Housing types of Korea have been changed from a single family house into apartments under the influence of industrialization. Thus, management problems of apartment houses such as obsolescence or functional deterioration of apartment houses came to the fore with the passage of time.
To cope with these problems, government enacted the law concerning the establishment of a long-term repair plan and accumulation of allowance for long-term repair. However, there is a considerable gap between the law and reality. As a consequence, the apartment complex has many difficulties in changing the main facilities and operating repair works because of the formal long term repair plan and imposing an excessive allowance for long term repair at the same time. Therefore, this is to suggest reasonable improvement by examining management system of allowance for long term repair and its legal problems. To carry out this study, not only the legal system was examined based on literature reviews but also advanced studies and foreign cases were examined. In addition, interviews were conducted and basic materials were collected by visiting the apartment administration center. A questionnaire was prepared based on survey result. The questionnaire was handed out to apartment complexes located in Seoul and metropolitan area. The result from analyzing the opinions of respondents was as follows.
1. Analysis for the actual condition of present law.
The result acquired through analyzing the execution of laws and regulations showed that allowance for long term repair was accumulated just by the formal plan because the standard for establishing a long term repair plan in reality was not difficult to implement. In addition, discordance between mandatory accumulation target range and mandatory management target range in allowance long term repair was another problem and led to confusion.
To improve these problems, laws, regulations and standards for establishing the plan for long term repair with regard to main facilities of apartment houses should be established flexibly and practically in accordance with the regional characteristics of apartment complexes. In addition, the range that is subject to mandatory accumulation of allowance for long term repair should be expanded.
2. Reflection of housing price variable ratio in calculating allowance for long term repair.
According to the government's statistics, apartment transaction index increased by 4.46 times on average compared with housing price of first occupancy for the past 20 years. On the contrary, levy of allowance for long term repair was nearly the same level as the amount that was calculated at the time of the first occupancy. The reality made provisions remarkably insufficient in repairing or replacing facilities. Due to the problem, it is difficult for long term repair to be done as planned. In order to settle such difficulties, the resonable price for reflecting housing price variable ratio in calculating allowance for long term repair should be set appropriately as well as the price for main facilities should be set in calculating allowance for long term repair by reflecting housing price variable ratio of apartment houses, and also the price for main facilities should be executed in a timely manner by calculating with the latest one. Long term repair construction should be executed in a timely manner by reflecting housing price variable ratio and revising unrealistic housing laws and regulations for the purpose of increasing the value of assets in accordance with the level of housing quality and its efficiency .
3. Analysis of differences between planned allowance for long-term repair and actually charged levy.
There is considerable validity in just having formal conditions in that it is dealt with only by the laws and regulations for long term repair for most of the apartment complexes to calculate allowance for long term repair. Besides the different amount between allowance based on a long term repair plan at the first stage and the actually charged levy was imposed on the tenants of apartment houses. As these laws and regulations were standardized and enacted without considering the characteristics of apartment complexes, it is understandable not to produce actual results. Therefore, the education that emphasizes long term repair plan and allowance for long term repair should be given to tenants and managers of apartment houses. In addition, items for establishing long term repair plan stipulated in housing act should be improved to reflect reality appropriately.
To improve and realize actively these problems mentioned, not only apartment Housing management law integrating the several provisions related to the management of apartment housing stipulated in the present housing act should be revised to reflect the reality appropriately, but also professional management agency should take full charge of policy according to the integrated guidance and controls.
