최근 몇 년 간 중국 청소년의 범죄 문제는 날로 심각해지고 있으며 이미 사회의 안정과 발전에 크나큰 영향을 주고 있다. 어떠한 방도로 청소년의 범죄 문제를 잘 해결할 것인가 하는 것은 시급한 과제로 되었다. 이웃 나라 일본의 청소년 범죄률은 비교적 낮으며 범죄 예방의 시스템도 상대적으로 완비하다는 평가를 받고 있다. 본문에서는 우선 일본 청소년 범죄 예방의 상황을 살펴본 후, 일본 청소년 범죄의 현황 및 특징을 분석하기로 한다. 그 중에서 일본 청소년 범죄의 적극적 옝방과 소극적 예방에 초점을 두고 논의할 것이다. 청소년 범죄의 예방에 있어서 일본의 방법과 대책을 참고하여 중국 사회의 여러 관련 부서를 서로 긴밀하게 협력시켜 그 예방의 역할을 제고해야 할 것이다. 특히 정부와 사회가 함께 참여하는 청소년 범죄 예방의 체제를 세워야 할 것이다. 그리고 청소년의 법률 교육을 강화하고 청소년으로 하여금 정확한 인생관과 세계관을 수립하도록 도와줘야 한다. 또한 사회의 환경과 풍기를 정화하고 과학적이고 합리한 청소년범죄의 예방 체제를 건립하는 것도 소홀히 할수 없다. 결론적으로 일본의 청소년 범죄 예방의 경험을 참작하여 중국의 상황에 부합하는 청소년 범죄의 예방 해결책에 조금이나마 계시를 주었으면 하는 바람이다. In recent years, the problem of juvenile delinquency in China has become more and more serious, which has affected the stability and development of society. One of the urgent issues to be solved in our country is to deal with the problem of juvenile delinquency. In contrast , Japan's crime prevention system is relatively complete , and the juvenile delinquency rate is low ,for China’s reference. This paper first introduces the overview of juvenile delinquency in Japan . Secondly , it introduces the current situation and characteristics of juvenile delinquency in Japan . Then it demonstrates the various countermeasures and measures taken by Japan to prevent juvenile delinquency from both positive and negative aspects . China should learn from Japan ’ s practice : close cooperation among various social forces and establish a juvenile crime prevention system jointly participated by the government and society . The popularization of law education for adolescents should be strengthened so as to help them establish a correct outlook on life and world .By purifying the social environment and atmosphere , to build a scientific and reasonable juvenile crime prevention system . Finally hope that China can draw lessons from Japan's valuable experience in juvenile delinquency prevention, and better deal with the problem of juvenile delinquency in the light of our own national conditions.

인터넷 산업이 크게 발전함에 따라 새로운 범죄수단이 계속 생겨나고 있으며, 그중에 사이버 성범죄는 미성년자의 합법적인 권익을 심각하게 훼손시켜 사회 각계의 많은 주목을 받고 있다. 범죄 장소인 사이버 공간과 현실은 다르기 때문에, 사이버 침해에 대한 형법적 규제는 학계에서 어느 정도 논란이 있다. 그러나 인터넷 환경을 정화하고 사이버 성범죄로부터 미성년자를 어떻게 보호할 것인가 하는 문제는 시급히 해결해야 할 문제이다. 이 글은 크게 네 부분으로 나누어서 서술하기로 한다. 1부에서는 현재 사이버 성범죄의 실태, 그 내용, 범죄 형태 및 기존의 성범죄와의 차이점을 소개한다. 2부에서는 현행 형법에 착안하여, 법조문상의 어휘에 다른 죄명의 사법적 해석을 접목하고 이를 깊이 있게 분석하여 후속 연구를 돕고자 한다. 3부에서는 사법적 실천에 입각하여, 현재 사이버 성범죄가 발행하게 된 중요한 원인을 나열할 것이다. 4부에서는 앞서 언급한 문제에 대하여 타당성을 제시하는 한편, 인터넷 질서를 규범화하고 미성년자의 합법적인 권익을 보호하기 위한 방법을 다루고자 한다. With the rapid development of the Internet industry, new criminal means emerge in an endless stream, among which online sexual assault has seriously damaged the legitimate rights and interests of minors, which has aroused widespread concern in all walks of life. Due to the difference between the cyber space and the real world, there is a controversy in the theoretical circle about the criminal law regulation of online sexual assault. However, it is urgent to solve the problems of how to purify the online environment and protect minors from online sexual assault. This paper is divided into four parts. The first part introduces the current situation of online sexual assault, including its connotation, criminal form and the difference between it and traditional sexual crime. The second part, focusing on the current criminal law, makes an in-depth analysis of the key words in the articles combined with the judicial interpretation of other crimes, which is convenient for follow-up research. The third part, based on judicial practice, lists the important reasons for the occurrence of online sexual assault. The fourth part puts forward feasible opinions on the problems mentioned above, aiming at regulating the network order and protecting the legitimate rights and interests of minors.

최근 중국은 “국민경제와 사회발전의 제14차 5년 계획”에 의무교육의 전면적 질의 향상과 학교 운영의 활력을 제고할 것임을 명시하였다. 여기서 일컫는 의무교육의 전면적 질적 향상은 교육의 양호한 질과 균형적인 발전을 요구하고 있지만 중국 현실의 상황을 살펴보면 그렇지 아니하다. 학교들 마다 교육과 운영에 있어서 서로 다르며 현저한 차이를 보여주고 있는 실정이다. 이를 대처하기 위한 일환으로 학군·그룹화 학교의 운영은 양질적이며 균형적 의무교육의 발전을 촉진하는 데에 있어서 방도를 제공하리라 기대되고 있다. 다만 이러한 학교의 운영 방식은 실천 중에서 여러 문제점이 있게 마련이다. 예를 들면 “통합된 제도화 운영체제”, “자원분할 및 공생과 재생의 메커니즘”, “편면적 보수주의 극복과 공동체 의식의 향상” 등의 딜레마가 있기 때문이다. 이러한 딜레마는 학군·그룹화의 발전을 가로막고 있을 뿐만 아니라 학교의 운영 등에 있어서 방해의 역할을 하게 된다. 본고는 이러한 문제점을 염두에 두면서 학군·그룹화 학교 운영의 각 주체들이 적극적이며 지속 가능한 협력관계의 길 탐색; 공동의 책임제도 구축; 교육자원의 공유; 교육 특화화의 관리 등에 연구의 초점을 둘 것이며 최종적으로는 학군의 그룹화 교육과 학교 운영을 최적화 및 상호 이익의 실현에 목적을 두고 실행가능한 제의를 제시할 예정이다. Outline of the 14th Five-Year Plan for National Economic and Social Development of the People's Republic of China puts forward that "improving the quality of compulsory education in an all-round way and releasing the vitality of running a school", which requires the balanced development of high-quality education. In reality, there is often a big gap in the level of running a school between schools, and running schools in school districts and groups provides a feasible realistic path for promoting the balanced development of high-quality education in compulsory education. However, this way of running a school has encountered many problems in educational practice, such as three practical dilemmas, namely, "the combination of appearance and spirit, lack of institutionalized operation system", "resource division, lack of symbiosis and regeneration mechanism" and "sticking to one side and lack of sharing consciousness", which hinder the development of school district groups and even hinder the exertion of the original advantages of this way of running a school. Each subject of collectivized school district should actively explore the path of sustainable cooperation, establish a community of management, teaching, scientific research and students with shared responsibility, resource sharing and characteristic co-creation, truly integrate into an educational community, optimize collectivized school running, achieve mutual benefit and win-win, realize the integration and sharing of resources within the community to a greater extent, comprehensively promote the high-quality and balanced development of compulsory education, and release the vitality of school running.
