민간위탁 시설의 기록관리 필요성 연구 : 서울특별시 자치구 시설형 민간위탁 중심으로

국가가 제공하는 공공서비스 중 상당수 분야가 민간위탁 방식을 통해서 이뤄지고 있다. 공공서비스에서 민간을 통해 제공하는 민간위탁 방식이 주로 채택되는 이유는 전문성과 효율성이다. 그러나 민간위탁 현장에서는 관리감독체계의 부실 등 공공서비스 제공에 있어서 투명성 부족이 제기되고 있다. 행정의 투명성과 설명 책임은 특히 기록관리에 있어 매우 중요한 문제다. 기록은 조직과 그에 속한 개인 활동의 증거이자 업무의 적법성, 투명성을 증명한다. 이에 『공공기록물 관리에 관한 법률』은 투명하고 책임 있는 행정 구현을 목적으로 공공기관에 기록을 보호・관리할 의무와 함께 투명 행정과 책임 행정의 근거를 기록에 의한 설명 책임을 통해 충족시킬 의무를 부과한다. 그러나 공공기록물을 성립시키는 주체는 공공기관이다. 공적 자금을 투여하여 공공서비스를 제공한다고 하더라도 민간위탁 사업의 주체는 민간임으로 민간위탁 시설에서 생산·수집하는 기록물은 『공공기록물 관리에 관한 법률』에 적용받지 않는다. 또한, 민간위탁 사업과 관련된 기록에 대한 통일된 관리 지침 역시 부재한 상태다. 본 연구에서는 이러한 문제의식을 바탕으로 민간위탁 제도의 투명성 확보 방안을 기록관리 측면에서 살펴보고, 기록관리가 민간위탁 사업에서도 필요한 업무임을 드러내고자 한다. 그리고 현재 민간위탁 시설의 기록관리 현황과 이슈가 무엇인지 파악하고 민간위탁 시설 기록물을 관리할 방안을 모색한다. 민간위탁 시설 기록물을 관리할 수 있다면 그동안 민간위탁과 관련하여 지적되어왔던 다양한 문제들을 해결할 방안을 찾을 수 있을 것이다. Many fields of public services provided by the government are carried out through contracting-out. The main reasons for the adoption of contracting-out in public services are professionalism and efficiency. However, there are concerns about the lack of transparency in the management and supervision systems at contracting-out in the provision of public services. Transparency and accountability in administration are particularly important issues in record management. Records serve as evidence of the activities of an organization and its individuals, and also prove the legality and transparency of work. In this regard, the "Public Records Management Act" imposes a duty on public institutions to protect and manage records in order to implement transparent and responsible administration, and also to fulfill their duty of accountability through the explanation of responsibilities based on records. The subject that establishes public records is a public institution. Even if public funds are invested to provide public services, the subject of contracting-out is private, so records produced and collected in contracting-out facilities are not subject to the "Public Records Management Act" In addition, there are no unified management guidelines for records related to contracting-out business. In this study, based on the awareness of these issues, we will examine the measures to secure the transparency of the contracting-out system from the perspective of record management, and aim to demonstrate that record management is also necessary in contracting-out business. We will also identify the current status of record management in contracting-out facilities and issues, and explore ways to manage the records of contracting-out facilities. If it is possible to manage the records of contracting-out facilities, we may find a solution to various problems that have been pointed out in relation to contracting-out so far.
