放火.失火犯의 搜査制度에 관한 硏究 = (A) study on the investigative system of arson and accidental fire

Since the last period of industrial development, fire has been useful and necessary to the everyday life. Although any kind of economic activity can''t be done without fire, we has been neglecting it and in addition fire has been used for criminal purpose by mankind. In Korea, for the last year of 2003, 31,372 cases of fire has been occurred and it gave us the human casualties of 2,833 including the property damage of 151,590 million won. Those property damage increase 5.6 % for the last decade. Among the cases of fire, there were 703 cases of arson and it has been increasing 3.0 % annually. Since last economic crisis in 1997, the cases of insurance crime pretending accidental fire has been increased gradually. In 2003 there were 8,697 cases of insurance crime. Annual increasing rate of insurance crime has been 25.0 %. and the total amount of official insurance pay was 52,909 million won. But, according to the survey by the association insurance of company, it could be a trillion by the year including unidentified one. With the lack of the fully prepared investigative systems and manpower for the arson and any kind of accidental fire, it cannot help admitting that the real cause of the case not only can''t be revealed but also was treated normal case of fire. With respect for the investigative systems for the fire, since last U.S. military government for Korea, it had been unified to a single authority by 1969. It is because the police and fire department was under the ministry of home affairs. But, since last 1970 the duty of fire has been transferred to local government, it is the fact that police agency is the unique for the investigation of the fire case. Fortunately the administration for the preventing fire and accident has been established last July, 2004, a lot of fire work has been changed. But it is still beginning stage and police investigation is the sole method to identify the case. In the developed country such as U.S. the fire investigators take in charge not only to investigate the fire case including the fire death and insurance crime but also to attend the performance the autopsy the body caused by fire. In conclusion, it is absolutely needed to introduce the fire investigator in order to effectively identified the real cause of the arson and accidental fire with its scientific investigative techniques.

국문 초록 (Abstract)

산업문명이 발달되는 과정에서 불은 가장 유익한 도구로 여겨져 왔고 실생활에서 없어서는 안되는 존재가 되어 버렸다. 우리가 살아가면서 불이라는 에너지가 없으면 어떠한 경제 활동도 할 수 없는 현실에서 인간은 이러한 존재를 너무 소홀히 하고 이를 또 가장 유용한 도구로 사용을 하여야 하나 이를 범죄에 이용하고 있는 것 또한 현실이다 2003년 한해동안 우리나라에서 발생한 화재는 31,372건으로 인명피해 2,833명, 재산피해 151,590백만원으로 최근 10년간 5.6%씩 증가하고 있으며 이중 방화로 인한 화재는 703건으로 매년 3.0%씩 증가를 하고 있고, 이로 인한 보험범죄가 갈수록 증가하고 있다. 또한 화재 및 기타사고를 가장하여 보험범죄를 저지르는 건수가 1998년 경제위기부터 갈수록 증가하여 2003년도 한 해 동안 8,697건에 연평균 25.0%씩 증가하고 있으며 이로 인한 보험금 지급액이 52,909백만원으로 이는 공식적으로 보험범죄로 적발되어 수사기관에 적발된 것에 불과하고 이에 포함되지 않은 암수범죄까지 포함하면 손해보험협회 추정으로 연간 1조원에 이르는 것으로 나타나고 있다. 그리고 이러한 화재로 인한 범죄 즉 방화․실화범의 경우 수사제도가 미흡하고 이러한 범죄에 대한 수사분야의 전문성이 결여로 사건의 실체를 밝혀내지 못하고 단순한 화재로 처리를 하고 있다는 것이다. 화재조사에 대한 수사체제는 미군정시대 이후 1969년도까지는 경찰과 소방이 내무부에 통합되어 있어 일원화 되어 있었으나 1970년도 부터는 소방업무가 자치소방를 거쳐 광역소방으로 넘어오면서 이원화 되었으나 현재 화재사고는 경찰수사에 의존하고 있는 실정이다. 2004. 6. 1.자로 독립적인 소방방재청이 설립되어 소방업무도 이제는 많은 변화를 가져오고 있으나 아직까지 화재사고인 방화․실화범의 수사는 아직까지도 경찰수사에 의존하고 있다는 것이다. 선진국인 미국의 경우에는 화재조사관제도가 있어 화재조사관은 화재조사는 물론 이로 인한 범죄인 화재사, 보험범죄등의 수사를 할 수 있는 제도적인 장치가 마련되어 있어 심지어 검시관이 하는 부검에까지 참여를 하여 화재사인지 타살을 은폐하기 위한 살인인가를 밝혀내는데 결정적인 역할을 하고 있다 이에 우리나라도 화재조사관제도를 도입 전문가로 하여금 최초 화재사고 현장에서부터 화재사, 보험범죄 여부, 연소경로등을 객관적이고 과학적인 방법에 의하여 수사를 하도록 하여야 한다.
