    This thesis aims to understand the Japanese policy of Buddhist cultural properties in Japanese Occupation by focusing the survey project of Japanese Government General of Korea. For this goal, this research expands the notion of cultural properties from the registered cultural properties to Buddhist temples themselves and its belongings such as buildings, pagodas, and statues.
    The Japanese government of the Meiji(明治) restoration had the policy to oppress Buddhism and destruct the Buddhist statues. This was because that government was influenced by Western learning during the 16th century and perceived Buddhism as the unnecessary relics of olden ages. In this circumstance, Japanese Buddhist cultural properties were destroyed with no justification. Afterward Japanese’s reflection for this cultural loss became the opportunity for shift from the destroying remains to preserving.
    Japanese did not apply these kinds of legal and institutional actions to Korea. On the contrary, they encouraged legal and illegal excavation and smuggling and also used these activities to rationalize their occupation of Korea.
    Since 1902 Japanese Government General of Korea researched the condition of Korean Buddhist cultural properties through varied surveys of cultural assets in Korea including Buddhist ones. However only a few budget supports were put into practice. Moreover, a number of ruined Buddhist temple sites were nationalized and the relics and remains were sold, disposed and moved illegally during the survey of historic sites. In these processes cultural properties were damaged.
    In addition, relics and remains excavated during surveys were not only preserved in the storage but also were displayed in the expos and museums to make propaganda for occupation. They used these exhibitions to propagate an idea which Japan and Korea had a common culture and Japan had the right to govern Korea. In this reason most of the displays were Buddhist cultural relics which both Korea and Japan had.
    Main Temple Ordinance(寺刹令) enforced in 1911 was simple action but had a significant meaning, the shift to the new administration which demand Korean Buddhist temple to acquire permission to run temple organization and manage temple’s asset from Japanese Government. In the early enforcement of Main Temple Ordinance they were a lot of criticism and objection to Main Temple Ordinance.
    Revised Main Temple Ordinance had some characters. First, it suppressed the increase of Buddhist temple. Second, it limited Korean Buddhist temples’ right to dispose their property. Third, it gave Japanese Government General of Korea the right to dispose the Korean Buddhist temples’ property due to public enterprises and projects. This law was contrary to the Japanese 'preserve as a national treasure's law(國寶保存法)' which prohibited illegal smuggling cultural treasures, having historic and artistic values and installed 'preserve as a national treasure's meeting' to make measures to preserve and survey cultural properties. Moreover Japan fostered pro-Japanese chief prist at a Buddhist temple(住持) by strengthening chief prist at a Buddhist temple’s competence. The Shift to the ‘main-branch temple's system(本末寺制度)' consolidated chief prist at a Buddhist temple’s position and power and then used them to mobilize Buddhist temple’s property to Japanese occupation.
    Korean Buddhist society tried to popularize Buddhism and diffuse Buddhist cultural properties through anti-Main Temple Ordinance movement, Buddhist newspaper-publishing. Anti-Main Temple Ordinance movement which was the first active resistance failed because of the inside friction with conservative chief prist at a Buddhist temple but became the opportunity to make people realize the negative influence of Main Temple Ordinance. Recovery of old temples performed a large part in preserve traditional Buddhist cultural properties during the infiltration of Japanese Buddhism and the decline of traditional Buddhism.
    In the Japanese occupation, Korean Buddhist society had several developments. First, Korean Buddhist society made a moment to reflect itself by recognizing Main Temple Ordinance’s limits and negativity. Second, it made the foundation to conserve the Buddhist cultural movement. Third, it contributed to arranging Buddhist records.
    Buddhist publishing was consisted mainly of translation of the Scripture and then had an effect on preservation of Scripture and typesets. Especially Lee Neung-hwa's(李能和) A History of Choseon Buddhist(朝鮮佛敎通史) was a kind of extensive and enormous material data and became the good primary historical materials for future historian. In 1900s Buddhist relics were simply introduced as a scenic spot, in 1920s varied traveler’s journals presented temples as great cultural properties, and in 1930s serial articles prevented forgetfulness of Buddhist culture. Despite these efforts these were not practical and overall alternative.
    The policy of Buddhist cultural property by government in Japanese occupation was peculiar and unilateral. They made the special laws to help their rule in Korea through their own experiences in Japan. Japan’s policy of Buddhist cultural properties had a critical deficiency which destroyed the original form. Japan regarded Buddhist temple as a administrative property and used it to propagate its occupation of Korea.

    이 논문은 일제강점기 불교문화재 정책의 역사적 실체를 파악하기 위하여 현대의 ‘지정문화재’ 개념에 국한하지 않고, 사찰 토지를 포함한 건조물과 그에 속한 유형의 유물과 유적을 불교문화재로 규정하여, 불교문화재의 이식과정과 조사사업 및 사찰령 시행에 따른 조선총독부의 정책목적과 실현과정을 통한 문제점 및 불교계의 대응책을 살펴보았다.
    메이지정부의 廢佛毁釋은 16세기 유럽문화를 통하여 성립한 洋學의 영향으로, 일본의 불교문화재가 구시대의 필요 없는 유물로 인식된 결과물이다. 폐불훼석은 일본의 불교문화재가 정의도 없이 사라지게 되는 정책희생물이 되었고, 이에 대한 반성은 국가주도의 문화재 보존정책으로 전환하는 직접적 계기가 되었다.
    일본은 1871년 「고기구물보존방」을 비롯하여 1897년 「고사사보존법」이 시행되면서 ‘고사사보존회’라는 전문가 집단이 중심이 되어 문화재의 조사와 보호가 진행되었다. 1919년 「사적명승천연기념물보존법」은 기념물 개념을 도입하여 문화재 지정의 범위를 확대하였으며, 1929년 「국보보존법」은 주요 문화재의 밀반출을 통제하는 법령이었다. 또한 1933년 「중요미술품 등에 관한 보존에 대한 법률」은 사유유물에 대한 법적 통제력을 강화한 것이 특징이다. 일제는 자국 내 불교문화재에 대한 보존과 보호의 수준을 조선에 그대로 이식하지 않고, 그들의 합법적 또는 편법적 반출과 도굴을 조장하여 식민지 지배의 합리화에 이용하였다.
    일제는 1902년부터 불교문화재를 비롯한 각종 문화재 조사를 통하여 불교문화재의 보존실태를 파악하였으나, 실제로 보존을 위한 예산지원은 일제가 정책상 필요로 하는 몇몇 건에 불과하였다. 특히 고적조사를 실시하면서 발견한 많은 폐사지가 일방적으로 국유화되고 그에 따라 폐사지 내 유적과 유물은 임의처분, 불법매매 또는 移築되는 현상이 발생하였다. 불교문화재의 원적지 이전으로 그 원형을 훼손하는 결과가 초래된 것이다.
    또한 불교문화재의 조사를 통하여 발굴 또는 발견된 불교문화재는 단순히 창고에 보관하는 것이 아니었다. 일제가 內地에서 박람회 및 박물관을 개최하여 긍정적 효과를 거둔 점을 식민지에서도 적용하고자 하였다. 이에 박물관 건립과 전시를 통한 그들의 우수한 문화재 관련경력을 선전하고 동일문화권임을 세계에 알려 식민지지배의 정당성을 확보하고자 하였다. 전시 유물의 대다수가 불교문화재인 것은 일본불교와 상통함을 위장하여 조선민족을 동화하기 위한 수단이었다.
    1911년 시행된 사찰령은 7개조의 간단한 법령이지만, 사찰운영 방식과 사찰재산 관리 등이 조선총독부의 허가를 득해야 가능한 행정체제로의 전환을 의미하고 있다. 사찰령은 시행 초기부터 폐지문제가 대두되었다. 그러나 조선총독부는 막대한 사찰재산의 관리를 목적으로 사찰령 폐지를 검토하지 않고 개정하는데 그쳤다. 개정 사찰령의 주요 특징은 첫째, 사찰의 신설을 현상대로 억제한 것이다. 둘째, 사찰재산에 국한하여 개정을 단행하여 임의적 사찰재산처분을 강력하게 규제한 것이다. 셋째, 일제의 소위 공공사업, 목적사업 등에는 사찰재산의 처분에 조선총독의 재량권을 부기하였다. 즉 일본의 「국보보존법」이 역사적 고증과 미술의 모범이 되는 건조물과 보물의 밀반출을 통제하고 국보보존회를 설치하여 학술조사와 문화재의 본존대책을 마련하는 것에 주목적을 둔 것과 비교된다. 또한 조선총독부는 사찰령을 통하여 주지권한 강화정책을 실시하여 친일주지를 양성하였다. 本末寺體制의 전환은 본산 주지의 위상과 역할을 획기적으로 강화시켜, 전시동원 시기에는 불교문화재를 전쟁물자화하는 데 주지들을 이용하였다.

    일제강점기 불교문화재 정책은 국가 주도하의 일방적 ․ 특수적 종교관리 정책이었다. 일본 자국 내의 현실과 시행착오를 통하여 한반도에 독특한 법령을 시행하여 그들의 통치방식에 부합하도록 제도화한 것이다. 특히, 일제의 불교문화재 정책은 원형 훼손이라는 결정적인 오류를 지닌 정책이라 할 수 있다. 즉, 일제의 불교문화재 정책은 사찰재산이라는 물적 개념의 관리 대상이었으며, 이를 통하여 불교계를 통제하고 그들의 식민정책을 선전하는 대상물로 이용한 것이다.
