The rapid advancement of the industry has heavily increased the economic value and competitive role of intellectual property (‘IP’). Such change brought about the development of an IP protection regime, which results in IP rights’ utilization across numerous aspects of business activities. Meanwhile, there has existed the notion that IP rights as a statutory monopoly conflict with competition law that views market monopolies suspiciously. This perspective has been largely overcome by the viewpoint that IP laws and competition law function in a complementary manner by help of a common goal of innovation. However, as IP plays an increasingly important role at every corner of business activities, the specific acts of enterprises based on IP rights’ effects are exposing competition law concerns frequently.
Korean competition law, Monopoly Regulation and Fair Trade Act (‘MRFTA’), allows for mitigating inherent tensions between competition law and IP rights to break out throughout individual scenes by means of Section 117, which exempts the application of the law to the ‘due exercise’ of IP rights. However, said provision suggests uniform ruling of competition enforcement in IP-related cases, thereby confining discussions on the legal principles for competition enforcement to the boundary of the questions as to how to interpret the specific provision. Consequently, the precedent studies on the enforcement principles could not but focus on those cases related to patent rights, the most popular type of IP rights active in business activities. Such an attitude is reflected in the IP Guidelines of the Korean competition authority which, for the most part, provides the standards of MRFTA enforcement against the exercise of the patent rights and instructs an analogical application to other types of IP rights the same standards prepared for patents.
Such an approach, however, may incur the principles of competition enforcement set up for patents to be generalized over other classes of IP rights bearing different competitive mechanisms. Thus, this study, on the grounds that the different characteristics and contexts of various types of IPs must be considered in terms of competition enforcement, categorizes various IPs and their genuine features with respect to their competitive significance. Also discussed is the methodology of reflecting such features in the actual enforcement, with a primary focus on licensing activities. Licensing is of specific interest in relation to the subject of this study, for it bears general pro-competitive aspects of enhancing the utility of IPs and promoting creation and dissemination processes of the initial innovation, while also raising competitive concerns under certain circumstances such as market concentration and the deterrence of the follow-up innovation, which thereby forms a major area of competition enforcement.
Specifically, while copyright law is common to patent law in encouraging creative activities, it is fundamentally distinguished from the latter in that it bears the identity of the culture law and protects expressions, not ideas. Copyrights face fewer technological features in general, provide relative exclusivity, and their demands are highly substitutable due to cultural consumption characteristics. However, since functional works such as computer programs are significantly different from traditional artworks, the competitive approaches should also be differentiated even within the copyright regime. Meanwhile, trademark law and unfair competition law interacts with competition policies in a different manner from that of the creation law, such as patent law and copyright law. These laws mainly protect marks, operate on the premises of competitive conditions, and consider public interests by promoting fair competition. Thus, they are more likely to form a complementary interaction rather than a collision. As a different type of IP, trade secrets share common features with patents, including technological and industrial ones, which allow for identifying their competitive characteristics in a similar way to that of patents. However, trade secrets bear stark differences from traditional IP rights as patents with respect to their genuine characteristics of secrecy, which results in unique issues concerning the compulsory disclosure or licensing of trade secrets. The differences in competitive characteristics of each type of IP rights briefly mentioned above may be reflected, along with each IP law’s internal control measures as relating to competition, in the enforcement of MRFTA in each step of assessing relevant markets, market power, and competitive effects including anti-competitiveness and unfairness.
Sound enforcement outcomes depend upon the competition authority’s efforts to reflect the differences pertaining to various types of IPs in the context of enforcement activities. However, it is also necessary to discuss institutional improvements which provides better environments facilitating such efforts. This study reviews, as a manner of forming improved institutional grounds for competition enforcement, legislative measures with proposed amendments to Section 117 of MRFTA as well as policy measures including amendments to the IP Guidelines. Amendments to Section 117 would provide guidance to well-established enforcement by supplementing a clause entrusting detailed criteria of MRFTA application to an administrative rule. By means of such amendments, Section 117 may suggest the applicability of MRFTA even to the exercising of IP rights, which would help overcome legal disputes which manifested surrounding the interpretation of the current comprehensive exemption clause. Along with the amendments to Section 117 of MRFTA, the IP Guidelines would be improved in the same spirit. Being entrusted with the materialization of MRFTA examination principles in IP-related cases, the IP Guidelines may be revised in a manner so as to reflect the characteristics of different classes of IP rights and enhance the predictability of law enforcement.
From the perspective that MRFTA is requested to function as a fundamental law where IP-related activities continue to flourish, the author looked into the manner of sound competition enforcement. The meaning of this study can be discerned in that it sheds light on the need for re-establishing the fundamental concepts of MRFTA enforcement in the context of IP practices, particularly licensing, as well as how it comprehensively introduces the competitive characteristics of individual IP rights and their respective implications for competition policies. Since the differences between individual IP laws have been rarely reviewed throughout former competition law studies, this study focused on the basic setting, and therefore failed to develop more concrete principles and methods of competition enforcement. Nevertheless, the author expects that this study may serve as a kind of momentum in triggering and invigorating further discussions and studies addressing the specific enforcement principles involving individual IP rights.
