국문초록
현대사회는 급격한 변화로 인해 기존의 사회적, 윤리적 경계가 해체되는 탈 경계의 시대에 접어들고 있다. 이러한 변화는 교정의 영역에서도 형벌과 교화 라는 이분법적 접근의 한계를 드러내며 새로운 전환을 맞이하고 있다. 이에 따라 교정철학의 재정립을 위한 새로운 접근방식이 요구된다.
본 연구는 교정의 목표를 달성하기 위해 刑罰과 敎化의 대립적 구도를 어떻 게 해소할 것인가, 그리고 교정교화를 위해 인간을 어떻게 이해하고 치유할 것인가에 관하여 고찰하였다. 이를 위한 방법론으로 『주역』의 變通觀에 내재 하는 변화와 소통의 가치관, 그리고 『주역』의 생명정신과 인간관에 함축된 共存의 윤리의식을 究明하였다.
『주역』의 변통적 사유방식은 예측 불가능한 현대사회에서 미래에 대한 통 찰과 방향성을 제시할 뿐만 아니라, 상황에 따라 시의적절하게 대응할 수 있 는 실천적 지혜를 제공한다. 또한, 『주역』에서는 인간을 자기변화를 통해 도 덕적 완성에 이르는 존재로 간주함으로써, 교정의 대상인 범죄자 역시 교화개 선이 가능하다고 본다. 이러한 관점은 교정교화를 위한 인격치유의 철학적 기 반이 될 수 있다.
矯正의 근본적인 목적은 사회 갈등의 치유와 더불어 훼손된 인간성의 회복 에 있으며, 이는 사회로의 건전한 복귀를 통해 비로소 가능하다. 따라서 범죄 자에 대한 교정정책 또한 공존의 윤리적 차원에서 사회로부터의 배제가 아닌, 사회와의 지속적인 관계를 강조하는 방향으로 모색되어야 한다.
『주역』의 세계관에 함축된 유기적인 생명정신은 열린 세계관을 지향하며, 이는 포용과 화합을 의미한다. 『주역』의 인간관 또한 인간 내면의 덕성을 길 러내어 인간과 만물의 경계를 긋지 아니하고, 이들의 조화로운 공존과 지속성 을 추구한다. 이러한 생명공동체의 의식 속에서 道義의 실천을 통하여, 인간 본래의 존재를 회복하고 깨닫는 일련의 과정이 바로 교정교화와 인격치유를 위한 방안이 될 수 있다.

Modern society is facing a post-boundary era in which existing social and ethical boundaries are dismantled due to rapid changes. These changes are also facing a new transition in the realm of correction, revealing the limits of the dichotomous approach of punishment and edification. Accordingly, a new approach to redefining the philosophy of correction is required.
This study considered how to resolve the confrontational structure between punishment and edification to achieve the goal of correction, and how to understand and heal humans for correctional edification. As a

- 165 -methodology for this, the value of change and communication inherent in the view on the flexibility in『I ching』, and the ethical consciousness of coexistence implied in the spirit of life and view of humanity in『I ching』 were investigated.
The flexible way of thinking in『I ching』not only presents insight and direction for the future in an unpredictable modern society, but also provides practical wisdom for timely responses to situations. Also in『I ching』, by considering humans as reaching moral completion through self-change, criminals who are subject to correction can also be improved. This perspective can be the philosophical basis for personality healing for correctional education.
The fundamental purpose of correction is the healing of social conflict and the restoration of damaged humanity,and this is possible through a sound return to society. Therefore, corrective policy for criminals should also be sought in the ethical dimension of coexistence in a way that emphasizes continuous relationships with society, not exclusion from it.
The organic spirit of life implied in the worldview of『I ching』aims for an open worldview, which means inclusion and harmony. The view of humanity in『I ching』 also seeks harmonious coexistence and continuity without drawing the boundary between humans and all things by cultivating human inner virtues. Through the practice of righteousness in the consciousness of the living community, the process of restoring and realizing the original existence of humans can be a way for correctional education and personality healing.
