유전자감식정보의 수사상 활용과 인권보호에 관한 연구 : 해상변사체의 신원확인을 중심으로 = Application on DNA identification toward crime investigation & human rights protection

국문 초록 (Abstract)

오늘날 DNA 감식정보의 데이터베이스는 범죄의 사전예방과 범죄인의 사후관리를 통한 재범 방지에 대단히 효율적이라는 평가를 받게 되었고 각국에서 입법화 또는 입법을 추진 중에 있다. 2006년 8월 1일 국회에 제기되었던 ‘유전자감식정보의 수집 및 관리에 관한 법률안”이 정부제안법률로 국회에 접수되었으나 17대 국회 임기 종료로 폐기된 바 있으며, 이 법안을 수정ㆍ보완한 ‘디엔에이신원확인정보의 이용 및 보호에 관한 법률안’이 2009년 12월 7일 국회에서 의결되어 6개월 후인 2010년 6월부터 시행하도록 되어 있다. 이 법안 역시 빈발하고 있는 살인, 강간, 방화 등 강력사건의 범죄수법이 흉포화ㆍ지능화ㆍ연쇄범죄화 됨에 따라 강력범죄자의 디엔에이(DNA)신원확인정보를 미리 확보ㆍ관리하는 DNA신원확인정보데이터베이스 제도를 도입하여 강력범죄 발생 시 등록된 DNA신원확인정보를 통하여 신속히 범인을 특정ㆍ검거하고 무고한 용의자를 수사선상에서 조기에 배제하고, 나아가 DNA신원확인정보가 등록된 사람의 재범 방지 효과를 제고하려는 취지이다. 그러나 수사의 효율성이 확보된다는 이면에는 DNA 정보가 피의자나 수형자의 인간으로서의 존엄성을 침해할 가능성이 도사리고 있다. DNA 정보는 수많은 개인적 성질을 지니고 있어서 그 정보가 유출 또는 오ㆍ남용되면 개인의 인권이 침해될 위험성이 높고, 향후 과학기술이 발달하여 어느 시점에서 모든 DNA 체계가 밝혀지게 된다면 자칫 인류를 파멸로 몰아갈 수 있는 가능성도 배제할 수 없기 때문에 DNA 정보에 대한 무조건적 추구와 의존은 경계해야 할 것이다.
따라서 본 연구에서는 인간의 DNA 정보를 데이터베이스화함에 따라 발생하는 문제점과 수사상 활용방안을 검토하고, DNA 정보의 유출 또는 오ㆍ남용으로 초래될 수 있는 개인의 인권보호방안을 모색하였으며, 특히 종전 수사에서 가장 어려운 영역의 하나인 해상변사체의 신원확인에 DNA 감식기법을 적극 활용함으로써 수사의 효율성을 제고하는 방안을 검토하였다.

The identification information data base has been praised for its usage toward preventing crimes and following up control toward ex-criminals. In numerous countries this system have been legalized and also in a progress of being legalized.
August 1st, 2006 'Collection of DNA Identification and Management act' was proposed at the National Assembly, however was denied due to the closure of 17th term National Assembly. With complementary measures and revisions the 'Act of usage of DNA identification system and protection' was proposed and was decided at the national assembly during December 7th 2009 and takes effect in June 2010.
The crime methods of cases such as Murder, Rape, and Arson have become more truculence, intelligent, and serialized and the usage of securing and following up control on the criminals DNA will bring a strong effect toward excluding innocent suspects and rapidly arresting the specified suspect. Also with the usage of following control with registered suspects DNA will take effect toward preventing second conviction.
However unconditional seek and reliance on DNA information should be looked with vigilance. The usage of DNA Identification system will take strong effect in the area of investigations; there is a high chance of invading the suspects and prisoners human dignity. The DNA contains a numerous unique personalities and with the leak and wrong usage of the information can bring a high chance of invading human dignity and further in the future when we discover the code of the DNA it could bring the destruction of human society.
This act should be carefully reviewed and studied in the area of side-effects when human DNA information has become data-based and also with the pros of usage of investigation. We have reviewed the side-effects when DNA information have been leaked and being used under a different purpose, and also reviewed the effect of usage on DNA information on the most challenging field of our investigation area; identifying marine unnatural death body and the effective usage of using the method for the purpose of investigations.
