Private land provided to the public is a product of rapid urban development led by the state in the past. The state and local governments needed urbanization through rapid housing supply and infrastructure expansion, and in particular, they preemptively secured major infrastructure roads through urban planning decisions, but financial conditions were not supported.
As buildings were built around the road site, the road site gradually took the form of a road, but it was provided to the public without compensation for the loss to landowners, and landowners continue to insist on claim for removal of disturbance, unjust enrichment claims, and land delivery claims.
Ownership is a right to absolutely use, benefit, or dispose of within the scope of the law, but it is difficult to claim for removal of the disturbance against the public in de facto roads and allows the state or local government to return unfair profits.
In this situation, the Supreme Court is trying to resolve the confusion by developing Korea's own legal principles for "abandonment of exclusive right to use and benefit," but there is still a lot of controversy in academia over violations of Principle of Real Right. Therefore, this study examines the key background and theories based on the situation of private land provided to the public, changes in precedents, and recent lawsuits by the Seoul Metropolitan Government, and suggests directions of rights remedy for landowners whose ownership has been violated for a long time.
