在信息时代下,人类社会与以互联网为代表的网络维度交互越来越紧密,互联网已经成为人类生存与发展过程中不可或缺的一部分,网络空间事实上也成为人类活动的“第五空间”。与此同时,网络空间技术的发展也给我们带来了前所未有的威胁与挑战,网络恐怖活动与网络黑客的出现甚至已经威胁到了国家安全。网络空间的治理难题成为当下各国政府无法规避的难题。为解决这些难题的措施而提出学理与法理上的依据,网络主权学说应运而生。本文正是以研究网络空间属性与国家主权的演变为切入点,进而全方位、多角度地论证与分析网络主权概念。通过对传统网络空间治理模式的思考与比较,进一步提出以网络主权为原则的网络空间治理模式的建议和构想。 In the context of the information age, the human society interacts with Internet more closely, the Internet has become an indispensable part of human survival and development process, in fact, the network space is human activities have become the “fifth space”. At the same time, the development of network space technology has brought us unprecedented threats and challenges, and the problems of Internet pornography such as cyber violence and online fraud are increasingly serious. Cyber terrorism and the emergence of cyber hackers have even threatened national security. The governance of cyberspace has become a problem that governments cannot avoid. In order to solve these problems, the theory and jurisprudence are put forward. In this paper, which is through researching network spatial attributes and the evolution of national sovereignty, with all-round, multi-angle to demonstration and analysis of network sovereignty concept, is to demonstrate network sovereignty for the principle of space governance mode. Through the thinking and comparison of the traditional network space governance models, the author further proposes the proposal and the plan of the network space governance model based on the principle of network sovereignty.

当前,随着“互联网+”时代的开启,网络技术日新月异。在线交易、共享经济、网上支付、网络政务等的快速发展,以网络为工具的数字技术正在与社会的方方面面产生融合,这在提高中国生活水平的同时也打开了“潘多拉魔盒”。犯罪分子将传统犯罪和网络这种新事物相结合,利用网络犯罪的跨界性、智能型、隐蔽性、经济性等特点使罪恶之手跨越国境边界,蔓延到世界的各个角落。本文以国际公约、管辖权、软法规则为视角对跨国网络犯罪进行分析研究,并提出相应的治理建议。 At present, as “Internet +” era begins, network technology is changing with each passing day. With the rapid development of online transaction, sharing economy, online payment and online government affairs, the digital technology based on the Internet is integrating with all aspects of the society, which not only improves the living standard of world, but also opens the “Pandora’s box”. Criminals combine traditional crime and network, which is a new thing, to commit crimes. The characteristics of cross-border, intelligent and covert make network crimes spread to all corners of the world and increase the difficulty of governance. This paper analyzes transnational cybercrime from the perspective of international conventions, jurisdiction, and soft law rules, and puts forward corresponding governance suggestions.
