아동학대의 실태 및 개선방안에 관한 연구 = The Actual Condition of Child Abuse and Its Improving Measures

국문 초록 (Abstract)

현대사회는 산업화, 도시화와 같은 변화와 더불어 가치관의 변화로 인해 핵가족화 및 빈곤가정이 점차 증가하였으며 사회구조의 변화와 함께 가정에서는 부모가 별거하거나 이혼을 하는 경우가 많아지게 됨으로써 아동학대를 초래하게 되어 아동의 정상적인 사회적, 지적, 정서적 발달에 부정적인 영향을 미치게 됨으로써 가정에서 학대받는 아동들의 학습된 폭력은 학교폭력과 사회폭력으로 연장되어 사회의 폭력지수를 높이게 되며 자신의 아동을 다시 학대하는 세대간 전승효과로 연결되는 악순환을 보이게 된다.
아동학대의 원인은 부모의 성격적 특성을 중심으로 하는 정신병리학적 관점, 아동자신의 특성에 초점을 두는 발달론적 관점, 가정의 특성과 사회문화적 측면을 다루는 사회심리학적 관점 및 문화, 지역사회 그리고 가족의 영향력의 상호작용을 강조하는 생태학적 관점으로 나누어지고 있으며 이러한 아동학대의 원인으로 인해 정신지체와 언어장애 그리고 심각한 정서적, 심리적 후유증을 가지게 된다.
보건복지부 통계에 의하면 우리나라의 2002년 아동학대 발생건수는 2001년 2105건보다 370건 늘어난 2478건으로 나타나 경제적 궁핍과 부부간 불화로 가정내 스트레스가 높아져 아이들의 양육에 무관심해짐으로써 아동학대가 증가하는 추세임을 알 수 있다. 이러한 추세 속에서 아동학대 근절을 위한 노력은 끊임없이 실시되어야 하며 시행착오 속에서의 문제점 및 개선점을 찾아 아동의 인격이 존중받는 사회를 만들어야하는데 아동학대에 대한 대책방안으로 예방적방안, 치료적방안, 법적대응방안, 행정제도적 지원방안, 사회적 지원방안으로 구분하여 살펴보면
첫째, 아동학대 예방차원에서의 홍보 및 교육이 필요하다. 아동학대는 부모역활, 부모의 성격적인 특성, 가치관, 그리고 가정의 경제적인 어려움으로 부부간의 갈등을 고조시키는 원인이 되어 아동학대가 발생되어지는데 아동학대 예방교육과 홍보를 사회언론매체를 통하여 홍보하여야 한다.
둘째, 치료적인 개선 방안이 필요하다. 학대아동은 정서적, 행동적, 인지적 장애를 가지므로 피학대 아동을 위한 보호 및 치료시설을 통하여 아동의 기본신뢰 형성 및 친밀한 대인관계를 형성할 수 있는 기회를 제공하여야 한다.
셋째, 법적 개선방안이 요구된다. 아동학대 대책을 위하여 먼저 아동복지법령에 보다 구체적이고 포괄적인 아동학대에 대한 개념이 시급히 규정되어야 한다. 그리고 아동학대 근절을 위해서 아동학대 발견 시 아동학대 신고에 대한 의무사항을 법적으로 마련하고 아동학대신고를 하지 않았을 경우에 처벌을 무겁게 하는 체벌규정도 법적으로 강화시켜야겠다.
넷째, 행정적인 지원방안이 필요하다. 정부차원에서 아동학대에 대한 사례연구와 아동학대 예방과 치료를 위한 서비스프로그램 개발에 재정적 지원을 하여야 하며 아동학대 관련 서비스 제공을 위한 관련기관과의 협조체계를 구축하여 보다 전문적이고 효과적인 서비스 제공이 이루어져야 한다.
다섯째, 사회적 지원방안의 개선방안이 요구된다. 아동학대치료를 위해 지역사회서비스 활성화 차원에서 아동학대 발견시 부모와 가정의 문제해결을 위한 가정방문서비스나 아동들을 위한 탁아서비스가 이루어져야 하며 아동학대서비스의 질을 향상시키기 위해서는 사회복지사의 증원이 필요하다.
이러한 아동학대 개선방안을 통하여 아동학대 방지를 위해서는 아동학대문제에 대하여 적극적이고 체계적으로 대처함으로써 아동학대에 대한 국민의식을 제고시키고 아동의 건전육성 및 권리증진을 도모하여 아동을 성인과 같은 인격체로 보호할 수 있는 복지제도를 정착하여야겠다.

다국어 초록 (Multilingual Abstract)

In modern societies, nuclear and poor families are increasing gradually due to the change in values, along with the changes like industrialization and urbanization. With the change of social structure, now there are many cases that children's parents live apart and divorce, so this condition can bring about child abuse and also have a negative effect on child's normal social, intellectual and emotional development. Thus abused children's violence, which is a learned behavior from their family, can be connected to the violence in school and society, and can heighten the violence index of society, followed by abusing children of themselves again, showing a vicious circle linked to the effect of inheritance between generations.
The cause of abusing child is classified into several perspectives as follows: psychopathic perspective centering upon characteristics of parents' character; developmental perspective centering upon characteristics of children themselves; socio-psychological perspective centering upon dealing with characteristics of home and socio-cultural aspect; and ecological perspective emphasizing the interrelationship of the influence of family. Owing to these causes of child abuse, children are most likely to have feeble-mindedness, speech disorder, and serious emotional and psychological aftereffects.
According to statistics of The Ministry of Health-Welfare, the number of cases of child abuse of our country in 2002 rose to 2478 cases, showing an increase of 370 cases over last year--2105 cases in 2001. It may mean that child abuse is on an increasing trend on account of the indifference to bringing up children as home stress is on the rise due to financial difficulties and marital trouble.
Under this trend, efforts to eradicate child abuse should be made continuously, and society where children's individuality is respected should be made by finding problems from trials and errors. Thus countermeasures against child abuse can be classified into those for prevention, those for treatment, legal countermeasures, those for supporting administrative system, and those for social support, and they can be examined as the following:
First, it is necessary to publicize and educate in the aspect of the prevention of child abuse. Generally child abuse is caused by the role of parents, characteristics of parents' character, values, and the increase of trouble between husband and wife because of financial difficulties of family, and it is required to educate and publicize the prevention of child abuse through mass media of society.
Second, measures for the improvement of its treatment are needed. Abused children may have emotional, behavioral and cognitive disorder, so opportunities to form children's fundamental trust and intimate personal relationship through facilities for the protection and treatment of abused children should be offered.
Third, measures for legal improvement are needed. For the measures of child abuse, above all more concrete and comprehensive concept on child abuse should be defined in the children's welfare law as soon as possible. Also, to uproot it, legal obligation to report it once it is found should be set up, and punishment rules to lay a heavy burden to persons in case they do not notify the police of it should be strengthened.
Fourth, measures for administrative support are needed. Financial support is required in case studies on child abuse in the level of government and in developing a service program for the prevention and cure of it. Besides, more professional and effective services should be made by establishing the cooperation system with the relevant agencies for the offer of service related to child abuse.
Fifth, measures for the improvement of social support are required. For its treatment, home visiting service and day nursery service to solve the problems of parents and home if it is found that a child is abused should be performed to vitalize community services, and it is necessary to increase social workers to improve the quality of the services.
To prevent child abuse through these measures for its improvement, it is requisite to deal with the problems positively and systematically. In this way, welfare system to protect children's character like adults should be established by considering national consciousness about it and working for the healthy rearing of children and the promotion of their rights.
