Child maltreatment is a physical, sexual or emotional abuse or neglect of children by an adult including parents. In Korea, perpetrators of child abuse or neglect is mostly parents, in other words 'person in parental rights' and it happens continuously. It does just have bad influence on the abused child physically and psychologically but also results in other various forms of violence in the society. It is not just a personal matter and it should be treated as a social problem.
I am here to research on the current condition of the child maltreatment while analyzing the basic concept and the theory of it with the focus on the cases of children abused by own parents or guardians. I am also to proceed the discussion especially with the focus on the restrictions and termination of parental rights as a solution for protection of the child abuse victims.
Parental rights, which means that the custodians have rights and obligations to protect and nurture the children, when practiced, have a problem of conflicting with the protection procedure for the victimized children although the parents are to consider the children’s welfare. Also if the victimized children and the abusing parents are not properly contained separately the victimized children are exposed to the abusing circumstances again. Therefore to maximize the effectiveness of legal protection of the victimized children, proper utilization of the restriction or termination of child custody is in absolute need.
In addition, the legal enhancement of the foster care or guardian system which are common follow-up steps for the victimized children after the parents’ loss or restriction of the custodian rights. In order for the complete follow through of the foster care system, the legal status of foster parents must be regularized and to reduce the burden on the guardian an institutional review of the institutional guardianship or legal guardian system is necessary. Also, for the restricted abusing parents, the government must perform an active intervention to restore the family through diligent operation of treatment program curriculum or counseling system.
In conclusion, this paper is to research on the problems of the child maltreatment cases involving adults with custodian rights by studying the custodian rights and protection system to suggest the solution to prevent the child abuse through restriction or termination of the parental rights.
