The use and disclosure of personal information is considered as a social issue brought by the rapid change in today’s information-oriented society.
In 2011, the National Assembly unified the personal information criteria, which had been separately enacted as special laws, into a single personal information protection act.
The enactment of the personal information protection act was initially proposed for legislation by the government after being selected as one of the 30 major assignments of the e-Government in 2003. Subsequent academic recognition of the act lead to its proclamation by both parties of the 17th assembly and its current enforcement.
As a result, discussions are underway in various fields for its betterment.
Private outsourcing, which is the delegation to private organizations or professionals of the appropriate field in a rapidly changing society, is generally operated in society with great importance.
The privatization of public services, initially introduced as a result of the government’s financial pressure, was accepted as an alternative to overcome the limitations of the inefficiency of the government and the public sector, and is currently continuing its upward trend.
Currently, outsourcing is widespread in society including not only the public services of the government, but also cleaning, manpower, and other services. The overflow of private outsourcing is causing many problems in society regarding the delegation of authority to the authorized organizations, the contradicting regions in the boundaries, and the use and disclosure of private information by the authorized organizations.
While there are cases regarding the use and disclosure of private information by authorized organizations in the process of carrying out consigned businesses, questions are raised on the extent of acknowledgement of the recognition and efficiency of the authorized organizations. Therefore, this paper focuses on the status of authorized organizations and the drawbacks of voluntary restraints based on the efficiency and delegation of authority of the authorized organizations.
Hence, in this paper, we discuss the boundaries of the delegated authority and the appropriateness of the use and disclosure of personal information during the process of carrying out delegated work by authorized organizations.
