통일 후 북한의 지적조사 방안

국문 초록 (Abstract)

현재 우리는 세계유일의 분단국가에 살고 있으며 분단에 따른 이산가족의 문제, 남북의 정치적 ․ 사회적 ․ 경제적 통합 등 남북한이 해결해야 할 많은 과제를 안고 살아가고 있다. 지적제도 또한 이와 마찬가지로 우리가 빠른 시일 내에 해결해야 할 과제 중에 하나이다.
분단이후 남한의 지적제도는 측량 수로조사 및 지적에 관한 법률에 입각하여 꾸준히 발전하여 왔다. 하지만 북한의 경우는 지적제도라고 말할 수 없는 토지의 소유권에 관한 내용과 토지이용에 관한 사항을 다룬 토지법만 있을 뿐이다. 이러한 남북한의 상이한 지적제도가 존재하면 추후 통일이 되었을 경우 국민의 재산권과 밀접한 관계가 있는 지적제도의 혼란을 야기 시킬 수 있다. 그래서 현재 지적제도가 미비한 북한의 지적조사 방안을 검토하여 통일이 이루어질 경우 이를 활용할 수 있는 방안을 모색하고 북한지역의 빠른 지적제도의 정착과 사회적 혼란을 방지하는 것이 주된 목적이다.
북한지역의 지적조사 방안은 먼저 일제시대의 토지조사사업과 임야조사사업의 성과를 분석함으로서 남한 지적제도의 기본 골격을 확인하였다. 북한과 같은 사회주의 지적제도를 도입하여 시행하는 국가 중에서 최근 구소련으로부터 독립한 아제르바이잔, 투르크메니스탄, 우즈베키스탄의 초기 토지등록 사항을 보고 이들 국가가 추진하고 있는 지적제도의 발전 방향을 분석한 후 북한지역에 적용할 지적제도의 발전 방향을 제시하였다. 북한의 지적제도의 발전방향을 알고 그에 상응하는 지적조사 방안을 도출 하였다.
북한의 경우는 측량기술의 낙후, 지적공부전산화 및 토지정보체계의 부재로 지적제도의 형태가 미미하고 거의 토지제도에 흡수되어 폐지되었기 때문에 통일 후 북한의 지적조사는 모든 것을 새로 만드는 과정이다. 성공적인 통일 후 북한의 지적조사사업수행을 위해 국가적 차원의 특별 전담기구를 설립하여 법률적 ․ 행정적 ․ 기술적인 연구가 선행되어야 하며 경제적 ․ 사회적 뒷받침이 있어야 할 것이다.
본 연구는 통일 후 북한의 지적조사사업을 함에 있어서 지적조사법의 제정, 소유권의 확정과 지적공부의 작성, 측량방법, 조직과 인력의 구성, 재원확보 방안을 검토 하였다. 이와 같은 방안으로 지적조사를 실시하여 그 결과를 전산화와 D/B를 구축함으로서 비용절감과 통합운영을 할 수 있도록 하는 개략적인 통일 후 북한의 지적조사 방안을 제시하였다.
