자치경찰제도 도입에 관한 연구

국문 초록 (Abstract)

우리나라는 1995년 이후 본격적인 지방자치 시대를 맞이함에 따라 지역정치와 행정에 대한 지역주민의 관심도가 크게 증가되었다. 이에 따라 정치·경제·사회·교육 그리고 행정에 이르기까지 모든 분야가 지방자치화의 구조로 변화하고 정착되고 있으나 경찰제도 만큼은 중앙집권화된 국가경찰제도를 유지하고 있다.
이로 인하여 경찰기능은 모두 국가사무로 되어 있으며, 경찰공무원도 말단 순경에 이르기까지 국가공무원이로 되어있으므로 경찰관들의 지역주민을 위한 서비스정신이나 책임감이 미약하며, 지역특성에 맞게 개별적으로 처리되어야 하는 사항까지도 중앙의 지시에 따라 획일적으로 처리되고 있기 때문에 지역별 특수성이 무시되어 경찰행정의 효율성이 매우 낮은 실정이다. 따라서 시대적 요구인 봉사경찰로서의 기능을 강화하고 경찰이 권력으로부터 독립하여 정치적 중립성을 확보하며 공정한 공권력을 행사를 통하여 국민의 생명과 공공의 안녕과 질서유지에 전력할 수 있도록 하기 위해 자치 경찰제의 도입이 필요성이 절실히 요구되고 있다.
이에 본 연구에서는 현재의 국가경찰제가 않고 있는 문제점과 외국의 사례를 바탕으로 정치적 중립성을 확보하면서도 국가의 일방적인 지휘·통제에서 벗어나 각 지역의 특성에 맞게 경찰행정을 수행할 수 있는 자치경찰제도를 도입방안에 대하여 살펴보았다.
자치경찰제의 도입형태는 한번도 경험하지 못한 제도의 도입으로 인해 야기될지 모르는 혼란과 시행착오를 예방하기 보완하기 위해 완전한 자치경찰제보다는 세계적인 추세인 국가경찰제와 자치경찰제의 혼합형태가 바람직할 것이다. 또한 자치경찰제가 합리적으로 도입되기 위해서는 경찰의 자율성을 보장할 수 있는 경찰의 독자적인 수사권확보와 자질향상을 위한 제도적 장치가 동시에 이루어져야 하며, 지방자치단체와 지방경찰간의 권한과 책임을 분명히 하여 지방정치인의 간섭을 최대한 배제하여야 한다. 더불어 경찰업무의 혼란을 방지하기 위하여 국가적인 업무와 지방자치적인 업무를 합리적으로 조정해야 할 것이며, 지방재정의 확보를 위해서는 국세의 상당부분을 지방세로 이전해야 할 것이다.
국가경찰제로부터 자치경찰제로 전환한다는 것은 결코 간단한 변화가 아니다. 경찰내부의 조직, 인사, 재정 등 여러 가지 제도의 변화와 정치권, 검찰과의 관계 변화 등, 자치경찰제의 도입으로 인해 해결되어야 할 크고 복잡한 문제들이 얽혀있다. 따라서 자치경찰제의 도입에 앞서 각계 전문가의 다양한 논의가 지속적으로 이루어져야 한다.
그러나 이러한 제도적 변화만으로는 그 동안 잃어왔던 경찰의 신뢰를 일시에 회복할 수 없을 것이다. 따라서 경찰관 개개인이 끊임없는 자기성찰과 노력으로 국가와 국민을 위해 다시 태어난다는 각오를 새롭게 해야할 것이다.

다국어 초록 (Multilingual Abstract)

After 1995, the local residents' interest rate in local politics and administration increased entering the period of Local Government. Also, politics, economics, society, education and administration has changed into autonomous system but only the police system is maintaining centralized national police system.
That's why the police force is one of national affairs and all the police are public officials so the service and responsibility of them are poor. Even things that are supposed to be taken care of individually according to the characteristics of the region, are all directed by the central system so it defies the characteristics of the region and this results very low efficiency rate of the police administration. Therefore as the demand of the time, they need to reinforce the service police and become independent from the authority to form political neutrality. The induction of autonomous policy is really needed to focus on lives of the people, public stability, and maintenance of order by exercising fair authority.
In this study, we looked at the induction plan of autonomous policy that can help to exercise appropriate administration for the region without one-way orders and control of the government maintaining the political neutrality, based on problems of current police and instances from foreign countries.
The autonomous policy is a policy that has been never tried so to prevent disorders and problems, it would be better to use combined policy of national policy and autonomous policy than only using autonomous policy.
Also, to induce the autonomous policy rationally, they need to give individual investigation rights that guarantee autonomy of the police and have a policy that improves the quality. They need to set the authority and responsibility of local autonomous system and local police definitely to restrain interference of the local politicians. They also need to set the affairs of the central government and local autonomous system rationally to prevent the disorder of the police affairs and they need to transfer considerable amount of national tax to local tax for the local finance.
Changing the national policy to autonomous policy is not a easy thing. They need to change a lot of policies such as system, personnel, finance, etc. inside the police and the relation of the police and the prosecution. There are many problems to be solved with the induction of autonomous policy. Therefore, before the induction, experts from different areas should discuss this matter continuously.
Changing the policy will not bring the trust they lost at once. Therefore, the police officers need to think that they are reborn to serve the citizens with continuous effort and self-examination.
