Unit owners have the right to ask unit developers for defects liability on aggregate buildings under the Aggregate Building Act Article 9 and the Civil Code Article 667 and 671. The aims of this paper are to review the followings; 1. The Legal Characteristics of Aggregate Building Sales Contract 2. The Legal Characteristics, Contents, and Maintenance periodfor Defects Liability based on Aggregate Building Act 3. The limitation of Defect Liability and Legal Effects of Confirmation Against Defaults Complete.
The committee of apartment dwellers representative and that sort of committee have the right to ask main participants for defects liability under the House Act Article 46, so that this paper includes the reviews on the legal characteristics and contents of defects liability, and characteristics for maintenance period under the House Act EnforcementOrdinance mainly from main participants’ viewpoints, and compares differences with those of defects liability under the Aggregate Building Act.
Although the Aggregate Building Act and the House Act, both amended on May 26th, 2005define that the House Act is prior to other acts when it comes to defects liability for multi-dwelling unit, the House Act doesn’t define the right to demand compensation equivalent to defects repair. Accordingly, it leads different viewpoints and precedents on whether the right is applied to the Aggregate Building Act or not. In this regard, the Supreme Court’s ruling on July 12th, 2012 for the 2010 da 108234 case, states that the right to demand compensation equivalent to defects repair is still applied under the Aggregate Building Act, and that the right for the defects after Acceptance of Work is applied only within the maintenance period under the House Act EnforcementOrdinance. In order to avoid further confusions, the Aggregate Building Act amended on December 18th2012 statedclearly that developers’ defects liability is applied under the Aggregate Building Act. This paper finds that there are differences in application for the House Act and the Aggregate Building Act in accordance with the period of Acceptance of Work, and reviews related precedents.
As the construction business has been on a downturn, construction companies which are alreadybankrupt or under legal management have also increased. In this case, unit owners can’t make unit developers take responsibility for defects liability. They can make a surety organization take responsibility for defects liability instead.
A surety organization’s surety liability, much related to the scope of its liabilitydepends onthe definition of defects after the Acceptance of Work, supporting evidences to prove defects occurred withinthe maintenance period under the House Act EnforcementOrdinance, deposits used for another purpose, effect of Agreement for defect repair conclusion, the validity on the liabilityand so on. This paper suggests new viewpoints on these issues by reviewing related theories and precedents.
A lot of leased apartments have been built to enhance housing security, so that the unit ownersfor leased apartments have the legal right to ask the unit developers for defects liability. Under this circumstance, the Supreme Court regards "the moment of Acceptance of Work" as the starting point of reckoning for the defects liability. However, it may not suggest any solutions for the unit owners who own the leased apartments, converted for sale after 10 years of rental period. This paper is to find out these problems and suggest appropriate solutions.
