The history of human culture is filled with moments of sharing and imitation. Since birth, people are surrounded in cultural environment which is necessary for their development. They acquire understanding of letters and language and obtain knowledge to ascertain history and tradition of their cultural background. From culture, humanslearn all aspects of their ‘lifestyles’, such as art, religion and ethics.
Despite of the varietal concepts of culture, they have been compressed to represent social use of creation of ideas, knowledge, faith and behavior. The use of these creation is part of reasonable human rightsmanifested in Universal Declaration of Human Rights of UNESCO.
Culture contains ‘paradox of public goods’ characteristically. Culture is public rights which shall be enjoyed by human. In this reason, the cultural publicness is realizable in case of recognizing the cultural publicness as objects of joint ownership and enjoyment instead of objects from personal possession and cultural monopoly.
However, cultural publicness is nowadays being controlled and suppressed by a lot of social mechanism. The suppression of cultural publicness is appearing in copyright fields representatively these days. Copyright law has a purpose of achieving ‘cultural development’ through contradictory means called ‘protection’ and ‘limitation’ of rights having been possessed to the author. In the copyright law, a private property rights is aimed to develop the culture ultimately while even ‘limiting’ rights of copyright holder. This reason is derived from recognitions that culture contains important public value in human society and history, and also the development of human society could not be expected only if exclusive monopoly in knowledge is asserted. However, copyright law of the day is being degenerated to a law of controlling approach toward cultural creations. The copyright law having been made for realizing cultural publicness called cultural development is confronting a paradox of destroying cultural publicness by the copyright law.
The reason why the expansion of copyright disturbs national studies, arts or knowledge delivery, educational development along with blocking scientific, technical researches and information communication is lie on the very universal reorganization of intellectual property. The United States is in the center and is compelling strengthened system of intellectual property to other countries. Though there are political, economic discussions which rationalize the logic of intellectual property in the background of strengthening the copyright, those who get substantial profits through these discussions is the cultural capital, not traditional writers.
The copyright rather makes creation difficult by increasing cost of creation paradoxically, even though the cultural capital insists that copyright enhancement activates creative impulse. Copyright enhancement deprives public value called ‘fair use’ and obstructs generation of ‘public domain’. As a result, copyright enhancement increases social cost and results in oppressing human originality while not even promoting creative activity.
In order to resolve these limitation and problems of copyright systems, prejudice on the public ownership shall be overcome.
A method of making promotion of creativeness and renovation having not been achieved from actual intellectual property is the very collective intelligence. The collective intelligence could be said as a public reaction on the knowledge monopoly of minority and an effort of joint ownership on information. Web 2.0 and Enterprise 2.0 are sustainable type of development through collective intelligence.
In order to overcome negative problems having been made by copyright enhancement nowadays, improvement of copyright systems is necessary absolutely in the aspects of laws, policies and socio-culture. Copyright shall not suppress human cultural rights, and shall recover cultural publicness of intrinsic copyright. For the purpose, introduction of fair use clause, reduction policy of protective period on the copyright, expansion policy of public domain and publicness of management policy etc. shall be institutionalized.
This study believes that these methods could be the basis of possibly overcoming the crisis of cultural publicness derived from copyright enhancement. Recovery of cultural publicness is an assignment which shall be resolved for the all mankind living on the present age, and is an asset to be able to leave for the following generations.
