アフリカにおける慣習的土地所有權のフォ-マ ル化と開發問題: タンザニア「1999年村士地法」の事例より

アフリカの土地問題とば 端的には土地所有權の確立の問閣のことである。元來アフリカの多くの地でば 慣習法による共同體的な土地保有が主であったが 値民地支配以降に個人的な權利が現れ齟齬が起こるようになる·さらに`` 近年のグロ-パリゼ-ションによる土地の市場開放化の要請により問題は複雜 化している。 これまでの筆者の硏究から`` タンザニアの「1999年村上地法」規定の土地所有權は いわゆる近代法規定の權利と大きく異なっていることが分かってい る·同法ば 村に管理を委ね慣習に基づく占有を認める規定 および總有の入會のような村共同體全員が使用·收益できる土地を「共同體の村土地」とする規定をおき土地流出を防ぐ目的を持っところに大きな特徵がある· タンザニ ア議會での議論および世銀の評價によると 同法は將來的に完全な私的所有權を目指す途上にある`` いわば移行期の法として扱われている·しかし 西洋的な私的所有權の確立が國の混亂をもたらしうる可能性が高い現狀において 慣習に基づく管理と完全な私的所有權立との中庸をいく選擇は極めて現實的といえよう。なお``タンザヱアが獨自の 「村土地法」を制定するに至った過程には`` アフリカの土地政策に影響を及ぼし續けている世銀の土地政策がある。 筆者は一貫して「村封也法」を`` タンザニアの實情に卽した法として評價し ている。タンザニア人にとって村とは生活·居住·生産のすべて場であり`` 彼らは出自の村に對し强いアイデンティティを有するからである·タンザニアが土地法を制定した背景の理解として世界銀行の土地政策の影響の考察を欠かすことはできない·世界銀行の政策は インフォ-マルな制度をいずれ淘汰されるべきものと捉える新古典派主義的な理解から それを認める方向へとシフ卜している。特に最新のが也政策において世界銀行はインフォマノレな制度を制定法化したといえるタンザニアの 「1999年 村土地法」 を`` 世界銀行の政治と合致したものと評價していることに`` 變化を顯著に見出 せる· 村土地法は慣習を制定法化したものであり`` そこには長所も短所もある。 本稿では 「1999年村土地法」規定の導入が村の土地の단保化を可能とするが ``必ずしも經濟成長と結びつかないこと`` むしろ知識のない村人にとって唯-の財である土地を喪失させ貧困を惡化させる可能性を指摘する· また本稿を通じ``筆者は``他國に例を見ない村に特化し村に權限を與えた法制定のユエ-クさを强調している。 現在 アフリカを含む多くの途上國と呼ば れる國-は``グロ-パリゼ-ションの名の下に市場經濟化に卽した土地法制定を迫られている·そのような國-に對し タンザニアの事例は`` 西洋的な個人的所有格擁立が常に最善の選擇ではなく`` 中庸を行く獨自の選擇が存在する ことを知らしめる役目を果たすと考える·タンザニアの村のように共同體が 息づき慣習的な營みが機能しているところにおいては`` 土地がせイフティ ネット機能を果たしている。 それを-律に いわゆる近代的所有權に置き換えることが常に最善ではない。

Experimental and numerical approaches for AC loss estimation in high $T_{c}$ superconductors

It is important to estimate the total AC loss which is the total energy, or power, dissipated in the superconductor in the simultaneous application of AC transport current and an AC external magnetic field. Experimental and numerical works on AC loss estimation of high $T_c$ superconductors in the author's group are reviewed. The method and the set-up for total AC loss measurements are described. The experimental results for a twisted Bi-2223 multifilamentary tape and a Y-123 mm conductor are given. A general theory for numerical electromagnetic field analysis of superconductor by the finite element method is explained. The numerical results for twisted Bi-2223 multifilamentary tapes and a rectangular superconductor simulating coated conductors are presented.

A Review on AC Loss Characteristics of High $T_c$ Superconductors

This paper reviews AC loss characteristics of high $T_c$ superconductors. The mechanisms of AC loss generation are explained briefly, and AC losses are classified by the magnetic field components which generate them. A couple of analytical formulae of AC losses, which are useful for simple and rough AC loss estimations, are presented. AC loss characteristics of single BSCCO multifilamentary conductors and single YBCO coated conductors are reviewed based on previous experimental and numerical studies. AC loss characteristics of those two types of practical high $T_c$ superconductors are compared with each other.

오늘날 경쟁력 강화를 위한 기업들의 자기변화노력들이 끊임없이 진행되고 있다. 하지만 이런 노력들이 지나치게 거시적 차원의 시스템 변화에만 초점이 맞추어져 변화의 와중에서 종업원들이 경험하게 되는 심리적 갈등과 같은 사회적 측면이 자칫 소홀하게 다루어 질 수 있다. 특히 다운사이징(인력감축)에 따른 잔류종업원들의 반응은 다운사이징을 통한 기업의 체질개선노력의 성공여부를 결정짓는 매우 중요한 요소라 할 수 있다. 본 연구의 목적은 이러한 문제인식 아래 다운사이징에 따른 종업원들의 미시적 반응을 과정적으로 이해하기 위한 개념적 모형과 명제들을 제시하는데 있다. 본 연구의 의의는 잔류 종업원들의 반응과 관련한 기존 연구들에서 깊이 다루고 있지 못하는 인지적 과정에 대한 내용을 심리적 계약의 파기라는 새로운 변수를 추가함으로써 보완하고 있다는 점이다. 또한 기존 심리적 계약의 파기에 따른 잔류종업원들의 감정적 반응 즉 신뢰감의 상실 정도를 조절해 줄 수 있는 개인특성 및 상황변수들을 고려하고 있다는 점이다. 끝으로 본 연구에서는 기업들이 다운사이징과 관련하여 잔류종업원들의 부정적 반응을 최소화할 수 있는 방안들을 제시하고 있다. In recent years, many firms have engaged in many forms of self-renewing efforts such as downsizing, restructuring, reengineering, mergers, and acquisitions to gain competitive edges. While research interests in those efforts among researchers been mainly focused on system changes of the firms from rather macro perspectives, enough emphasis has not been given to micro and social aspects of the organizational changes. The psychological impacts of downsizing(work force reduction) on survivors is now keen interests among researchers and practitioners. This paper proposes a model which helps further understanding of the cognitive and psychological process preceding survivors' experiences of trust violations after downsizing by introducing the concept of psychological breach and some moderating variables. Finally, theoretical and practical contributions of the framework and propositions of this paper are discussed.

This Article is intended to be an overview of the legal issues arising from ship collisions. Firstly, this paper introduces the international jurisdiction and applicable law concerning ship collisions with foreign element. Secondly, this paper introduces exchange of Letter of Undertaking and arrest of ship based on collision claims which may be a topic of great interest from the viewpoint of practice. Thirdly, this paper introduces liabilities between colliding ships and the same for third parties including cargo interests. Finally, this paper introduces damages resulting from collisions and other matters.
