도로부지 보상기준의 개선방안에 관한 연구 = A Study on an Improvement Plan of the Standard of Road Lot Compensation

국문 초록 (Abstract)

토지보상평가중 도로부지의 평가는 과거에서 현재까지 이론적이나 실무적으로 보상평가의 가장 중요한 문제로 되어 있으나, 그것을 합리적으로 개선하는 것은 상당히 어려운 문제이다. 이에 본 연구는 도로부지 보상평가에 대한 문제점을 도출하고 개선방안을 모색하여 국민의 재산권을 더욱 더 충실히 보호하고 공익사업을 효율적으로 추진하는데 기여함에 그 목적이 있다.

법 이론적 접근을 시도하기 위하여 도로부지의 보상평가에 관한 판례, 논문, 보상평가규정, 단행본, 학위논문, 연구보고서, 학회지, 협회지 및 국토해양부에서 발간한 각종 통계 자료 등을 참조하고 감정평가전례, 국토해양부 질의·회신, 법원판례, 국민고충처리위원회 사례를 수집하여 분석하며, 개선방안을 모색하기 위하여 국내외 법규정 관련 단행본, 학위논문, 연구보고서, 학회지, 협회지 등을 참조하여 분석과 현황파악을 근거로 수립하였다.

도로부지 보상기준은 2002년 12월 31일 입법에 의한 제도적 보완에도 불구하고 몇가지 문제점을 내포하고 있어 이에 대한 개선방안을 제시하였다.

보상평가와 관련한 도로개념을 새로이 정립하기 위해서는 공익성과 정당보상이 최상위의 판단기준으로 새로이 정립하고 분류되어야 하며, 구체적인 사례 또는 유형에 근거한 판단기준을 제시할 필요가 있거나, 적용기준을 다양화 할 필요가 있다. 토지보상법 시행규칙 제26조의 내용은 국민의 권리의무에 중대한 영향을 미치는 법규사항에 관한 것이므로 이를 행정규칙이 아닌 법규명령으로 보아야 할 것이다. 토지보상법 시행규칙 제25조에서 규정하고 있는 미불용지의 경우 도로관리청에 매수청구할 수 있도록 관련 규정을 신설하여야 할 것이다.

각종 판례, 민원사례 등을 근거하여 보다 구체적으로 문제점을 분석하고 관련 학자 및 전문가 그리고 보상담당자 참여와 광범위한 설문조사 등이 필요할 것이며, 향후 각 도로부지에 대한 공공기관 및 학계에 의한 실증적이고 구체적인 통계적 조사가 이루어져서 본 연구에서 살펴본 문제에 대하여 합리적으로 제도를 개선하여 국민의 재산권을 더욱 더 충실히 보호하고 공익사업을 효율적으로 추진하여야 할 것이다.

(Abstract)
The road lot assessment, out of land compensation assessment. has been the most important problem both theoretically and practically, but it is quite difficult to improve it rationally. The purpose of this study was to protect people`s properties more faithfully and to contribute to the efficient propulsion of public service by drawing out the problems concerning the road lot compensation assessment and groping for an improvement plan.
References to attempt the legal theoretical approach were the judicial precedents about road lot compensation assessment, articles, regulations of compensation assessment, books, theses, research reports, journals, and various statistical resources published by the Ministry of Land, Transportation and Maritime Affairs. Collections to analyze were the precedents of appraisal and assessment, the question to and reply by the Ministry of Land, Transportation and Maritime Affairs, court cases, cases of anti-corruption & civil rights commission of Korea. Improvement plan was established based on the analysis and current status of books related to legal regulations home and abroad, theses, research reports and journals.
The standard of road lot compensation included a few of problems in spite of the systematical complement by the enactment on Dec. 31, 2002, an improvement plan about that was presented.
To establish the concept of road concerning compensation assessment, the publicity and fair compensation should be newly established and classified as the highest standard of judgement. It is necessary to present concrete cases or the standard of judgement based on type, or to diversify the standard of application. The Compensation Act, Enforcement Rules, Article 25 is about matters that have an important affect on rights and duties of people, so it should be considered not as administrative regulations but as laws and commands. As for the uncompensated lot regulated in the Compensation Act, Enforcement Rules, Article 25, a related regulation should be established so that the Road Administration Service can claim to purchase.
Problems should be analyzed more concretely based on various court cases and civil application cases, and participation by related scholars, experts and officials in charge of compensation and extensive questionnaire survey will be required. Hereafter empirical and concrete statistical investigation by public institutions and the academic world should be carried out on each road lot. People's properties should be protected more faithfully and public projects should be promoted efficiently by the rational improvement of system concerning the problems treated in this research.
