The purpose of the study is, through the comparison of special education laws between Korea and China, to research related laws for persons with disabilities and others in the two countries, to analyze structures and the contents of special education laws in both countries, to examine problems of the laws in China, and suggest revised plans for the laws.
In this study, we investigate the systems of both countries’ education laws and related special education laws, and compare the related special education laws and articles. Through that, we analyze the common ground, similarities and differences between two countries’ laws, and study problems of the laws in China to imply revision in special education laws.
Having looked at the results of the comparison of the two countries, problems of special education laws are; Firstly, ‘education ordinances for persons with disabilities’ is supposed to be translated into action as a part of the education legal system, however it has not actually wielded its influence as an independent law. Secondly, like other education laws, the special education laws are so comprehensive that it does not identify specific provisions. Thirdly, the range of special education benefactors is too narrow. The range of recipients should include gifted children with emotional and behavioral disorders, and juvenile delinquents with education and health problems.
Fourthly, free education is needed. At the moment, the disabled people in China do not get free education opportunities with the right of equal education. Fifthly, definitions of the terms of special education laws are ambiguous and no regulations and criteria exist, so that the practical introduction of the laws cannot be performed accordingly.
On the basis of these researches, we suggest the special education regulations in China; we suggest the special education regulations in China be considered but: Firstly by establishing a special education legal system, the effects of the law should be stepped up. Secondly the practical use of legislation has to be improved and specific legal basis regarding the problems of special education has to be considered. Thirdly a law regarding education finances must be enacted so that the disabled can benefit from the right to free education and the range of special education recipients has to be expanded so that the numbers of benefactors can escalate.
