자리 잡은 정치범불인도의 원칙에 근거하여서도 이러한 결론에 이를 수 있음을 살펴보았다. 미귀환 국군포로는 생존자가 얼마 남지 않은 상태이다. 10년이 지나면 더 이상 이 문제가 논의될 필요성이 사라질 수도 있으므로 정부의 당면문제에 대한 해결의지가 강력히 요구되는 시기이다. When the Korean War(1950-1953) was broken out, both North and South Korea was not a party to the Geneva Conventions. Expression of consent to be bound to the Geneva Conventions was made through unilateral pronouncements of both sides at the early stage of the conflict. However, different interpretation and approach over the Convention Ⅲ article 118 and article 7 resulted in a longest negotiation period for the matter of prisoners switch. 2009 works the 60th anniversary of adoption of the 1949 Geneva Conventions. On October of 1999, Korean government made an official announcement to withdraw of reservation concerning the Article 118 by 2003 at the 27th International Conference of the Red Cross and Red Crescent. Ten years have passed since and the government has not kept the promise. The principle of Non-Extradition of Political Criminals as well as customary international humanitarian law guarantee that defector don't have to be sent to North Korea. However, POWs are different in concept as well as in treatment. Those POWs living in a North Korean should be released and repatriated without delay. Chances are only a couple of hundred POWs were reportedly still alive. Timing is critical Further delay in the discussion on this pending matter will make all in vain.
