이 연구는 토마스 홉스(Thomas Hobbes, 1588-1679)의 사회질서관에 관한 분석 평가이다. 즉 그의 사상을 집대성한 Leviathan(리바이어단)에서 홉스가 무질서와 범죄에 대해 어떤 생각을 갖고 있었는지를 검토 평가하는 것이다. 이를 위해, 홉스가 생각하는 무질서와 범죄는 무엇이고, 홉스는 이들을 어떻게 해결하려고 했는지, 홉스의 해결책은 어떻게 평가할 수 있고 오늘날 시사점은 무엇인지를 밝혔다. 홉스는 당시 유럽에서 벌어진 무질서와 범죄, 즉 기독교세계의 내분과 싸움, 국가 간의 전쟁, 교황과 군주 간의 투쟁, 그리고 이들로 인한 일반국민들의 생활파탄과 범죄 등의 표면상 원인은 종교와 정치에 있지만 근본 원인은 인간의 자기보호와 권력추구 본능에 있다고 보고 새로운 과학적 방법으로 해결책을 제시했다. 그는 통치권력이 없어 자기보호와 권력욕에 따라 움직이는 자연인의 세계(자연상태)에서는 생존과 만족스런 생활을 위한 ‘만인에 대한 만인의 투쟁’이 불가피함으로 이로 인한 폭력과 죽음을 막기 위해 모든 자연인들은 자신들의 권리를 한 사람(국가, 군주)에게 양도하는 사회계약을 체결해야 하고 이 사람이 절대권력을 갖고 평화와 질서를 확립해야 한다는 사회질서관을 제시했다. 이질서관의 구체적 내용을 보면, 국민 상호간의 안전과 평화를 확립하기 위해 자연법을 실현해야 하고, 이 자연법 실행을 위해서는 사회계약을 통해 강력한 절대국가를 설립하여 이 국가로 하여금 자연법을 반영한 시민법을 제정 집행하고 아울러 질서확립에 방해되는 학설들과 불순집단들을 통제하고, 생필품을 풍부하게 생산하되 공정하게 분배토록 하는 것이다. 홉스의 질서관은 기존의 자연적 질서관과 기독교적 질서관들을 배척하고 오늘날의 개인중심 자유민주주의적 사회질서관으로 가는 길을 열어 주었고, 시민법의 집행과 관련하여 범죄의 면죄 조건, 경중판단 기준, 처벌의 목적 등을 논의함으로써 오늘날의 죄형법정주의, 정당방위, 소급입법금지, 묵비권행사 등에 대한 나름대로의 철학적 근거를 제공한 공헌이 있다. 그러나 인간관과 자연상태에 대한 비현실적 가정 때문에 실현가능성 부족하다는 비판이 따라다녔고, 국가의 무오류성을 주장하고 학설들을 통제하며 윤리교육을 경시하는 등의 문제점이 있다. 그럼에도 불구하고, 홉스의 질서관은 사회질서 확립에서 분배적 정의의 중요성을 강조하고, 시민법에 악의 처벌만이 아니라 선의 권장도 포함시켜야 하며, 시민법의 관리에 있어서 가급적 범죄를 양산하지 말아야 하고, 교화 목적이 없는 처벌을 자제해야 한다고 주장함으로써 오늘날 치안당국에 상당한 시사점을 주고 있다. This study is an analysis of Thomas Hobbes’s Leviathan from the standpoint of social order and crime. It tried to figure out Hobbes’s theory on social order and crime, to explain why Hobbes suggested such a theory, to evaluate them in terms of contributions and faults, and to draw lessons for the authorities concerned. * National Police University.. Watching disorders and crimes prevailing in the Europe of the 17 century, such as internal cleavages and struggle in the Christian world, wars between monarchical countries, collisions between the Popes and monarchs, and miserable life and crimes of people, Hobbes diagnosed that their origin was in church and politics, and more fundamentally in the nature of mankind. Then, he suggested a new solution, that is, a social contract theory of social order on the basis of a scientific methodology. According to his theory, human beings pursue for self-protection and glory according to his passions and reason in the state of nature. This tendancy of mankind ends up with ‘War of all against all.’ To avoid this cruel war, human beings are required to follow the Natural Laws and make a social contract to erect an absolute power which will execute the Natural Laws. The Natural Laws are moral precepts inferred from human reason. The absolute power is required to make civil laws on the basis of the Natural Laws and mobilize all kinds of resources and instruments for security and peace of its people. Hobbes is evaluated as a contributor to pave the way to humanistic liberal-democratic social order and to justify the principle of the legality of crimes, the prohibition of retrospective law, the legitimacy of self-defence, etc. But he asserted the infallibility of the sovereign, the control of thoughts and social groups which may intimidate social order, and the neglect of ethical education. Nevertheless, many lessons can be drawn from his emphasis on distributive justice of wealth, laws that can embody the justice and moral ethics in addition to sanctioning the illegal behaviors, prohibiting crimes from being multiplied, and punishment for the purpose of crime-prevention.
