다문화가정 자녀의 '교육권리' : 다문화가족지원법을 중심으로 = Children's 'Educational Rights' of Multicultural Families

국문 초록 (Abstract)

이 연구는 다문화 사회로 변화하는 현대 사회의 변화에 맞추어 우리 사회에서 다문화 가정 자녀들이 겪는 교육 문제에 주목하고, 그들의 교육 권리가 제법률에서 어떻게 보장되고 있는지를 살피고자 한다. 특히 최근 만들어진 다문화가족지원법에서의 다문화 가정 자녀의 교육 권리가 확보되고 있는지를 살펴보고, 다문화 가정 자녀의 교육 권리 향상에 도움이 되는 개정 방향을 살펴보는 것에 목적이 있다.
이러한 연구 목적을 달성하기 위해서 우리 나라 다문화 사회로의 변화 양상을 찾아본다. 문헌 연구의 방법을 통해서 선행 연구 자료의 우리 나라 다문화 가정 자녀의 학교 교육에서의 문제점들을 유형화한다. 이를 통해 다문화 가정 자녀의 교육권리를 살펴볼 수 있는 분석틀을 만들어 보았다. 분석은 크게 세 부분으로 이루어진다.
첫째, 다문화가정 자녀의 교육받을 권리, 교육 기회가 법으로 보장되어 있는가?
둘째, 다문화주의적 관점에서 다문화가족지원법이 마련되었는가? 다문화가족지원법에 다문화교육 실시와 소수 민족의 언어를 중시하는 다문화주의적 관점이 반영되어 있는가?
셋째, 우리나라 다문화 가정 자녀의 학교 생활에서의 문제점으로 대두된 특수성을 다문화가족지원법이 반영하고 있는가?
분석틀을 통해 다문화가족지원법을 분석한 결과는 다음과 같다.
첫째, 결혼이주민 여성의 적응만을 목표로 한 지나치게 제한적인 대상만을 다루고 있어 다문화가족지원법이 목적으로 하는 다문화 가정과 그 자녀들의 ‘삶의 질’ 향상에 기여하는 데 제한이 있을 것으로 보인다.
둘째, 기존의 ‘국적’ 개념을 벗어나 ‘정주’ 개념을 도입할 필요가 있다. 다문화 가정의 범주에 있어서 이주노동자가정, 새터민 가정을 포함시켜 법적 권리를 확보하는 것이 중요하다.
셋째, 다문화가정 자녀 교육에 있어서 본국의 언어, 문화를 활용할 수 있는 이중언어교육 및 다문화교육을 실시할 수 있는 법령이 마련되어 있지 않다.
넷째, 현 다문화 가정 자녀와 관련한 제정책을 주관할 정부 기관이 산발적이어서 관련 기관들의 긴밀한 협조가 이루어질 수 있는 행정 시스템의 보완이 필요하다.
다섯째, 다문화가정 자녀와 관련하여 다문화가정의 저소득 문제, 진학률 저하문제를 해결할 수 있는 직업교육 및 구직을 위한 기초능력 함양을 위한 법규정이 마련되어야 한다.

다국어 초록 (Multilingual Abstract)

This paper attempts to pay attention to educational issues children of multi-cultural families face in the times of a modern society changing into a multi-cultural society and to see how their educational rights are guaranteed in existing laws. Especially, after closely examining if the Act to Support Multi-cultural Families, recently enacted, allows them appropriate educational rights, it intends to make suggestions for a way to amend the law to improve children's educational rights of multi-cultural families.
For this, it first searches for Korean society's changing direction to a multi-cultural society and materializes problems at schools children of multi-cultural families face by studying documents through previously conducted researches to create standards for analyzing their educational rights, which can be mainly divided into three parts.
First, are the children's educational rights of multi-cultural families guaranteed by laws?
Second, is the Act to Support Multi-cultural Families made from a multi-cultural perspective? Does the Act reflect a multi-cultural perspective considering the practice of multi-cultural education and languages of minority races important?
Third, does the Act reflect children's particularity of multi-cultural families, which rises as problems at schools?
The outcomes of analyzing the Act to Support Multi-cultural Families are following.
First, because the Act limits its subject to female immigrants with their marriages for their adjustment, it has difficulty covering multi-cultural families themselves and their children's improved 'life qualities.'
Second, it needs to adopt 'settlement' concept transcending the pre-existing 'nationality' concept. It is fundamentally important to secure legal rights of all the different types of multi-cultural families, when considering the ranges of multi-cultural families, including immigrant laborers' and the North Korean defectors' (called Saetermin).
Third, no Acts deal with an issue of granting such children bilingual education and multi-cultural education about their foreign parents' native countries.
Fourth, the government agencies sponsoring current policies related to the children of multi-cultural families are scattered around. Therefore, a supplemental administrative system is necessary to mediate more intimate cooperations among those agencies.
Fifth, the amendment on the Act should provide multi-cultural families with vocational education and the ways to improve basic capabilities for being employed, which will solve the multi-cultural families' low-income problems and the children's low ratio of going on to a higher stage of education.
