The present study deaBt with the issue concerning the rights & its limitations of the state, schooBs, teachers and parents, which are relevant entities in developing and operating school education curricula. The objectives of this study were to identify problems with the
current development and operation of school education curricula, and the causes of the problems based on historical and legal backgrounds. With regard to these purposes, three research problems to be discussed were defined as follows.
First, this study examined the issue of justness of the concept of public education in contemporary society through the histoncal background and developmental process of public education, which are the bases of current development and operation of school education curricula. Second, this study considered the constitutiona]ity of educational ideas on the right of education defined in the constitution and other education-related laws and regulations, and based on the findings, examined the legality of education curriculum doveLopment and operation policies conducted by the state. Third, based on the discussion above, this study examined specifically the right of schools, teachers, parents and students, which are relevant entities in developing and operating school education curricula in each school, as wel] as the relationships among the entities. As a result of this study based on the historical and legal background of public educatien to solve these research problems, the following conclusions were drawn.
Public education started as family-based private education fell into the national system as the state was established. In the process the state that tool over the dominant position in education from parents strengthened ideological Instruction for the political and economical interest of the ruling group. The current 7th Education Curriculum is a representative example that shows clearly the intention to propagate neo-liberalism. Thus the government's exclusive right on education lost its justness. As for legal issue, the national po]icies related to the current development and operation of school education curricula are contrary to the basic idea of securing people's right to education specified in the Constitution, and provisilons related to school education curricula in subordinate education-related lalvs and regulations are likely to violate the Constitution.
In conclusion, the government's policies on the development and operation of school education curricula lack the basis of justness and legality. Thus, it is required to reconsider the government's exclusive development and operation of school education curricula and reestablish the statuses of education entities so that a group of educational experts lead the development and operation, and the state, schools, parents and students participate in it.
