소송절차에서 독립된 디지털증거 검증기관의 필요성에 대한 연구

본 연구에서는 디지털증거에 대하여 보다 나은 신뢰성을 확보하여 더욱 효과적으로 사용할 수 있도록 하는 제도인 독립된 디지털증거 검증기관의 필요성과 그 역할을 제안한다. 본 연구에서 제안하는 독립된 디지털증거 검증기관은 디지털증거에 대한 무결성을 보장하고 검증하는 역할을 하게 되며 수사기관의 증거분석 결과를 법정에서 검증하는 대신 검증기관에서 전문가에 의해 검증 및 확인하는 절차를 거치도록 하여 공판정에서더욱 효율적인 재판을 수행할 수 있도록 한다. 또한 검증기관에서 디지털증거의 검증조서에 대한 열람 등사를 제공하도록 하여 개정 형사소송법의 디지털증거에 대한 증거개시제도를 보다 쉽게 실현할 수 있다. 따라서 독립된 디지털증거 검증기관은 디지털증거를 사용함에 있어 신뢰성을 확보하도록 할 수 있을 뿐 아니라 공판정에서의 신속한 재판을 가능하게 하고 전자증거개시제도에 대한 실효성 있는 방안을 제공함으로써 소송의 상대방으로 하여금 증거조사에 효율적으로 대응할 수 있도록 하여 디지털증거와 관련된 분쟁 및 소송에서 공정성과 효율성이라는 양자를 모두 추구할 수 있게 할 것이다. In this paper, we suggest the necessity of the independent authority for verifying digital evidence apart from the judicial procedure as a trusted third party. It makes digital evidence more reliable and the judgment fair. Independent authority suggested in this paper warrants and verifies the integrity of digital evidence. Using this suggested authority, it makes the judgment more secure and efficient in the court not verifying the analyzed result of digital evidence in the court but making a judgment using the verified result of the authority. In addition, it makes it possible to read and copy the analyzed result of digital evidence in this authority, so Digital Evidence Discovery System is also able to be realized much more easily in the revised criminal procedure law. Therefore, the proposed authority will make justice organizations to be able to adjudicate with more fairness and efficiency.

형태 초점 의사소통 교수법에 따른 초등 영어 학습자의 동사와 조동사 인식 및 쓰기 능력 향상

본 연구는 형태 초점 의사소통 교수법이 초등 6학년 영어 학습자의 동사(3인칭 단수 동사, 과거 동사)와 조동사(should, can, will, have to)의 인식 및 쓰기 능력 향상에 영향을 미치는지, 더불어 정의적 영역에 어떠한 영향을 미치는지 탐구하는 데목적이 있다. 이를 위해, 서울 소재 OO초등학교 6학년 네 학급 중 두 학급에는 기존의 의사소통 중심 교수법을, 다른 두 학급에는 형태 초점 의사소통 교수법을 적용하였다. 3인칭 단수 동사 1개 단원, 과거 동사 1개 단원, 조동사 2개 단원으로총 4개 단원을 수업하고, 사전 검사지와 지연 사후 검사지, 단원별 사전 검사지와 즉각 사후 검사지, 그리고 설문지를 통해 자료를 수집하였다. 본 연구의 결과로는, 형태 초점 의사소통 교수법이 과거 동사와 조동사 인식 및 쓰기 능력 향상에 유의한 영향을 미쳤다. 형태 초점 의사소통 교수법이 학습자들의 정의적 영역에 통계적으로 유의한 차이를 나타내지는 않았지만, 실험반 학습자들의 문법 학습에 대한 부정적인 답변이 비교반보다 많이 감소하였고, 긍정적인 답변이 많이 증가하였음을 확인하였다. 본 연구는 영어를 학습하는 데 있어서 언어의 의미와 기능뿐만 아니라 형태에도 초점을 두어야 할 필요를 강조한다. 또한, 언어 형태에 대한 학습을 할 때에 형태 초점 의사소통 교수법 중 명시적 혹은 암시적 기법을 다양하게 활용할 것을 제안한다. The purpose of this study to investigate whether focus-on-form instruction (FFI) has impact on improving recognition and writing of verbs and modal verbs, and their affective factors. In an elementary school located in Seoul, four sixth-grade classes were assign original communicative language teaching and two classes FFI. The four chapter lessons about third person singular verbs, past tense verbs, and modal verbs. Data were collected from pre-test, delayed post-test, pre- and post-test for each chapter, questionnaire. As for the findings of the study, FFI had positive impacts on improving recognition and writing skills of past tense verbs and modal verbs. Students in the experimental groups showed increase positive opinions about studying grammar than those in the comparison groups. Th study call for more attention to the importance of forms in learning English, coupled with language meaning and function. In addition, employ FFI in teaching language forms.
