「화재예방, 소방시설의 설치·유지 및 안전관리에 관한 법률(이하 “소방시설법” 이라 한다)」은 화재예방과 소방안전을 위하여 특정소방대상물에 소방시설의 설치·유지 및 관리에 관한 의무를 특정소방대상물 관계인에게 부과하고 있다. 또한 화재 발생 시 원활한 화재진압을 위해 특정소방대상물의 관계인으로 하여금 해당 특정소방대상물에 설치되어 있는 소방시설등에 대하여 정기적으로 자체점검을 하거나 관리업자 또는 일정한 기술자격자로 하여금 정기적으로 점검하게 하도록 의무를 부과하고 있다. 그러나 특정소방대상물의 관계인 상당수가 소방시설등에 대한 자체점검의무를 충실하게 수행하지 않음으로써 화재발생으로 인한 피해를 확대시키고 있다. 소방당국의 관여가 없는 현행 자체점검제도는 그 실효성이 미약할 수밖에 없다. 현행 소방특별조사제도는 2011년 8월 도입되어 2012년 2월 시행한 제도로서, 1~2년마다 일반적·전수적으로 이루어지던 소방검사방식에서 특별조사방식으로 전환함으로써 관계인의 자율안전관리책임을 강화할 뿐만 아니라 검사인력의 부족에 따른 형식적이고 부실한 소방검사 운영의 문제점을 해소하기 위하여 효율적으로 상세하게 소방안전관리에 관한 조사를 실시하고자 하는 것이었다. 소방특별조사는 자체점검을 전제로 하여 소방시설법에 부여된 자체점검의무의 이행 여부와 이행의 엄격성 등에 관하여 소방청장, 소방본부장 또는 소방서장이 현장조사를 실시한다. 소방특별조사의 대상은 소방시설법 제4조제1항에서 소방대상물과 소방시설등으로 정하고 있다. 그 대상이 특정소방대상물 뿐만 아니라 소방대상물도 포함하고 있기 때문에 소방시설등을 설치·유지 및 관리해야 할 의무가 있는 구조물이나 물건인 특정소방대상물 뿐만 아니라 그렇지 아니한 화재의 위험이 있는 구조물과 물건도 포함된다. 소방특별조사의 대상을 객관적이고 공정하게 선정하기 위하여 자문위원회인 소방특별조사위원회는 민간이 참여하는 위원회를 구성하고 행정청의 정책결정과 집행단계에서 외부전문가의 전문적인 지식을 활용하여 합리적인 정책추진을 도모하고, 관계기관과 각계각층의 의견을 수렴하여 다양한 이해관계를 조정함으로써 대상선정에 공정성·책임성 확보하는 제도를 마련하고 있다. 소방특별조사의 절차는 소방특별조사계획의 수립, 관계인에게 통보, 조사수행, 결과조치로 진행된다. 소방특별조사를 하려는 경우에 소방청장, 소방본부장 또는 소방서장은 7일 이전에 관계인에게 조사대상, 조사기간 및 조사사유 등을 서면으로 알려야한다. 통보기간의 단축에 대해서는 7일 전 통보하는 것은 소방특별조사의 목적 실현을 저해하기 때문에 적합하지 않고 단축이 필요하다는 견해와 현행과 같이 7일로 유지하는 것이 적합하다는 견해가 있다. 소방특별조사의 소방안전실현이라는 공익적인 가치와 소방대상물 관계인의 권리보호라는 사익적인 가치를 형량하여 현행과 같이 유지하는 것이 적합하다. 소방특별조사를 기존의 소방검사와 동일하게 정기적으로 실시하고 모든 소방대상물을 그 대상으로 하는 경우에는 이에 필요한 소방인력이 현저하게 부족하다. 그러나 소방특별조사에 필요한 소방공무원의 부족을 이유로 화재위험성이 있는 소방대상물에 대한 소방특별조사를 도외시 하는 것은 국가의 화재로 인한 생명과 재산권의 보호에 관한 헌 ...
